CLIENT/GUARDIAN WAIVER - RELEASE OF LIABILITY, PHOTO/VIDEO RELEASE AND WAIVER OF LEGAL RIGHTS

THIS AGREEMENT (“AGREEMENT”) INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS AND DEPRIVES YOU AND OTHERS OF CERTAIN LEGAL RIGHTS, INCLUDING, BUT NOT LIMITED TO, THE RIGHT TO SUE LIQUID LIFESTYLES, INC AND OTHER PARTIES. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY. SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT.
I, the undersigned participant, parent, or legal guardian of myself, a child, or the children listed above (hereinafter individually and collectively referred to as "Participants"), intending to be legally bound, hereby recognize and acknowledge that neither Liquid Lifestyles, Inc. (hereinafter referred to as “Liquid Lifestyles”) nor any of its employees, representatives, associates, volunteers, members, and/or officials carry any medical, health, and/or hospital insurance that would cover any injury while Participants are participating in any programs and/or activities provided, sponsored, or recommended by Liquid Lifestyles, including, but not limited to, rigorous physical training, sports training, and/or racing (individually and collectively, the “Activities”).
I acknowledge that the Activities are or may be an extreme test of a person’s physical and mental limits and carry with them the potential for death, serious injury, and/or property loss. I certify that each Participant is sufficiently healthy for participation in the Activities, and neither I nor the Participants have been advised against participation by a qualified health professional. I am aware of and accept the risks associated with possible exposure to any communicable diseases, including but not limited to COVID-19 or other similar illnesses.
I, on behalf of myself, each Participant, and all heirs and personal representatives, assume all risks and possible costs associated with participating in the Activities. Further, I do hereby defend, hold harmless, indemnify, release, and forever discharge Liquid Lifestyles, the host facility, its managers and operators, and their officers, agents, insurers, employees, representatives, associates, volunteers, members, officers, directors, and/or shareholders (individually and collectively, the “Released Parties”) from and against any and all claims, demands, actions, or causes of action, actual or threatened, on account of damage to personal property, personal or bodily injury, and/or death arising out of or in connection with Participants’ participation in the Activities, regardless of fault or negligence of Liquid Lifestyles or any of its officers, agents, or employees.
Further, on behalf of each Participant, myself, and all Related Parties (defined as my spouse, children, parents, guardians, heirs, relatives, next of kin, insurers, and/or any legal or personal representatives, executors, administrators, successors, and/or assigns), I waive, release, and discharge Liquid Lifestyles, the host facility, and all other Released Parties from any and all claims, losses, or liabilities resulting from or arising out of Participants’ involvement in the Activities.
