ACKNOWLEDGMENT OF RISKS, WAIVER, RELEASE OF LIABILITY, HOLD HARMLESS, and MEDIA RELEASE
In consideration of being allowed to participate in the GL52 Series 2026 including any related events and activities (collectively, the “Event”), the undersigned acknowledges, appreciates, and agrees that:
1) I understand that my safety and the decision whether or not to participate in the Event and its various activities are my responsibility and not that of GL52 Events Association, LLC, the Organizing Authority, the Race Committee, the host club, the host facility(ies), lessees, operators, or any sponsors of the Event (including any of their affiliated companies) and each of any such entity’s officers, directors, managers, owners, officials, agents, employees and volunteers or any other affiliated organization or official, (collectively as “Releasees”).
2) I agree to abide by any and all rules, instructions, policies or procedures published with respect to the Event, including all rules of the host site and all applicable laws.
3) I understand and fully acknowledge that participating in or attending sailing-related events involves inherent risks, and the risk of serious injury from the activities involved in the Event are significant, including the potential for property damage, personal injury, dismemberment, paralysis, permanent disability, and death. The risks of participating in or attending the Event and its related activities include, but are not limited to, drowning, hypothermia, collisions, impacts from equipment and other persons, slips, falls, exposure to weather conditions (including extreme wind and sun and lightning strikes), and electrocution. These risks are present even to participants and bystanders on shore, on docks, or on/within other facilities.
4) I knowingly, voluntarily, and freely assume all such risks associated with participating in or attending the Event, or visiting the facilities or boats associated with the Event, both known and unknown, including those arising from the negligence of the Releasees, and assume full responsibility for my participation and attendance.
5) I, for myself and on behalf of my heirs, executors, administrators, successors, assigns and next of kin, HEREBY WAIVE, RELEASE, DISCHARGE, AND COVENANT NOT TO SUE, EACH OF THE RELEASEES WITH RESPECT TO ANY AND ALL CLAIMS, ACTIONS, DEMANDS, CAUSE OF ACTION, SUITS, DAMAGE, LOSS, INJURY, DISABILITY, OR DEATH, TO PERSON OR PROPERTY, resulting from or arising out of my participation in or attendance at the Event, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law. I agree to indemnify and hold harmless the Releasees from any and all claims, demands, actions, or causes of action, including attorney’s fees and costs, arising out of or related to my participation, attendance, or visit to the Event, and the boats or facilities associated therewith.
6) If this document is being signed on behalf of a minor child by the child’s parent, natural, or legal guardian, you, as parent or guardian, fully acknowledge and understand the following:
NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASEES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM THE RELEASEES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND THE RELEASEES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
7) I grant, at no cost, the Organizing Authority and any and all sponsors of the Event (including any of their affiliated companies) the absolute right and permission to use my name, voice, image, likeness, biographical material and images or representations of any of my property (including, without limitation, boats) in any media worldwide (including, without limitation, television, print and internet media) for the purposes of advertising and promotions, as well as reporting and disseminating information regarding the Event and its participants. I understand that the foregoing right and permission includes, without limitation, still images and video footage which may be created before, during or after the Event.
I HAVE READ THIS Acknowledgement of Risks, Waiver, Release of Liability, Hold Harmless and Media Release AGREEMENT, I FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
