BUCKET OF ADVENTURES PARTICIPATION WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

I understand that participating in events organized, sponsored, coordinated, or hosted by Bucket of Adventures may involve risks, including but not limited to injury, illness, accident, medical emergency, death, property damage, theft, or other loss. These risks may arise from the nature or location of an activity; outdoor, unfamiliar, or changing environments; weather, terrain, traffic, water conditions, or other conditions; equipment; transportation; the actions or omissions of other participants or third parties; or the ordinary negligence of Bucket of Adventures, its organizer, event hosts, assistants, volunteers, agents, representatives, or other persons involved in organizing or conducting an event.

Bucket of Adventures events may include, but are not limited to, walking, hiking, recreational and outdoor activities, social events, excursions, travel-related activities, water activities, swimming, boating, kayaking, rafting, transportation, and other activities that may involve physical activity or inherent or unexpected risks. I understand that the specific risks may vary depending on the particular event, location, activity, weather, conditions, and circumstances.

I understand and acknowledge that participation in Bucket of Adventures events is voluntary. I am responsible for determining whether I am physically and otherwise capable of participating safely in any particular event. I agree to use reasonable care for my own safety, comply with applicable laws and safety requirements, follow reasonable instructions provided by the event organizer or host, and promptly notify the organizer or host of any condition or circumstance that may affect my ability to participate safely.

I understand that Bucket of Adventures is a social and recreational group and that its organizers, hosts, assistants, and volunteers cannot provide continuous personal supervision of every participant at every moment of an event. I remain responsible for my own actions, decisions, health, safety, belongings, and personal needs while participating.

I understand that group activities may involve participants becoming separated from the group. This may occur when a participant voluntarily leaves the group for a restroom break, personal matter, emergency, or other reason, or otherwise chooses not to remain with the group. When reasonably possible, I agree to notify the event organizer or designated host before leaving the group and to follow instructions regarding meeting locations, departure times, routes, regrouping, and other event procedures. I understand that Bucket of Adventures and its organizers cannot guarantee that a participant who leaves the group can be continuously located, supervised, or accompanied.

ASSUMPTION OF RISK
I knowingly and voluntarily assume all risks associated with my participation in Bucket of Adventures events, including known and unknown risks, foreseeable and unforeseeable risks, and risks arising from the ordinary negligence of the released parties identified below, to the fullest extent permitted by applicable law.

RELEASE AND WAIVER OF LIABILITY
In consideration of being permitted to participate in Bucket of Adventures events, I, on behalf of myself and, to the extent legally permitted, my heirs, personal representatives, successors, and assigns, voluntarily release, waive, discharge, and hold harmless Jaleh Siadat Donaldson, Bucket of Adventures, its organizers, event hosts, assistants, volunteers, agents, representatives, and participating property owners from claims, demands, causes of action, liabilities, losses, damages, costs, and expenses arising out of or relating to my participation in a Bucket of Adventures event, including claims arising from the ordinary negligence of the released parties.

This release is intended to be interpreted to the fullest extent permitted by applicable law. Nothing in this agreement releases, waives, or limits liability that cannot legally be released, waived, or limited, including liability arising from gross negligence, willful misconduct, or other conduct for which a release is prohibited by law.

THIRD-PARTY SERVICES, VENUES, AND PROVIDERS
I understand that Bucket of Adventures may use, visit, or coordinate with third-party businesses, venues, transportation providers, tour operators, activity providers, guides, hotels, restaurants, cruise operators, airlines, and other independent service providers. I understand that such third parties are independent entities and that Bucket of Adventures does not control every aspect of their services, facilities, equipment, employees, or conduct.

To the fullest extent permitted by applicable law, I release Bucket of Adventures and the released parties from claims arising from the acts, omissions, negligence, services, facilities, equipment, or conduct of independent third parties involved in or associated with an event.

TRANSPORTATION
I understand that transportation associated with an event may involve additional risks, including automobile, bus, van, boat, aircraft, or other transportation-related risks. Unless expressly stated otherwise for a particular event, I understand that Bucket of Adventures does not necessarily own, operate, or control transportation services used in connection with an event.

MEDICAL TREATMENT AND EMERGENCIES
I understand that Bucket of Adventures organizers and hosts are not medical professionals and are not responsible for providing medical care. In the event of an injury, illness, or medical emergency, I authorize event organizers or hosts, to the extent reasonably necessary and permitted by law, to seek emergency medical assistance for me. I understand that I am responsible for my own medical expenses, treatment, transportation, and related costs.

PERSONAL PROPERTY
I understand that I am responsible for my personal belongings and property while participating in Bucket of Adventures events. To the fullest extent permitted by applicable law, Bucket of Adventures and the released parties are not responsible for lost, stolen, damaged, or misplaced personal property.

INDEMNIFICATION
To the fullest extent permitted by applicable law, I agree to indemnify and hold harmless the released parties from claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees and costs, arising from my own negligent or wrongful acts, omissions, or misconduct in connection with my participation in a Bucket of Adventures event, or from claims brought by another person arising from my conduct.

GENERAL PROVISIONS
This waiver and release applies to my participation in all current and future Bucket of Adventures events for which I am permitted to participate, unless a subsequent written agreement expressly replaces or modifies this waiver.

If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

I acknowledge that I have carefully read this Participation Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement. I understand its contents, understand that I am giving up certain legal rights by signing it, and voluntarily agree to its terms.

By signing below, I confirm that I have had an opportunity to ask questions regarding this agreement and that I voluntarily agree to participate in Bucket of Adventures events subject to these terms.
