  • Drug-Free Workplace Policy and Consent to Test for Drugs/Alcohol In the Event of Work-Related Injury or Illness

    Square One strives to maintain a safe and productive work environment that is free of substance abuse of any kind.  It is the policy of Square One to create an alcohol and drug-free workplace in keeping with the spirit and intent of the Drug-Free Workplace Act of 1988.  The use of controlled substances is inconsistent with the behavior expected of employees, subjects all our employees and the employees and representatives of our clients to unacceptable safety risks, undermines Square One’s ability to operate effectively and efficiently, and prohibits participation in certain contracts with our clients. In this connection, the unlawful manufacture, distribution, dispensation, possession, sale, or use of a controlled substance, including alcohol, in the workplace or while engaged in Square One business on or off Square One’s premises is strictly prohibited.  This includes all normal working hours, including lunch periods and breaks.  Such conduct occurring during nonworking time, to the extent that the residual effects, in the opinion of Square One, impair an employee’s ability to perform on the job or threatens the reputation or integrity of Square One is also prohibited.

    Square One reserves the right to require employees to undergo appropriate tests designed to detect the presence of alcohol, illegal drugs or other controlled substances where it has reasonable suspicion that an employee may be under the influence of any of these substances.  Square One also reserves the right to require employees to submit to random testing to detect the presence of alcohol, illegal drugs or other controlled substances in its discretion.  By signing this policy, I understand and agree that if I refuse to submit to testing, it will be considered as a refusal to comply with a reasonable request by Square One, and will be cause for dismissal.  I further agree to hold harmless Square One, its agents, and clients for any and all consequences arising from my testing positive for the use and/or influence of drugs or alcohol at the time of any accident, injury or illness. 

    I understand that, as part of its regular employment policy SQUARE ONE SOLUTIONS requires any employee who suffers a work-related injury or illness to be tested for the presence of drugs and/or alcohol.  This testing is to be done at the location where initial treatment for the injury/illness is provided, and is to be conducted in accordance with acceptable medical procedures.  I understand that if I refuse to submit to testing, it will be considered as refusal to comply with a reasonable request by my employer and will be cause for dismissal.  I further agree to hold harmless SQUARE ONE SOLUTIONS, its agents, and clients for any and all consequences arising from my testing positive for the use and/or influence of drugs or alcohol at the time of my injury or illness.

  • Policy Regarding Dispute Resolution

    I agree that any disputes arising out of my employment, including any claims of discrimination, harassment or wrongful termination, that I believe I have against SQUARE ONE SOLUTIONS and all other employment related issues (excluding only those claims arising under the National Labor Relations Act or otherwise within the jurisdiction of the National Labor Relations Board) will be resolved by arbitration as my sole remedy.  The American Arbitration Association under its Commercial Arbitration Rules shall conduct the arbitration and the decision of the arbitrator shall be final and binding.

  • Release of Claims Against SQUARE ONE SOLUTIONS Customers

    I understand that SQUARE ONE SOLUTIONS (“the company”) provides temporary workers for its customers to work at the customers’ designated job site.  In accepting any work assignment, I acknowledge that I am a temporary worker of SQUARE ONE SOLUTIONS and not an employee of the Company’s customer.  If I am ever injured in the course of any work assignment for SQUARE ONE SOLUTIONS, I agree that I will look only to the Company’s Workman Compensation coverage and not the Company’s customer for any recovery.  For myself, and on the behalf of my heirs, executor, personal representatives and assigns, I waive, release, and forever discharge any claim that I may now have or that may later accrue against any customer of the Company which directly or indirectly arises out of any injuries which may occur while I am on a temporary work assignment for the Company.  In signing this Release, I understand that I am not waiving or releasing any claims that I may have against the Workman Compensation coverage provided by SQUARE ONE SOLUTIONS.

    In consideration of my employment, I agree to conform to the rules and regulations of SQUARE ONE SOLUTIONS and I understand that my employment by SQUARE ONE SOLUTIONS may be terminated at any time by me or SQUARE ONE SOLUTIONS with or without notice, for any reason.  I understand that no Manager, or any other employee or representative of SQUARE ONE SOLUTIONS other than the President of SQUARE ONE SOLUTIONS, has any authority to enter into any agreement for employment for any specified period of time, or to make any agreement contrary to any of the foregoing.  I understand the duties, including physical requirements, of the position for which I am applying with SQUARE ONE SOLUTIONS and I certify that I am capable of performing the required tasks with or without reasonable accommodation.  If after I am hired I am requested to perform work which I am unable to perform due to a disability, I will notify SQUARE ONE SOLUTIONS so that we may discuss the options for reasonable accommodation.     I understand that I am not required to work on any particular day and whether I call in to the SQUARE ONE SOLUTIONS availability line is always my choice.    I know that SQUARE ONE SOLUTIONS is not required to find work for me and is not required to contact me in any way in order to make work available to me.  If I do not call the availability line and list myself as available, SQUARE ONE SOLUTIONS may assume that I am not available for work on that day.  I understand that SQUARE ONE SOLUTIONS follows a “best match dispatch” policy and not a “first in –first out” policy.  I understand that after receiving a job assignment, I am free on my own time to leave the branch and do as I wish until the job assignment starts.  I understand the importance of never being late for a job assignment.  I understand that if I am dispatched to a job assignment and accept that assignment, I agree that I will work the full term of the assignment and will not walk off the job or perform my job duties in a manner that would result in the client requesting that I not return to the jobsite  I understand that my employment with SQUARE ONE SOLUTIONS is on a day-to-day basis.  That is, at the end of the work day, I will be deemed to have quit until I report to the branch and receive a work assignment at a later date.  Failure to request a new assignment may affect eligibility for unemployment compensation.  I understand that merely registering my availability to work does not constitute employment, and I am not re-employed until I actually receive a new work assignment.

    I have read and understand the Square One Solutions Safety Policy and Orientation.  Any questions I have about the policy have been explained to my satisfaction.  I understand that safety in the workplace is my responsibility and that if I identify any hazardous workplace situation I am to immediately report it to Square One Solutions and to not work in any area where I might put my personal safety into jeopardy.   I understand that if I am offered employment with Square One Solutions, I will abide by the Square One Solutions Safety Policy.
