An FRS Retiree may provide unpaid Post-Retirement Volunteer Services to the University within the first 6 calendar months following Retirement if the Services comply with Florida Statute 121.091(15) and USF's guidelines.
Post-Retirement Volunteer Services do not constitute employment by the University of South Florida. Retired staff employees must comply with the USF Volunteers Policy and the Post-Retirement Volunteer Services policy. FRS Retirees may participate in Post-Retirement Volunteer Services to provide civic, charitable, and humanitarian services during the first 12 calendar months following Retirement, provided that the Post-Retirement Volunteer Services meet the following criteria:
- Neither the University nor any third party may provide any form of compensation, including cash equivalents, in exchange for Post-Retirement Volunteer Services.
- Employee benefits provided to active employees, including health or life insurance benefits, may not be provided in exchange for Post-Retirement Volunteer Services. However, certain perquisites that are necessary to complete tasks associated with volunteer activities, such as an assigned uniform or the provision of equipment, are permissible.
- The number of volunteer hours per week, including training, is limited to no more than 20 percent of the amount of time that was expected of the FRS Retiree per week before the date of Retirement.
- A clear distinction between the Post-Retirement Volunteer Services and the duties of an employee is required. An assessment of the totality of the previous duties and comprehensive nature of the previous role will be considered when evaluating the Post-Retirement Volunteer Services.
- Volunteers must maintain control of their volunteer schedule, including the number of hours volunteered and assignments for which they agree to volunteer.
- Adequate volunteer program record keeping must be maintained by both the University and the volunteer to document adherence to the criteria listed in this subsection. The records must be made available to appropriate administrators upon request.
- The University’s affiliation with an FRS Retiree who provides Services or Post-Retirement Volunteer Services does not constitute USF’s verification that an FRS Retiree meets any or all legal requirements and restrictions. FRS Retirees are required to independently confirm their ability to provide any Service and Post-Retirement Volunteer Services and assume all financial and other risks if it is determined their Service or Post-Retirement Volunteer Service is inconsistent with the law as interpreted or applied by the State of Florida.
An individual who is receiving a retirement benefit or plans to receive a retirement benefit from the State of Florida while providing Services of any kind must consult with the Florida Retirement System or the Florida Division of Retirement prior to providing such Services. FRS Retirees seeking authorization to provide Services must comply with all requirements and restrictions regarding State of Florida retirement benefits. No Services may be provided by an FRS retiree who does not meet the requirements of the State of Florida.
The below named person (“Volunteer”), requests to be appointed as a volunteer for USF, pursuant to Chapter 110, Part IV, Florida Statutes, to perform those volunteer services approved by the University. Volunteer agrees to perform said volunteer services in a diligent and safe manner. Volunteer hereby acknowledges and agrees that any appointment to act as a volunteer for the University is without promise, expectation, or receipt of compensation or future employment for the services rendered, and Volunteer agrees to comply with the terms hereof.
The University acknowledges that Volunteer will be provided with liability protection pursuant to Section 768.28(9), Florida Statutes, and covered by Workers’ Compensation, in accordance with Chapter 440, Florida Statutes. However, Volunteer will not be entitled to such liability protection and workers’ compensation for willful or malicious conduct or conduct outside the scope of approved volunteer services.
Volunteer agrees to complete and submit time sheets to be provided by the University and verified by Volunteer’s supervisor, indicating the dates and times of volunteer services rendered for the University, and further agrees to comply with all applicable rules and regulations of the University. Volunteer recognizes that Volunteer is not part of any collective bargaining unit, is an unpaid independent volunteer, and is not entitled to Unemployment Compensation should Volunteer’s appointment be discontinued. The University reserves the right to discontinue the appointment of Volunteer at any time it is deemed to be in the University’s best interests.
Volunteer agrees that Volunteer is not authorized to bind the University to any contract or obligation whatsoever, and Volunteer is responsible for all statements made or actions taken by Volunteer that may be outside the scope of Volunteer’s assigned duties. The University’s approval of volunteer services does not certify Volunteer’s compliance with any obligations or restrictions Volunteer may have under federal law relating to any nonimmigrant visa status or extension thereof. Based on the nature of volunteer services to be performed, Volunteer may be subject to a background check. To determine if a background check is required, contact Central Human Resources.
