I am applying to sell at Farmers Market(s) managed by Oscar G. De Leon. I understand that the Manager is responsible for making, implementing and enforcing all rules and regulations in a fair and equitable manner. I further understand that the Manager may at any time modify or terminate the following market rules. I understand that in order to submit this application, I will be required to sell only Admissable Products and agree to Rules and Regulations.
ADMISSABLE PRODUCTS
Agricultural producers are vendors who produce certified agricultural products and non- certifiable agricultural products.
All non-certifiable agricultural products must have been produced or derived from plants or animals grown, bred, raised, cultivated or collected upon land, which the producer controls. Appropriate County and or State environmental health paperwork will be required (permits), such as proof of certified kitchen and packaging site.
A certified producer may sell non-certifiable agricultural products if such products (including the ingredients comprising such products) have been:
• Produced or derived from plants or animals
• Raised or produced by such certified producer
• Are grass fed
• Contain no antibiotics
• Do not contain genetically modified ingredients (GMOs)
The ingredients may be in solution such as brine or vinegar, but (for example) if olive oil is used, olives must be on the Certified Producers Certificate.
Second Certificate (Farmer Partnership) The market manager may allow a farmer to sell certified products from another farm if grower certificates are “cross-referenced” and if the products are not otherwise available for sale at the market.
RULES AND REGULATIONS
DISLPAY BUSINESS INFORMATION - All Vendors must have and display their business name, contact information, and City of origin. If a Vendor certified organic, he or she must display the certification
FOOD LABELING - All prepackaged food must be packaged and labeled prior to farmer’s market arrival according to Cal. Health & Safety Code § 114089 (a) and § 114089 (b).
OFF THE GROUND - All Vendors must keep the ground free from any food products at all times.
HEALTH PRECAUTIONS - All Vendors must protect food on display from contamination by the using gloves, paper towels, HOT water container, water disposal container, hand sanitizer, chlorine, watered chlorine for utensils, trash receptacles, service lines, sneeze guards that intercept a direct line between the consumer's mouth and the food being displayed, containers with tight-fitting securely attached lids, display cases, mechanical dispensers, or other effective means. See Cal. Health & Safety Code § 114060.
CERTIFICATE DISPLAY - All Vendors must have and display updated original copies of Grower’s certificates, Health Department Permits and Employee Letters during market hours. Cal. Code Regs. tit. 3, § 1392.4(d) Certificates must be displayed on the front top side of the canopy.
TEMPERATURE CONTROL - All pre-packaged items are to be kept within regulated temperatures and properly identified by a business label. Cal. Health & Safety Code § 113996
PRICE DISPLAY - All Vendors must display price tags on ALL items
DIFFERENTIATE PRODUCT CATEGORIES - All Vendors must identify Certified Organic Products AND Conventional Products if the Vendor has both. Cal. Code Regs. tit. 3, § 1392.4(h).
APPROVED SCALE - When any agricultural products are sold by weight, the type of scale used shall be approved by the Department of Food and Agriculture, and shall be tested and sealed for use by the County Sealer-Director of Weights and Measures. Cal. Code Regs. tit. 3, § 1392.4(e).
SETUP - All vendors must arrive for setup no later than one hour before the opening of the market, and must be ready to operate at the market's scheduled opening time.
BREAK DOWN - All vendors will begin breakdown at market closing and no earlier, and will complete breakdown no later than one hour after market closing.
SETUP/BREAK DOWN - For emergency access and efficicent traffic flow, vendors are required to park next to designated vendor space while loading and offlaoding, leaving at least 20 feet of space in the middle of the street. Vendors may not bring thgeir vechiles into the market area until a parking space becomes avilable. Benodrs are encouraged to help one another during set up and breakdown.
BOUNDARIES - Vendors must keep all equipment, tables, chairs, and products within their assigned boundaries and must set up in such a wy to allow participants to easily identify distinct vendors.
BOOTHS - Vendors are required to provide their own materials for booth setup, including a 10x10 canopy, tables, table cover, and an identifying banner. All items/tools must be clean and in working order.
BOOTH SPACE - Although the Manager will work to honor requests, vendors will be assigned a booth in a specific area to best serve the Farmers Market.
NO SMOKING - Out of courtesy for guests, food safety and concern for young attendees, the Farmers Market is a smoke-free environment.
NO ALCOHOLIC BEVERAGES - No alcoholic beverages are allowed anywhere within market grounds.
NO PETS - Pets are not permitted to enter Farmers Market grounds. Vendors are expected both to adhere to this rule and to help enforce it by asking patrons to remove their pets from the market premises and/or keep pets at least 20 feet away from booths.
HAZARDS - Booth areas must be safe and free of hazards (tripping, fire, stacked heavy objects, etc.). All items are to remain off sidewalks and contained within booth space during market hours. If items do not fit within booth space, items must be kept in vehicles.
TRASH RECEPTICAL - Vendors must provide a clearly marked trahs receptacle large enough to contain all the trash they and their patrons will generate at the event. When the Market closes, vendors must ensure that their designated booth areas are clean. Vendors must deposit all the trash they generate in their own receptables. Receptables provide by the Farmers Market are for use by the public ONLY. Dumpster containters/City trashcans in the Market area are private and cannot be used by Vendors.
PARKING - Hourly vendor parking or free street parking is generally available on streets nearby any given Market.
MARKETING - Vendors are encouraged to assist in marketing the Farmers Market even through social media channels, literature, sharing recipes, and other means.
ATTENDANCE - Vendors who are unable to attend the Faremrs Market MUST inform the Manager at least 48 hours prior to the Market. Vendors who miss four markets may lose the right to participate.
FAILURE TO COMPLY - Failure to comply with any Rules and Regulations, or engaging in unlawful behavior on Faremrs Market grounds during market hours; or behaving in a manner inconsistent with the expectations of Farmers Market guests; or creating a safety hazard; may be subject to suspension or dismissal from participating in the Farmers Market.
ENFORCEMENT - The Manager will enforce Rules and Regulations as follows: First Violation - Vendor will receive an oral warning; Second Violation - Vendor will receive a written warning; Third Violation - Vendor will receive a final written warning; Fourth Violation - Vendor will be dismissed from Market participation.
FEES
WEEKLY - All Vendors and Exhibitors will pay a fee each week to participate in farmers markets they've been approved for.
FARMERS AND FOOD VENDORS - Farmers and Food Vendors are required to complete a Space Fee Load Sheet for each market, including the business owner's name, farm or business name and the produce or products that are being sold. The fee is 7% of gross slaes for the day, plus a $2 Agriculture Department fee.
ARTS AND CRAFTERS - $35 per day
BUSINESS EXHIBITORS - $50 per day
CORPORATE EXHIBITORS - $100 per day
LOCAL NON-PROFIT ORGANIZATIONS - One organization per week per market, free of charge
