Who You Can Nominate
You cannot just name anyone. Under Australian superannuation law, your nominees must be either:
• Spouse or de facto partner
• Children of any age (including adopted, stepchildren, or adult children)
• Financial dependant (someone who depends on you financially at the time of your death)
• Interdependency relationship (someone you live with, where you have a close personal relationship and provide domestic support, care, and financial support)
• Legal Personal Representative (LPR) (the executor or administrator of your deceased estate, so it gets distributed according to your will)
Note: Parents, siblings, cousins, nieces, and nephews cannot be named directly unless they qualify as a financial dependant or are in an interdependency relationship. Otherwise, you must name your estate (LPR) and outline them in your will.
Please note there are tax implications for adult independant children (18+) on the taxable components of your fund.
