  • Terms and Conditions for Subcontractors: Responsibilities and Liability

    1. Introduction
    These Terms and Conditions outline the responsibilities and liabilities of subcontractors engaged by UK Gas Plumbers (“the Company”). By agreeing to work with the Company, the subcontractor (“you”) agrees to comply with the terms set forth below.

    2. Scope of Work
    2.1 You shall perform the tasks and duties assigned by the Company with reasonable skill, care, and diligence, adhering to industry standards, applicable laws, and the Company’s policies.
    2.2 You shall only undertake tasks within the scope of your agreed services, qualifications, and competence.

    3. Compliance with Regulations
    3.1 You must comply with all applicable health and safety regulations, including the Gas Safety (Installation and Use) Regulations 1998 and any other legal requirements relevant to your work.
    3.2 You must hold valid and appropriate certifications (e.g., Gas Safe registration) for all work undertaken and provide proof of such certifications upon request.

    4. Tools, Equipment, and Materials
    4.1 You are responsible for providing and maintaining your tools and equipment in good working order unless otherwise agreed in writing.
    4.2 Any materials supplied by the Company must be used solely for the specified project and returned if unused.

    5. Insurance and Liability
    5.1 You must maintain appropriate public liability and professional indemnity insurance policies and provide evidence of such coverage upon request.
    5.2 You are liable for any damages, losses, or costs incurred by the Company or its clients due to your negligence, failure to comply with regulations, or breach of this agreement.
    5.3 You are responsible for rectifying any defective or non-compliant work at your own expense.

    6. Confidentiality and Data Protection
    6.1 You must keep all information about the Company’s operations, clients, and projects confidential, unless disclosure is required by law or with the Company’s prior written consent.
    6.2 Any data you handle must comply with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR).

    7. Indemnity
    You agree to indemnify the Company against any claims, liabilities, damages, or expenses arising from your actions, omissions, or failure to comply with these terms.

    8. Health and Safety
    8.1 You must adhere to the Company’s health and safety policies and report any accidents, hazards, or unsafe practices immediately.
    8.2 You are responsible for your own health and safety and must ensure your actions do not endanger others.

    9. Termination
    9.1 The Company reserves the right to terminate your services without notice in cases of gross misconduct, negligence, or breach of these terms.
    9.2 Upon termination, you must return all materials, equipment, and confidential information belonging to the Company.

    10. Dispute Resolution
    Any disputes arising under this agreement will be resolved through good faith negotiations. If unresolved, disputes may be referred to mediation or arbitration under UK law.

    11. Governing Law
    These terms are governed by the laws of England and Wales. Any legal proceedings will be conducted in the courts of England and Wales.

    12. Acceptance of Terms
    By undertaking work for the Company, you acknowledge and accept these terms and conditions in full.
