WAIVER AND RELEASE OF LIABILITY

THIS IS A RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT for all events of BOOMERS ROCK.

IN CONSIDERATION of being permitted to participate in any way in any of the Events of Boomers Rock, THE UNDERSIGNED, for him/herself, personal representatives, heirs, assigns, and next of kin:

LEGAL OR NONLEGAL REMEDIES WHATSOEVER AGAINST BOOMERS ROCK, its affiliates, managers, directors, officers, members, agents, staff, volunteers, representatives, and anyone else associated with the Event(s), (collectively "Releasees"), for any and all liability to the undersigned, his/her personal representatives, assigns, heirs, and next of kin for any and all loss or damage, and any claim or demands therefore for injury and/or exposure to infectious syndromes or diseases to the person or property or resulting in injury, illness and/or death of the undersigned arising out of or related to any and all Event(s) or preparation for the Event(s) of BOOMERS ROCK, whether caused by the negligence of the Releasees or otherwise. By participating, preparing, or attending the event, I assume all risks whether known or unknown.

1. I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT TO SEEK NO

I HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releasees from any loss, liability, damage or cost they may incur arising out of or related to the Event(s) whether caused by the negligence of one or more of the Releasees or otherwise. I specifically acknowledge that the Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. 3. If I should require medical care or treatment, I authorize Boomers Rock to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. I further understand that BOOMERS ROCK is a not for profit entity under Arkansas and Federal Law. 4. I HEREBY acknowledge THE ACTIVITIES OF THE EVENT(S) MAY BE DANGEROUS and involve risks including but not limited to exposure to infectious syndromes and diseases, serious illness, injury and/or death and/or property damage.I assume full responsibility for any risk whatsoever, including, but not limited to bodily injury, exposure to infectious syndrome or disease, death, or property damage arising out of or related to the EVENT(S) whether caused by the negligence of Releasees or otherwise.

I HEREBY grant to the Releasees, in perpetuity, the right, with or without my knowledge, to film, tape, photograph, record, exhibit, edit, alter, copy, reproduce, license, sell, rent, disclose, display, publish, distribute, broadcast, webcast, prepare derivative works from or otherwise preserve, use and/or exploit in any format and/or manner now known or hereafter developed, whether commercial or non-commercial in nature (collectively, the "Use and Materials"): (1) my appearance at and/or participation in the Event; (2) my name, likeness, signature, voice, singing voice, conversation, sounds, biographical data, testimonials, and/or any other information or material secured by the Releasees in connection with my appearance at and/or participation in the Event(s I agree that Releasees shall have the right to the Use and Materials, for their own account. I acknowledge and agree that I shall not be entitled to receive any compensation whatsoever in connection with the Releasees' use and materials rights. 5. I HEREBY AGREE AND UNDERSTAND that should any part or portion of this INDEMNITY AGREEMENT be determined to be legally invalid or unenforceable for any reason, only such part or portion shall be severed and removed from the Agreement. The remaining provisions and all portions of this Agreement that have not been ruled invalid or unenforceable shall independently survive and remain in full force and effect, with only the invalid or unenforceable part or portion of this Agreement to be deemed stricken, unenforceable and severed from this Agreement. 6. I HEREBY AGREE that this Waiver and Release of Liability survives in perpetuity for any and all Boomers Rock Event(s) unless and until this Waiver and Release of Liability is mutually released by both the Board of Directors for Boomers Rock and the signatory herein. The signatory hereto acknowledges that this Waiver and Release of Liability applies to any and all events of Boomers Rock Event(s 7. Any controversy or claim arising out of or relating to any injuries or events that fall under this Waiver and Release, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any Arkansas court having jurisdiction thereof. Venue shall occur in Hot Springs Village, Arkansas.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF ALL RISK, AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
