At NO time, shall this puppy/dog be Homeless, Neglected, Living Outdoors, Living in a shelter or

MJMB&D Kennel will agree to take this puppy/dog back at any time without question and at the buyer's request. In the event that the buyer cannot keep this dog, it MUST be returned to MJMBD Kennels- it may not be sold or given away, placed in a guardian or co own home. 

Our preferred method of payment is by Walmart, Money Order, Money Gram and Cash,and zelle.

We will not reserve a Puppy/dog until the payment and this Agreement is received.

Financial Arrangements, I/we, directly to Melonie Manning. Terms of the sale: The above referenced dog is being sold to the purchaser under the following terms and conditions. The purchase prices stated are non-refundable. All retainers are non-refundable. Specific details of this sale: Any additional expenses incurred by the new owners after they receive their puppy are NOT the responsibility of the breeder.

At No time, shall Buyer/Owner: Sell, Re-home, or Give away dog/puppy for any reason or take the puppy from its original contracted home unless agreed to by Melonie Manning MJMB&D Kennels. A new contract MUST be signed by new owner(s) if agreed upon.

 

MJMB&D Kennels has the right to remove this dog at any time if owners do not abide by this contract and/or are deemed to be neglectful. If you are taken to court or your dog gets removed from your home, all court proceedings will reside in the county of the breeder and you will be responsible for all court fees as well as attorney fees for the breeder/seller Melonie Manning.

By signing this contract, you agree to provide the following for the puppy/dog: *Loving indoor home environment for the puppy to live *Proper socialization beginning soon after it has received its final booster shot *High quality dog food with proper nutritional levels for a rapidly growing Great Dane *Proper Vet care including yearly exams, and as needed otherwise, with records to prove

*Other de-worming treatments as needed Seller has the right to do a home visit if there is any means for concern for the dog/puppy within 72 hours of calling the Buyer to make sure that the puppy/dog is in a safe environment, and are in good health, and are still in the home, also that they are an inside dog and not Living outside on a chain or Kenneled, if the said dog/puppy is found to be in a bad place the seller has all rights to remove the said dog/puppy out of the home at no cost to the Seller, and all Registration Papers, Vet Records must be provided along with the animal.

Buyer agrees to not speak ill of the breeder in any way shape or form. On social media or in person. Each violation of this will be $1,000 fine. If you have a problem with your puppy/dog please let Melonie know ASAP to help address the situation. Any amendments to this contract must be in writing and signed by both parties.

By signing below, all parties agree that they have read and understand this entire contract and agree that it is a legally binding document, to be upheld in a court of law. If any of these mutually agreed to conditions are not met, this contract is considered breached. Any breach of this contract shall result in forfeiture of the dog, along

with the AKC registration signed over to breeder, for NO compensation. All legal issues regarding breaching this contract will be filed and decided in the county the breeder resides in (Wagoner County, OK), regardless of who files the charges. By signing below, I guarantee that all information and documents provided are correct and true to the best of my knowledge. Must be signed by both Parties Statement of Acknowledgement and agreement: I have read, understand and agree to the terms and conditions of this agreement. I also state I will not make claims of exemption(s) excluding or against points of this agreement. In addition, I also agree and herein grant, without recourse, my permission for local police to become involved, act upon, and issue remedy, where needed, in support of this agreement. I agree that any dispute or legal actions involving this agreement shall be heard and decided in the jurisdiction of which the breeder resides. I agree that if upon court awarding decision of "breach of contract", I agree to pay the Breeder $5000.00 (five thousand dollars) in liquidated damages for damages to the owner's kennel name and reputation. Also for time, trouble, mental duress and damage to the dog's reputation. I agree to accept financial responsibility for all costs incurred by legal matters, for all parties involving this agreement or subject to dog thereof.

This contract must be filled out and then signed, and sent back to the breeder, or given when you receive your puppy, whichever is first, but must be within 7 days of the Date. Breeder will be supplied with the Original Document, and the Buyer will receive a Copy of the said Document.
