RELEASE/WAIVER South Baltimore Brewery District Cleanup November 30, 2024
This legally-binding Release and Waiver (this “Release”) is made by me, the undersigned, in favor of Trash Free Maryland, Checkerspot Brewing Company, Pickett Brewing Company, Wico Street Beer Co, M8 Beer Co, and each of the foregoing’s affiliates and their respective directors, officers, managers, employees, agents and representatives (collectively, the “Companies”).
I understand that I am/my child is participating voluntarily in a clean-up activity and that I/my child will not be reimbursed for my/my child’s time and efforts. I understand that there are inherent risks associated with participating in clean-up activities, which may be both foreseen and unforeseen and may include serious bodily injury, death, or damage to my/my child’s personal property. I understand that I/my child may be exposed to the actions and negligence of employees, volunteers, and other persons present and to dangerous conditions present at the location of the clean-up activity. I understand that these examples are not all-inclusive and that there may be additional risks. I agree to assume all risks associated with my/my child’s participation in this clean-up activity with the Companies.
In consideration for the opportunity to participate in this clean-up activity with the Companies, I, for myself and on behalf of my heirs, personal representatives, executors, administrators and assigns, willingly and knowingly hereby irrevocably release and forever discharge the Companies from any and all liability for any bodily injury or damage to my/my child’s personal property relating to my/my child’s participation, including any such claims or causes of action caused in whole or in part by the negligence, mistake or failure to supervise of the Companies.
I understand that I am solely responsible for any hospital or other costs arising out of any bodily injury or damage to my/my child’s personal property relating to my/my child’s participation in voluntary clean-up activities with the Companies and therefore hereby agree to indemnify and hold harmless the Companies from those costs.
I am/my child is physically fit to participate in this clean-up activity with the Companies. I understand that there are no medical services available on site or otherwise, and I give permission to the Companies to authorize medical treatment for me/my child if I am unable to give authorization myself.
I hereby release the Companies from liability for any injury or damage that might extend from such emergency medical treatment. If any medical treatment is needed from a healthcare provider, all costs shall be my responsibility. I understand that, should there be any material change to my/my child’s ability to participate in voluntary clean-up activities with the Companies, I will notify the Companies before I/my child continue to voluntarily participate.
I agree to grant Trash Free Maryland all right, title, and interest in any and all photographic images and video or audio recordings made during my/my child’s voluntary clean-up activity, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
