Informed Consent and Acknowledgement

 

I accept all risks associated with the activities and release Peek Sports LLC and its representatives from any liability for injuries related to these activities. In the event of injury, I waive all claims against Peek Sports, its coaches, participants, sponsors, and venue owners. I understand that participating in sports carries inherent risks, including the possibility of injury or death. *PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING, YOU WAIVE LEGAL RIGHTS. In exchange for participating in various activities at PEEK SPORTS LLC, I voluntarily enter into this WAIVER, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT.

1. ACKNOWLEDGMENT OF RISKS: I acknowledge that participating in these activities involves risks, including bodily injury or death. I agree to be financially responsible for any damages caused by myself or minors under my supervision.

2. SCOPE OF RELEASES: “Claims” include any past, present, or future claims arising from my participation, regardless of the cause, including negligence or other risks.

3. RELEASE FROM LIABILITY: I release all Claims against the Released Parties related to my participation and agree not to sue them for such Claims.

4. INDEMNIFICATION: I agree to indemnify the Released Parties from any Claims arising from my participation, including those involving minors under my supervision.

5. MEDIA RELEASE: I grant permission to be recorded or photographed during the activities, understanding these materials may be used for promotional purposes. I waive rights to approve their use and release the Released Parties from related Claims.

6. PRIVACY AND PERSONAL INFORMATION: Personal information collected in connection with this Agreement may be used by Peek Sports Texas for waiver administration, participation records, safety, facility operations, and communications related to its services. Personal information will be handled in accordance with applicable law and will not be sold by Peek Sports Texas. Information may be disclosed when reasonably necessary to operate the facility, administer this Agreement, respond to an emergency or incident, comply with legal obligations, or protect the rights and safety of Peek Sports Texas, its participants, and others.

TEAM MANAGER / RENTER RESPONSIBILITY
The individual making the reservation (“Renter” or “Team Manager”) is responsible for informing all players, participants, parents, guardians, coaches, and guests associated with the reservation that each participant must complete the Peek Sports Texas waiver before participating in any activity at the facility. The Renter/Team Manager agrees to make reasonable efforts to ensure that no participant takes part in activities until the required waiver has been completed. For participants under 18 years of age, the waiver must be completed by a parent or legal guardian. Completion of a separate team, league, academy, or organization waiver does not replace the Peek Sports Texas waiver requirement.

I understand this is a comprehensive agreement; I enter it voluntarily, and it is governed by Texas law. Any disputes will be resolved in Harris County, Texas. If any part is deemed invalid, the rest remains valid. I agree to these terms and confirm receipt of this Agreement.
