MIP & KJ Liability Waiver

This LIABILITY WAIVER AND RELEASE OF CLAIMS (the "Waiver") is executed on Date* by First Name* Last Name* (herein "Participant"), and KJ DANCE DESIGNS, INC, a Texas corporation and MAKE IT PRO DANCE, LLC, a Texas limited liability company, as well as its members, manager, contractors, vendors, affiliates, and representatives (herein collectively the "Studio").

Acknowledgement of Assumption of Risk. The Participant acknowledges that dance involves physical activity that carries inherent risks. These risks include, but are not limited to, physical injury, falls, sprains, strains, and other injuries that may arise from dance practice or performance. The Participant voluntarily assumes all such risks associated with participation in any classes, rehearsals, or events conducted by the Studio.
Waiver of Rights and Release of Liability. In consideration of being permitted to participate in dance instruction and related activities provided by the Studio, the Participant hereby releases, waives, discharges, and covenants not to sue the Studio from any and all liability, claims, demands, or causes of action for personal injury, property damage, or wrongful death arising from or related to participation in the dance activities, whether such injury or damage results from the negligence of the Studio or otherwise.
Indemnification Clause. The Participant agrees to indemnify, defend, and hold harmless the Studio from and against any and all claims, demands, losses, liabilities, damages, and expenses, including legal fees, arising from or related to any injury, damage, or loss incurred by the Participant or any third party as a result of or related to participation in the dance activities.
Waiver of Right to Jury Trial. The Participant agrees that any legal action or proceeding arising out of or related to this Waiver or participation in the dance activities shall be conducted in a court of competent jurisdiction without a jury trial. The Participant waives any right to a jury trial to the fullest extent permitted by law.
No Guarantee of Success. The Participant acknowledges and agrees that the Studio does not guarantee that participation in the dance instruction will result in making a team or advancing in any tryout process at any recreational, collegiate, or professional level. The Studio makes no representations or warranties regarding the outcome of any dance tryouts or evaluations.
Applicability to All Locations. This Waiver applies to all activities conducted at any location owned, leased, or otherwise operated by the Studio, including but not limited to dance studios, rehearsal spaces, and performance venues.
Severability. If any provision of this Waiver is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Governing Law. This Waiver shall be governed by and construed in accordance with the laws of the State of Texas.
