The following constitutes the Videography Agreement (the “Agreement”) of Quality Filmz (the “Videographer”). Please read the Agreement in its entirety and contact the Videographer if you have any questions or concerns about the Agreement. As used in the Agreement, all references to “you” or “your” or the “Client” refer to the signer of this Agreement. You will be able to preview the Agreement prior to its submission, at which time you are encouraged to print a copy for your records.
It is understood that Quality Filmz is the exclusive Videographer retained by the client to cover the outlined event. Any conflicts with video coverage contracts and any notifications necessary to avoid such conflicts are the sole responsibility of the client.
Client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be required for Quality Filmz at each event, public or private. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions. The client agrees that he/she has the legal rights to anything Quality Filmz will video at the wedding ceremony. All other video content recorded on the day of the wedding will be the product of Quality Filmz for inclusion in the client's final video.
Quality Filmz is not responsible for poor audio if the groom does not agree to wear a lapel microphone, dark or grainy video resulting from inadequate lighting or the refusal of the client to allow additional lighting provided by Quality Filmz at the reception, or electrical or mechanical malfunctions on location that are beyond our control.
Quality Filmz will establish an arrival time for the wedding date with the client prior to that date and remain on duty for the number of hours included in the package. Coverage hours included in the package are for the wedding date only and must be consecutive.
Quality Filmz reserves the right to use videos and photos for display and or for promotional purposes. All final video masters, wedding ceremony footage, and audio captures remain the exclusive property of Quality Filmz. Such property will be provided to the client as it is specified with the selected video package.
Artistic Style. On its own behalf and on behalf of the subject: The client acknowledges that he/she is familiar with Quality Filmz’s portfolio and is requesting services with knowledge of the videographer's style and that Quality Filmz’s work is constantly evolving; that Quality Filmz's services are of a unique and artistic nature; that the video may be different from videos done by the company in the past; and that in creating the videos we shall use our own creative artistic judgment to create videos consistent with our personal judgment and consistent with our vision of the event, which may be different from the clients and or the subject’s vision of the event. Accordingly, the client acknowledges that the videos shall not be subject to rejection on the basis of taste or esthetic criteria. Additionally, it is the client's responsibility to inform Quality Filmz of any specific shot selections that the client would like captured.
If Quality Filmz fails to comply with the terms of this agreement due to any event or beyond the control of Quality Filmz, including but not limited to illness, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Quality Filmz’s liability is limited only to a refund of all non-deposit related monies received.
The client reserves the right to terminate the contract for any reason up to 5 days after the date of initial deposit. Should the client terminate the contract, all money paid minus the deposit retainer which is 35% of the total cost will be refunded.
Quality Filmz reserves the right to ask any attendee who may be inhibiting the ability of the videographer to capture footage to adjust the actions that are preventing the videographer's capturing of said footage. This includes but is not limited to, standing in the aisle of the ceremony's location, the capturing of footage on the attendee's personal video recording devices, and the crowding of a select area in which the couple will be filmed.
Both the client and Quality Filmz agree to the terms of delivery which includes final video masterings between 2-3 months after the date of the contracted wedding.(Wedding Date)
If for any reason the client chooses to change the contracted date he/she agrees to pay additional retainer costs for the second date.
Any overage time that exceeds 60 min will be calculated at an hourly basis of $350/hour. Additional hourly rates will be factored in once the overage time exceeds the 60-minute mark. To resolve this additional cost the client may request a staged couple walkout to be filmed. This decision must be brought to Quality Filmz's attention at least 1 hour in advance of the staged walkout in order to give videographers time to plan accordingly. If the client fails to inform Quality Filmz of a staged walkout, then it is to be assumed that the night will go on as initially planned.
