Defined Terms:

 
“We”, “Us”, “Our” means Crate Escapes LLC. “We”, “Us” and “Our” can also mean Crate Escapes LLC and its subsidiaries, employees, owners, related entities, officers, contractors, servants and agents depending on its use in this Waiver.

 
“I” “You”, “Your” “My” means the adult who signs this Waiver of Liability.

 
“Park Rules” means the rules that You must abide by to be on Our premises with or without Your dog(s). Posted in the Park and by reference incorporated in this Waiver. Please note that the “Park Rules” may change from time to time and by signing this Waiver You agree to abide by the most current version of the Park Rules.

 
“Dog Park + Bar” means any Crate Escapes LLC location or property, in it’s entirety.

 

PLEASE READ CAREFULLY

I understand that Crate Escapes LLC is an indoor dog park and Crate that allows dogs to be present off leashes in it’s Dog Park + Bar. I understand that each Dog Park + Bar has Rules.  I attest that the Park Rules have been provided to be, either in digital form or in print, and that I have read the Park Rules.  My signature below indicates that I understand and will abide by the Park Rules in their entirety. I have signed this Waiver for My minor children as well, I will ensure that My minor children will abide and follow the Park Rules.  I understand that to bring My dog (s) to the Dog Park _ Bar that My dog (s) must be current on rabies, DHLPP/Da2PP, and bordetella vaccinations.  I agree that My dog(s) are current on said vaccinations. I understand that I am solely responsible for the well- being and safety of all humans and dogs that are covered by this Waiver while at the Dog Park + Bar.

I am fully aware of the risks and hazards connected with utilizing the Dog Park and specifically of being in the same space with unleashed dogs and their respective owners. I am fully aware that Crate Escapes LLC cannot guarantee the vaccination status of any dog at the Dog Park + Bar(s) and accept the risk and hazard associated with that fact. Nonetheless, I hereby elect to voluntarily utilize the Dog Park + Bar(s) knowing that said participation may be hazardous to Me, My dog(s), My minor children covered by this Waiver, and/or My property. In allowing my dog(s) on the Crate Escapes property (on or off-leash),  I/We, the owner/customer(s) understand the risks and agree to accept responsibility for any and all problems or damages that may occur, including, but without limitation, the following: 

• Ingestion of materials or substrates in an outdoor environment 
• Injuries related to outdoor environments/ agility equipment 
• Potential encounters with wildlife including birds, biting or stinging insects or fleas, and ticks 
• Skin allergies/hot spots 
• Torn toenails 
• Cruciate tears/orthopedic problems
• Bite wounds or injuries to dogs or humans
• All other injuries that may be sustained by a dog or human
• Upper respiratory infections/possible contagious infections
• Weather-related health issues

Any problem or damage that may occur must be reported to the owner(s) or acting managers at the site before leaving the premises.  

In consideration of My participation in the use of the Dog Park + Bar, and for other good and valuable consideration, I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by Me, My party, My minor children covered by this Waiver, and/or My dog(s) and which arises from my participation at any Dog Park + Bar(s). I/We, the owner/customer(s) also agree to be responsible for my guest(s), dogs(s), invitee(s), associate(s), affiliate(s), and agent(s), and for any liability caused by me, my guest(s) and/or my dog(s) while on Crate Escapes’ property and its associated facilities.

I hereby RELEASE, WAIVE, DISCHARGE, AND GREE NOT TO SUE Crate Escapes LLC, and its officers, employees, contractors, servants and agents from any and all liability, claims, demands, actions and causes of action no matter whether said claims, demands, or causes of action are via contract, tort, or any other legal theory, whatsoever arising out of or related to any claim, loss, damage, or injury, including death, that may be sustained by Me, My dog(s), My minor children covered by this Waiver, and/or to My property, arising from My, My minor children, if applicable, and/or My dog’s(s) presence at any Dog Park + Bar.

It is my expressed intent that this waiver shall bind my heirs, assigns interested parties and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, and COVENANT NOT TO SUE Crate Escapes LLC/Us for any reason.

In signing this release, I acknowledge and represent that I HAVE READ AND UNDERSTOOD THE WAIVER AND THAT I SIGN IT VOLUNTARILY as my own free act and deed; no oral representations, statements or inducements not contained herein have been made; and I EXECUTE THIS RELEASE FOR FULL, ADEQUATE AND COMPLETE CONSIDERATION FULLY INTENDING TO BE BOUND BY SAME.

Crate Escapes LLC reserves the right to refuse service or use of its Dog Park + Bar to any person or dog in it’s sole and exclusive non-discriminatory discretion.

I understand that Crate Escapes LLC may use my dog(s) name, photos, and video media obtained on our premises for promotional material.

 Your privacy is important to us. At the same time, in order to create a community of dog lovers, there may be situations where we have to share your information with others. For example, in the event of an incident in the park involving you or your dog, we will share contact information with all parties involved. In addition, in order to provide a safe environment, the Dog Parkour property is under video surveillance at all times. By becoming a Member, you consent to the possibility of being captured on video. The video is the exclusive property of Crate Escapes LLC. In the event of an incident in the Dog Park, we may release portions of this video to investigating authorities or others, in our sole discretion or in accordance with the law.
