Advocate Volunteer Agreement and Liability Waiver for the S.A.F.E. Program brought by Tianguis Market Foundation.
This Agreement (“Agreement”) is made between Tianguis Market Foundation (“Organization”) and the Advocate named below (“Advocate”) for volunteering in the S.A.F.E. (Street Advocates for Education) Program.
1. Purpose of Agreement
The purpose of this Agreement is to establish the responsibilities, liabilities, and protections for both the Organization and the Advocate in support of the S.A.F.E. program.
2. Advocate Responsibilities
The Advocate agrees to:
•Act in a professional and respectful manner when representing the S.A.F.E. program.
•Provide support to street vendors in a way that aligns with the goals and mission of the S.A.F.E. program.
•Follow all protocols, guidelines, and laws as outlined by the Organization and applicable local, state, and federal laws.
•Attend any required training sessions, meetings, or seminars provided by the Organization.
3. Confidentiality
The Advocate agrees to maintain the confidentiality of any sensitive information they may come across during their participation in the program, including but not limited to:
•Personal information of street vendors.
•Details about the S.A.F.E. program’s legal partners and strategies.
•All information marked as confidential by the Organization.
Confidential information shall NOT be disclosed to third parties without written consent from the Organization.
4. Liability Waiver and Release
In consideration of the opportunity to serve as an advocate, the Advocate agrees to the following terms regarding liability:
•Voluntary Participation
The Advocate acknowledges that their participation in the S.A.F.E. program is voluntary and may involve interactions that could lead to potential risks, including but not limited to confrontations or disputes with law enforcement or the public.
•Assumption of Risk
The Advocate acknowledges and assumes any risks associated with their duties in the S.A.F.E. program, including personal injury, property damage, and any other potential risks.
•Release of Liability
The Advocate agrees to release, waive, and hold harmless the Organization, its board members, employees, agents, and partners from any and all claims, demands, actions, or liabilities, of any nature, arising out of or related to their participation in the S.A.F.E. program.
•Indemnification
The Advocate agrees to indemnify and hold the Organization harmless from any loss, liability, damage, or costs, including attorney’s fees, resulting from the Advocate’s actions while participating in the S.A.F.E. program.
5. Code of Conduct
The Advocate agrees to:
•Uphold the values of the Tianguis Market Foundation and the S.A.F.E. program with integrity and professionalism.
•Avoid any actions that could endanger the safety or reputation of street vendors, the Organization, or themselves.
•Report any incidents, confrontations, or breaches of conduct to the Organization immediately.
Any violations of this code of conduct may result in termination of the Advocate’s participation in the program.
6. Term and Termination
This Agreement will remain in effect for the duration of the Advocate’s participation in the S.A.F.E. program unless terminated by either party. The Organization reserves the right to terminate this Agreement at any time for any reason, including but not limited to breaches of conduct, confidentiality, or failure to adhere to the guidelines set forth in this Agreement.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California.
8. Acknowledgment of Understanding
By signing below, the Advocate acknowledges that they have read and understand this Agreement. They understand the risks associated with participating in the S.A.F.E. program and agree to the terms of this Agreement.
