ASSUMPTION OF RISK, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT
The individual to sign this document will be referred to as "Participant", "You", or "They". Trail to Taproom, including all staff and employees, agents, assigns, successors, subsidiaries, insurers and any other representatives, are hereinafter collectively referred to as "Trail to Taproom."
This Agreement is applicable to all Participants while such individuals participate in activities and attend events operated and run by Trail to Taproom and/or for all other purposes encompassed by and during Trail to Taproom trips, hereinafter referred to as "Trip", "Trips", or "the Trip".
PARTICIPANTS: READ THIS DOCUMENT CAREFULLY BEFORE SIGNING.
By signing this agreement and voluntarily participating in activities with Trail to Taproom, you acknowledge that you have read and agree to each of the following terms and conditions:
Trail to Taproom WILL NOT pay for or provide alcohol to any participants whatsoever. All participants are required to purchase their own beverages on their own tabs.
Trail to Taproom trips are not guided. All hikes are self-guided, however, a staff member from the Trail to Taproom team will walk with the group to provide turn-by-turn directions and answer questions throughout the experience.
1. Age and Physical Capability
The Participant hereby attests and warrants that they have attained the age of majority, being no less than twenty-one (21) years of age. Furthermore, the Participant represents and warrants that they possess the requisite physical capacity and fitness to engage in and complete all activities associated with Trail to Taproom excursions, without limitation. Attendees under twenty-one (21) years of age must have written consent from a parental or legal guardian with Trail to Taproom staff, signed on behalf of the underage participant, at the bottom of this agreement.
2. Nature of Activities
The Participant acknowledges and accepts that Trail to Taproom excursions encompass public land use, pedestrian sidewalks and parking lots, and paved/unpaved hiking trails. Hiking routes will not exceed five (5) miles in length, and no more than two (2) stops to local brewing establishments.
The Participant further accepts full responsibility for the provision of all necessary hiking equipment and assumes sole financial liability for any and all expenses incurred at said brewing establishments, including alcoholic drinks, non-alcoholic drinks, and food.
3. Assumption of Risk
The Participant assumes any and all risks, whether known or unknown, foreseeable or unforeseeable, associated with participation in Trail to Taproom activities. Such risks include, but are not limited to, bodily injury, property damage, and any adverse effects resulting from the consumption of alcoholic beverages.
4. Waiver of Liability
The Participant hereby waives, releases, and forever discharges Trail to Taproom, its staff, officers, agents, employees, and representatives from any and all claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury that may be sustained by the Participant during participation in Trail to Taproom activities. This waiver does not extend to acts of intentional misconduct by Trail to Taproom.
5. Indemnification
The Participant hereby agrees to indemnify, defend, and hold harmless Trail to Taproom from and against any and all liabilities, losses, damages, costs, expenses (including attorney's fees), claims, and actions arising out of or related to any act or omission of the Participant during participation in Trail to Taproom activities, including any harm caused to third parties.
6. Compliance with Laws and Regulations
The Participant covenants and agrees to fully comply with all applicable federal, state, and local laws, ordinances, regulations, and rules pertaining to the Trail to Taproom activities, including but not limited to those governing public land use, alcohol consumption, and environmental protection.
7. Alcohol Consumption
Trail to Taproom staff reserves the absolute right to prohibit, restrict, or terminate any attendee's consumption and/or purchase of alcoholic beverages at any time during the event, for any reason deemed necessary, including but not limited to over-consumption, time constraints, health concerns, behavioral issues, or any other reason at the staff member’s discretion. This right is final, non-negotiable, and extends to all attendees regardless of circumstances.
Attendees agree to comply immediately with any such directive, acknowledging that failure to do so may result in removal from the event, fee forfeiture, and/or ban from future events. By participating, Participants waive the right to contest the Organizer's decision and agree to hold Trail to Taproom harmless from any related claims or liabilities.
8. Photo / Media Release
The Participant hereby grants Trail to Taproom the irrevocable right and permission to use photographs, video recordings, or other media capturing the Participant's likeness in connection with Trail to Taproom activities for any lawful purpose, including but not limited to publicity, marketing, social media, and web content, without compensation or further consent.
9. Non-Discrimination Clause
Trail to Taproom DOES NOT and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation, military status, or any other characteristic protected under applicable federal, state, or local law, in any of its activities or operations. Any Participant or staff found to have exhibited any inappropriate conduct or behavior against others related to the above, or otherwise, may be subject to removal from the event.
