I understand that classes with SoCal Kangoo Club - Raqui, Staci & Jeanette ("SCKC") and LULULEMON may be physically strenuous and I voluntarily participate in them with full knowledge that there is a risk of personal injury, property loss or death. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against "SCKC" and LULULEMON, host facility, its members of staff for any personal injury, property damages/loss, or wrongful death, whether caused by negligence or otherwise. I further expressly agree that I will not use equipment improperly, and I am responsible for the safety of any equipment I bring. I am physically sound and have approval to proceed with a routine of exercise. In consideration for permitting participation in a class or private session with "SCKC" and LULULEMON, the undersigned, for themselves, and for their respective heirs, personal representatives and assigns, agree as follows: ASSUMPTION OF RISK: The undersigned hereby acknowledges and agrees that he/she understands the nature of classes/sessions participating in; that PARTICIPANT is qualified, in good health, and in proper physical condition to participate therein; that there are certain inherent risks with exercising with "SCKC" and LULULEMON in person and virtually, and that, except as expressly set forth herein, he/she, knowingly and voluntarily accepts, and assumes responsibility for each of these risks and all other risks and dangers that could arise out of, or occur during PARTICIPANT'S participation in any guided practice with "SCKC" and LULULEMON. PARTICIPANT shall consult with his/her own physician for any; and all medical questions, issues, and advice. INDEMNIFICATION AND HOLD HARMLESS: The undersigned hereby agree to INDEMNIFY, DEFEND AND HOLD "SCKC" and LULULEMON HARMLESS from any; and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities including, but not limited to, attorneys fees, arising from, or in any way related to Participant's participation in "SCKC" and LULULEMON classes, programs, or trainings, arising from any cause including negligence. SEVERABILITY: The undersigned expressly agrees that the foregoing assumption of risk, release and waiver of liability and indemnity agreement is intended to be as broad and inclusive as in permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. ACKNOWLEDGMENT OF UNDERSTANDING: The undersigned has read this assumption of risk, release, and indemnity agreement. The undersigned fully understands this assumption of risk, release, and indemnity agreement, and acknowledges that the undersigned is giving up substantial rights in connection therewith, and that its terms ate contractual, and not a mere recital. The undersigned acknowledges that he/she is signing this agreement freely and voluntarily.
