  • STATIC DISPLAY REQUIREMENTS

  • The insurance requirements for exhibiting an aircraft at the US Aircraft Expo Static Display event are fairly consistent, with the main variable(s) being the dollar limits of the policies and the list of additional insureds.

    There are five (5) distinct and separate requirements for insurance coverage:

    1 Comprehensive general liability insurance, including broad form contractual liability coverage, with limits of at least $1,000,000 combined single limit, per occurrence, for bodily injury and property damage, at least $1,000,000 for products-completed operations aggregate, at least $1,000,000 for personal and advertising injuries and at least $50,000 for fire legal liability; Please note that the required single limit amount is a variable

    2 Aircraft liability insurance, including premises liability, with limits of at least $1,000,000 combined single limit, per occurrence, for bodily injury and property damage including passengers

    3 Aircraft hull (all risk) insurance for the full replacement value of the aircraft.

    4 Workers' compensation insurance in accordance with statutory limits and employers' liability with limits of at least $1,000,000 per accident

    5 If Exhibitor will own or operate any motor vehicles at any Facility, automobile liability insurance with limits in an amount adequate to cover all of Exhibitor's motor vehicles at the Facilities but not less than $1,000,000.

    All insurance must be primary and non-contributory to any other insurance coverage and Exhibitor shall obtain a waiver of subrogation on each policy in favor of the additional insured parties. Mackin Aviation LLC dba US Aircraft Expo must be named as additional insured on the liability insurance policies to the limits of each policy, even if those limits are in excess of the requirements of this section

  • EXHIBITOR CONTRACT TERMS & CONDITIONS

  • The US AIRCRAFT EXPO (USAE) ("Event") is produced by the US AIRCRAFT EXPO ("Show Management") The Event is scheduled to be held in 8 (Eight) Different Airports in the United States (each location listed above, a "Facility") on 8 (Eight) different dates (each listed above "Exhibitor" means, collectively, the entity that is applying to exhibit at the Event, the authorized representative ("Representative") of that entity executing this contract on its behalf and, where applicable, that entity's officers, employees, contractors and agents.

  • 1. Effectiveness. This contract becomes binding once the Exhibitor's application has been accepted by Show Management. Show Management reserves the right to reject applications with or without cause if in the best interests of the Event. 2. Exhibit Space Assignment. Upon acceptance by Show Management, Exhibitor will be assigned exhibit space in accordance with the procedures established by Show Management. Exhibitor will not be assigned space until all fees due under this contract have been received provided Exhibitor has no outstanding obligations to Show Management. Show Management may modify or relocate Exhibitor's space at any time if it is in the best interests of the Event. Exhibitor acknowledges that this contract, including its cancellation provisions, will remain effective even if Show Management exercises its right to modify or relocate Exhibitor's space. 3. Cancellation. Requests to cancel or reduce space from Exhibitor must be submitted in writing. The parties acknowledge that the actual damages likely to result from Exhibitor's cancellation or space reduction are difficult to estimate on the date of this contract and would be difficult for Show Management to prove. Therefore, the parties intend that Exhibitor will remain liable for the original exhibit fee amount as liquidated and agreed upon damages and not as a penalty. 4.Directory; Publicity; Data Protection. Show Management may list Exhibitor's name, trade names, product names and Representative's name and contact details on website, social media or other promotional materials. Show Management will not be liable for any errors in any listing or materials or for omitting Exhibitor from the directory or other materials. Show Management and its partners may photograph or otherwise record any aspects of the Event, including Exhibitor's space, booth, aircraft and personnel, and use such photographs or recordings for any purpose. Personal information shared with Show Management by Exhibitor will be processed and retained in compliance with the US Aircraft Expo privacy policy. Exhibitor shall only provide personal information to Show Management for individuals from whom Exhibitor has obtained consent. 5. Sharing; Assignment. Exhibitor shall not assign, share or sublet its assigned space without the written consent of Show Management. Show Management may allow Exhibitor to share its space with another entity (that entity, a "Co-Exhibitor") if: (1) Co- Exhibitor meets any requirements of Show Management. (2) Exhibitor and Co-Exhibitor each complete any required forms and pay the applicable fee; and (3) Exhibitor and Co- Exhibitor have an established business relationship. The Exhibitor and Co-Exhibitor are collectively referred to as the Exhibitor. 6. Exhibit Space Operation. Exhibitor shall install and occupy its space in accordance with the rules and timeline specified. Exhibitor's aircraft, if any, must comply with the arrival and departure procedures and timeline adopted by Show Management. 7. Insurance Requirements for Exhibitor With Aircraft. If Exhibitor will display one or more aircraft within its exhibit space, then the terms of this section 7 will apply. Exhibitor and shall maintain the following during the entire Event, including move-in and move-out periods: (1) commercial general liability insurance, including broad form contractual liability coverage, with limits of at least $1,000,000 per occurrence, combined single limit for bodily injury and property damage, at least $1,000,000 for products- completed operations aggregate, at least $1,000,000 for personal and advertising injuries and at least $100,000 for damage to premises rented to you; (2) aircraft liability insurance, including premises liability, with limits of at least $1,000,000 combined single limit, per occurrence, for bodily injury and property damage including passengers; (3) aircraft hull (all risk) insurance for the full replacement value of the aircraft; (4) workers'

  • 11. Violations. Upon the violation by Exhibitor of any of the terms of this contract, Show Management may take one or more of the following actions: (1) require modifications to Exhibitor's booth or space at Exhibitor's expense; (2) cancel Exhibitor's exhibit space assignment; (3) declare Exhibitor ineligible for priority lotteries at future events produced by Show Management; or (4) disqualify Exhibitor from exhibiting at future events produced by Show Management. These remedies are illustrative only and do not limit any remedies described elsewhere in this contract or otherwise available by law. 12. Severability. The parties intend that, if any provision of this contract is held to be unenforceable, then that provision will be modified to the minimum extent necessary to make it enforceable and the rest of the contract will remain in effect as written. 13. Representative; Communications. Show Management shall direct communications related to the Event, including notices under this contract and additional rules and regulations, to the Representative by email, mail or hand delivery. Notices from Exhibitor to Show Management, including the designation of a new individual as Representative, must be sent by email to marketing@usaircraftexpo.com, by mail or overnight carrier to US Aircraft Expo 14600 N. Airport Dr., Scottsdale, AZ 85260 or by hand delivery. 14. Rules and Regulations. Show Management or a Facility may adopt or amend rules and regulations governing the Event at any time. 15. Waiver; Entire Agreement. No waiver of satisfaction of a condition or failure to comply with an obligation under this agreement will be effective unless it is in writing and signed by the party granting the waiver, and no such waiver will constitute a waiver of satisfaction of any other condition or failure to comply with any other obligation. This contract, including any additional rules or regulations adopted by Show Management in accordance with section 21, constitutes the entire understanding between the parties with respect to the subject matter of this contract and supersedes all other agreements, whether written or oral, between the parties. 16. Governing Law. Exhibitor consents to the jurisdiction and laws of the State of Arizona without giving effect to its principles of conflicts of law, all matters arising out of this agreement or Exhibitor's participation at any event, and agree that Arizona shall have exclusive jurisdiction, and venue for any claims shall be in Maricopa County, Arizona. Arizona Law applies. 17. Acknowledgement: I acknowledge the contagious nature of the Coronavirus/COVID-1 and that the CDC and many other public health authorities still recommend practicing social distancing. I further acknowledge that US Aircraft Expo has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I further acknowledge that US Aircraft Expo cannot guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Expo staff, and other Expo Attendees and their families, Vendors, Food Truck and other onsite personnel. I voluntarily attend the event with US Aircraft Expo and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-1 I acknowledge that I must comply with all set procedures to reduce the spread while participating at the event.

    * Staff is not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.

All insurance must be primary and non-contributory to any other insurance coverage and Exhibitor shall obtain a waiver of subrogation on each policy in favor of the additional insured parties. Mackin Aviation LLC dba US Aircraft Expo must be named as additional insured on the liability insurance policies to the limits of each policy, even if those limits are in excess of the requirements of this section. The Exhibitor Service Kit may contain additional insurance requirements. Exhibitor shall furnish evidence of insurance coverage meeting the requirements of this section as requested by Show Management. Exhibitor acknowledges that the requirements of this section in no way limit the liability of Exhibitor. Additional insurance requirements may be required if Exhibitor has any aircraft towed to the Orange County Convention Center. 8. Insurance Requirements for Exhibitor Without Aircraft. If Exhibitor will not display any aircraft within its exhibit space, then the terms of this section 8 will apply. Exhibitor shall maintain the following during the entire Event, including move-in and move-out periods: (1) commercial general liability insurance, including broad form contractual liability coverage, with limits of at least $1,000,000 per occurrence and $1,000,000 aggregate, combined single limit for bodily injury and property damage, at least $1,000,000 for products-completed operations aggregate, at least $1,000,000 for personal and advertising injuries and at least $100,000 for damage to premises rented to you; (2) workers' compensation and employers' liability insurance in accordance with statutory limits; and (3) if Exhibitor will own or operate any motor vehicles at any Facility, automobile liability insurance with limits in an amount adequate to cover all of Exhibitor's motor vehicles at the Facilities but not less than $1,000,000. All insurance must be primary and non-contributory to any other insurance coverage and Exhibitor shall obtain a waiver of subrogation on each policy in favor of the additional insured parties. US Aircraft Expo must be named as additional insured on the commercial general liability and automobile liability insurance. 9. Indemnification; Assumption of Risk. Exhibitor shall indemnify Show Management and each Facility, and their parent and subsidiary companies, shareholders, officers, employees, agents and contractors, against all losses, damages, claims, demands, actions, penalties, judgments and liabilities (including court costs and reasonable attorneys' fees) that arise from any acts or omissions of Exhibitor or any of Exhibitor's EACs related to the Event, including, without limitation, any activities they may be conducting at the Event, or from any breach by Exhibitor of any term of this contract. Exhibitor assumes full responsibility for any risk of bodily injury, death or property damage or loss arising out of or related to Exhibitor's participation at the Event, whether caused by negligence, intentional act or otherwise. The parties intend that this indemnification and assumption of risk be construed as broadly as permitted by law. 10. Waiver of Liability. Under no circumstances will Show Management be liable for any lost profits or any incidental, special, indirect, punitive or consequential damages of Exhibitor, regardless of whether such losses or damages were foreseeable or Show Management was informed of the possibility of such losses or damages. The maximum liability of Show Management under any circumstances will not exceed the exhibit fee actually paid by Exhibitor to Show Management.

  • * I do not believe any staff have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19 *Staff have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities. *All Staff are following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19 We hereby release and agree to hold US Aircraft Expo and all other Contracted Vendors and Food trucks harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the salon, or that may otherwise arise in any way in connection with participating with and attending the US Aircraft Expo. I understand that this release discharges US Aircraft Expo and all contracted Vendors and Food Trucks from any liability or claim that I, my heirs, or any personal representatives or Employees may have against the Expo with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, attending and participating at the Expo. This liability waiver and release extends to the Expo together with all owners, partners, Vendors, Attendees, employees and City and Airport Employees and staff.

    Any person who attends an AZ US Aircraft Expo Static Display or seminar grants permission to USAE, its employees and agents (collectively "US Aircraft Expo") to record his or her visual/audio images, including, but not limited to, photographs, digital images, voices, sound or video recordings, audio clips, or accompanying written descriptions, and, without notifying such person, to use his or her name and such images for any purpose of USAE, including advertisements for USAE and its programs.
