  • COVID-19 Liability Waiver and Acknowledgment

  • The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment or cure for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.

The Erdenheim Farm Foundation cannot prevent you or your child(ren) from becoming exposed to, contracting, or spreading COVID-19 while participating in the Erdenheim Farm Foundation’s summer camp program (“Camp”). It is not possible to prevent against the presence of the disease. Therefore, if you choose to or allow your child(ren) to participate in the Camp, including Camp activities, and/or enter onto the property of Erdenheim Farm (the “Farm”), you may be exposing yourself and your child(ren) to and/or increasing your own risk and your child(ren)’s risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my child(ren) in order for my child(ren) to participate in the Camp and enter the Farm. The Camp and Camp activities are of such value to me and/or to my child, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order for my child to participate in the Camp and Camp activities and to enter the Farm.

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against the Erdenheim Farm Foundation, Erdenheim Farm Foundation Explorers Camp, Erdenheim Farm, LLC, Erdenheim Farm (EQ), LP, Erdenheim Farm (SB), LP, The 2015 McCausland Descendants Trust, and, as applicable, the respective affiliated entities, owners, directors, managers, officers, agents, representatives, employees, successors and heirs of each of the foregoing and any other persons on the Farm, on behalf of myself and/or my minor child(ren), in connection with exposure, infection, and/or spread of COVID-19 related to the Camp, Camp activities and/or the Farm. I understand that this waiver means I give up my right to bring any claims on my own behalf and on behalf of my minor child(ren), including claims for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

ACKNOWLEDGMENT: I acknowledge that I have read, understand and agree to comply with any written COVID protocols provided regarding distancing, masks/face coverings, handwashing and sanitizing. I further acknowledge and represent that neither I nor my minor child(ren) has been diagnosed with COVID-19, are exhibiting COVID symptoms, or have had any known COVID exposure within the last fourteen (14) days.

CHOICE OF LAW: I understand and agree that the law of the Commonwealth of Pennsylvania will apply to this contract.

  • NOTICE: THE PARENT/GUARDIAN OF THE C.I.T NAMED BELOW IS REQUIRED TO READ AND SIGN THIS ACKNOWLEDGMENT OF RISK AND RELEASE OF LIABILITY AND INDEMNITY BEFORE C.I.T WILL BE PERMITTED TO  PARTICIPATE IN ANY ACTIVITIES

    I.    INTRODUCTION. The Erdenheim Farm Foundation (“Foundation”) is pleased that you are interested in having your child (“Counselor In Training" "C.I.T") attend and participate in the Foundation’s summer camp program, Erdenheim Farm Foundation Explorers (the “Camp”) at Erdenheim Farm (the “Farm”). Through your child’s participation with the Camp, the Foundation will further serve its mission of education on the importance of the Farm and its history, while highlighting the Farm’s physical and cultural landscape. Before C.I.T is permitted to enter on to the Farm or participate in any Camp Activities (as identified below), you must read and sign this document. Please read this document carefully before signing as it contains important information on the risks associated with the Farm and Camp, as applicable, and the affirmative release of certain of your legal rights.

II.    ACKNOWLEDGMENT OF RISK. I am the parent and/or duly authorized guardian of the below named C.I.T. In consideration of C.I.T being allowed to join and participate in the Camp, I, the undersigned, as such parent and/or duly authorized guardian, acknowledge and understand that the Farm is an active farm, and that, without limitation, the use of farm equipment, devices and vehicles, the presence of livestock, horses and other animals and the performance of operations at the Farm present inherent risks to persons and property. I acknowledge and understand that C.I.T’s entry and continued presence on the Farm property and participation in the Camp, as applicable, places C.I.T at risk of serious personal injury or death and/or damage to property. I acknowledge and understand (a) that farm animals can and may behave unpredictably and in ways that may result in injury, harm or death to C.I.T or to persons nearby, (b) that conditions exist at the Farm that may be dangerous or hazardous, (c) C.I.T may incur serious injury, disability or death as the result of not only C.I.T’s own actions, omissions or negligence, but also as the result of the actions, omissions or negligence of others at the Farm or in connection with C.I.T’s participation in one or more activities related to the Camp including, but not limited to, interacting with hens, sheep, goats and other farm animals, hayrides, walks or hikes at the Farm and areas adjacent or proximate thereto, food preparation and working in a vegetable garden, in addition to other activities as may be authorized by the Camp Director (collectively, the “Activities”), and (d) that there may be other risks other than as expressly set forth above that are not known to me, C.I.T or to the Camp or Farm personnel or the Released Parties (as identified below), or not reasonably foreseeable at this time including, without limitation, economic and social losses (the foregoing (a), (b), (c) and (d), collectively, the “Risks”). I acknowledge that C.I.T IS present AT THE CAMP AND on the Farm property voluntarily, and I understand the Risks associated with C.I.T’S continuing presence AT THE CAMP AND on the Farm property AND ENGAGEMENT IN THE ACTIVITIES. I confirm and agree that C.I.T will not enter upon any area of the Farm other than those areas as shall be designated by authorized Camp personnel. I fully understand that the Camp and related Activities involve one or more of the Risks and that such Risks and any other dangers may be caused by C.I.T’s own actions or inactions, the actions or in actions of others participating in the Camp or one or more Activities, the condition in which any of the Activities take place or the negligence of others. I FULLY ACCEPT ALL SUCH RISKS AND ALL RESPONSIBILITIES FOR ANY LOSSES, COSTS AND/OR DAMAGES THAT C.I.T OR I MAY INCUR AS A RESULT OF C.I.T’S presence AT THE CAMP, on the Farm property OR PARTICIPATION IN ANY ACTIVITIES.

In addition to the above, I acknowledge that I understand the nature of the Camp and that C.I.T is (1) in good health and in proper physical condition to be able to join and participate in the Activities, and (2) I have disclosed in writing to Camp personnel all known allergies, sensitivities, medical conditions and required medications, if any, of C.I.T. I further agree and warrant that if at any time I believe the conditions of any Activities to be unsafe for C.I.T’s participation, I will immediately notify Camp personnel and discontinue C.I.T’s participation in such Activities.

III.    PERMISSION. In the event of any injury to C.I.T, I hereby grant permission to the supervising staff to attend to C.I.T. If any such injury warrants further medical attention, I grant permission for necessary medical treatment to be given to C.I.T including, without limitation, transport to a hospital, physician or other medical facility or medical professional (collectively, “Medical Attention”).

IV.    WAIVER AND RELEASE OF LIABILITY; INDEMNITY.  I hereby waive, release, discharge, covenant and agree not to sue, and I defend and hold harmless Erdenheim Farm Foundation, Erdenheim Farm Foundation Explorers Camp, Erdenheim Farm, LLC, Erdenheim Farm (EQ), LP, Erdenheim Farm (SB), LP, The 2015 McCausland Descendants Trust, and, as applicable, the respective affiliated entities, owners, directors, managers, officers, agents, representatives, employees, successors and heirs of each of the foregoing and any other persons on the Farm (collectively, the "Released Parties") from and against all demands, suits, actions, claims or damages on account of personal injury, death, and damage or loss to property which may result from C.I.T’s entry and continuing presence on the Farm and participation with the Camp, Activities and any Medical Attention, as applicable, even if caused in whole or in part by the actions, omissions or negligence of any of the Released Parties. If despite signing this Acknowledgement of Risk and Release of Liability and Indemnity, I make any claim against any of the Released Parties, I will indemnify, save and hold harmless each of the Released Parties from any litigation expenses, attorneys’ fees, loss, liability, damage or cost which Released Parties may incur as a result of such claim. This release is in addition to and not in limitation of any release afforded to the Released Parties under law.

    V. ONE-ON-ONE POLICY: If your child receives one-on-one aide support in school, it is required that they attend camp with their designated aide. This policy is in place due to the active nature of our farm environment, and presents various safety risks. The presence of a one-on-one aide will ensure that your child receives the necessary supervision and support to maintain their safety while participating in camp activities.

Furthermore, all one-on-one aides must submit copies of their Pennsylvania State and Federal clearances prior to the commencement of camp. These documents will be reviewed and kept on file to ensure compliance with safety regulations.

VI. Peanut/Nut-Free Policy: To ensure the safety of all campers, the Camp reserves the right to designate the camp as a peanut/nut-free environment on a weekly basis, as needed. This decision may be made in response to individual camper needs or in consultation with medical personnel. In such cases, we will communicate any changes to the Camp's food policy to all families and staff to ensure compliance. Parents are required to adhere to these guidelines and provide safe, peanut/nut-free snacks and lunches for their child. This policy is implemented to reduce the risk of allergic reactions and to maintain a safe and inclusive environment for all campers.

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND I UNDERSTAND THE FOREGOING ACKNOWLEDGMENT OF RISK AND RELEASE OF LIABILITY AND INDEMNITY IN ITS ENTIRETY. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF THE RELEASED PARTIES FROM ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I AGREE THAT IF ANY PORTION OF THIS ACKNOWLEDGMENT OF RISK AND RELEASE OF LIABILITY AND INDEMNITY IS HELD TO BE INVALID, THE BALANCE SHALL CONTINUE IN FULL FORCE AND EFFECT.
