    Private Parties:

    Examples: birthday party, quiñceanera, wedding, anniversary, graduation, holiday party, etc.


    An average of 10-12 guests can be painted per hour. Please be considerate of the time you book based on the number of guests. If you’re unsure how long you should book, we will happily advise you.


    A non-refundable $50 booking fee is required in order to secure a date, and will be credited towards the total booking rate. Your date will not be booked until that non-refundable booking fee is received. A 48 hour cancellation/change notice is required to change the date of the party. Once the 48 hour notice is given, the booking fee credit will transfer to the newly booked party date. If notice was given less than 48 hours before the scheduled event, a new booking fee is required to book the party with a new date/time.


    The balance of the party is due by cash, debit card, paypal or venmo NO LATER THAN 6:00AM on the morning of the event. If the total balance is not received by 6AM on the day of the event, through any of the mentioned payment methods, the artist will not arrive to paint. In this case, the non-refundable booking fee will not be returned or applied to the booking of another party. Glitter Gang does not accept checks as a form of payment.


    The artist will display and distribute business cards during the event. The artist will take photos of their art with verbal permission given by the parent or guardian of the accompanying child, unless otherwise requested. 


    Our Party Package is available for these types of events! The party package is great for those who want to prepay for accessories (headbands, wings, wands, capes, etc.) at a discounted price!


    Private Events or Public Events:

    Private event examples: office parties, church picnic, club celebrations, etc. (large scale events)

    Public event examples: carnival, fun days, harvest/halloween events, christmas events, etc.

    A tip jar will be set out for festivals and public events, but private corporate events may request no tip jar. The artist will display and distribute business cards during the event.     Pay-Per-Face 

    Example: any business/organization/festival that would like to offer face painting at their event with attendees paying the cost for the entertainment

    A show-up fee of $95 is required to secure the date. This is the only payment required for a pay-per-face booking. This fee is due by cash, debit card or venmo at least 48 hours before the scheduled event. A 48 hour cancellation/change notice is required to change the date of the event. If 48 hours notice is given, the show-up fee will apply to a newly booked event date. If notice is given with less than 48 hours before the scheduled event, a new show up fee is required to book another event.


    The artist charges the public a price per face to be painted, and those wishing to be painted will pay the artist directly. If the artist makes the agreed upon amount in pay-per-face (based on number of guests and time contracted), the artist will refund the show-up fee to your organization. If the artist does not make at least the agreed upon amount, the show-up fee is retained by the artist. If the event is not well attended, the artist reserves the right to leave early; However, in the case the artist does leave early, she will refund the show-up fee to your organization regardless of sales.


    A tip jar will be set out, and tips will be encouraged and requested. The artist will display and distribute business cards during the event. The artist will take photos if verbal permission is given by the parent or guardian accompanying the child, unless otherwise requested. 


    Venue Conditions


    Client agrees to provide the artist with a safe and appropriate working environment. Client agrees to provide for use during the event: access to tap water, restroom access, adequate lighting, and protection from the sun, wind and rain. Shade from the sun is essential in any outdoor event. If the client does not provide a tent, one can be provided by the artist for a $15 fee. If your event is planned to be outdoors, please have an indoor backup plan in case of inclement weather. Our indoor set-up requires at least 6ft x 6ft of space. Neither the event fee nor the booking fee will be refunded if entertainment services are rendered impossible due to the client’s negligence in having a backup plan for bad weather conditions.


    If weather becomes a possible threat to the event, a tentative rain date can be discussed 48 hours prior to the scheduled event. Please keep an eye on the forecast for your event so that we can plan accordingly! We may reach out as well, but it is ultimately the client’s responsibility to bring possible inclement weather to our attention. 


    Breaks


    The artist will have a paid break of 5-10 minutes every 2 hours. Artist access to a restroom is mandatory.


    Bounce House Cautions


    If you plan to have a bounce house at your event, please discuss face painting with the bounce house company prior to hiring the artist. Please be aware that some bounce house companies do not allow face painting at the events where their equipment is used. If the artist is asked to leave due to a bounce house company, the artist will not refund any portion of the booking fee or event fee. If a bounce house is present at the event, the client alone is responsible for cleaning any face paint off the bounce house material and/or paying the bounce house company for such cleaning and/or damages of bounce house material that may occur.


    Travel/Setup/Other Fees


    Travel fees may apply for events that are more than 35 miles away from lincoln. Our current travel fee is +$0.65/mile beyond a 35 mile radius. Depending on your event, there may also be a charge for outdoor, lengthy, or difficult setup. This is generally a $15 fee, but please confirm with the artist prior to the event if you feel your event may be considered difficult to set up for. 


    The client is responsible for providing a tent/shade for outdoor events. If a tent needs to be provided by the artist for the event, a $15 fee will apply. 


    Artists will be provided with easily accessible parking on the property where services will be provided. Parking fees incurred by the artist must be paid for or reimbursed by the client. If a permit or pass is required, we must receive them at least 1 day before the event. If the event is at a commercial facility, the artist will be provided a parking spot near the commercial facility entrance door to unload equipment. If an accessible parking option is unavailable, Glitter Gang Face Paint and Body Art by Marissa has the right to deny or halt services.


    If your event requires line management (long, long lines of kids waiting to be painted, usually with larger events), we require an additional $25/hour fee. You always have the option to provide someone to help with line management in order to avoid that fee, but we will need their full attention and assistance during peak times, and near the end of the contracted time especially. 


    Cancellation by the artist


    Should the artist have to cancel (due to illness, emergency, or any other unforeseen and uncontrollable circumstance), the entire fee, including the generally non-refundable booking fee, will be refunded to the client.


    A full refund of any amounts paid after an artist’s cancellation will represent a full satisfaction of any and all amounts due. This means that Glitter Gang Face Painting and Body Art by Marissa is no longer liable to the client for any further claim of damages or other claims of any kind whatsoever, beyond a full refund of any amounts paid by client. 


     Overtime


    Any time beyond what was initially booked will be billed at the rate of $110 per hour, or $55 per half hour. There is a full half hour charge for every 1-30 minutes of overtime. This means overtime fees start the minute after the booking is scheduled to end. For example, if the event is scheduled until 3, but the artist is still painting at 3:02, overtime fees apply. Please plan accordingly. Overtime fees do not apply to tear-down time. We cannot guarantee to have additional time available on the day of your event. We can only guarantee to be there for the initial contracted time. Although the artist will attempt to accommodate requests for additional paid time, additional time on the day of the event may not be available.


    It is the responsibility of the client to limit additional guests from requesting services near the end of the booking. Please book enough time to have all of your guests painted in order to avoid this disappointment.


    Policies


    Client acknowledges that there are risks and dangers inherent with the contracted-for entertainment, and with the props and products necessary for entertainment. Client assumes the liability for all such risks and agrees to indemnify, defend and hold harmless the artist from and against any and all accidents, claims, judgements, costs, or liability for damage, injury to any person or property during the event, including the time of set-up and take-down, by guests or staff. Liability of the artist shall not exceed the total value of this agreement.


    UNDER NO CIRCUMSTANCES WILL THE ARTIST SUPERVISE CHILDREN. THEIR BEHAVIOR AND SAFETY IS THE CLIENT’S AND/OR PARENT’S RESPONSIBILITY. 


    Disclaimer


    Glitter Gang Face Paint and Body Art by Marissa uses only professional water activated face paints and glitters that are tested for use on the face and the eye area. Brand names may include Kraze, Fusion Body Art, TAG, Diamond FX, Professional Colors, GTX, and Superstar (to name a few). The artist does not use anything that has not been approved and tested by professional face paint artists. However, as with any cosmetics, some people may develop sensitivity to any ingredient. Many children are allergic to a wide range of common products. Although rare, allergic reactions to face paint can sometimes happen. The artist is not responsible for allergic reactions. If you have concerns regarding your child’s reaction to the face paints, please discuss that with the artist before the child is painted. Ask for a patch test. If irritation occurs within 30 minutes, remove face paint immediately. Otherwise, remove face paint before bedtime. Don’t sleep in face paint as it can cause irritation and/or transfer to blankets/bed sheets. To remove the facepaint from the skin, use a soft washcloth with mild face soap (CeraVe works great!) and warm water. If color remains on the face, use coconut oil or vegetable oil worked gently into the skin to help remove the pigment. Do not use alcohol, harsh makeup removers or strong soaps, which can irritate the skin. 


    The artist will use reasonable care but is not responsible for damage to clothing or property. Clothing that has been in contact with face paint should be soaked in cold water overnight with an oxygen activated stain remover before washing as indicated on the care label. Avoid placing stained clothing in the dryer to set the stain. Hang to dry and check to see if stain remains. If stain is still present, repeat the stain removal process. 


    The artist will not paint anyone under duress, or anyone who does not wish to be painted. The artist will not paint anyone under the age of 3 years. The artist will not paint anyone, who, in the artist’s opinion, appears to be suffering from conjunctivitis, any infectious skin complaint, open wounds near the area being painted, scabbed wounds in the area being painted, runny noses that have not been cleaned from the face, dirt or encrustation on the area to be painted, anyone who appears to have lice, or anyone who is coughing, sneezing, or appears to be ill with a contagious condition. These requirements are for the safety of all being painted and to avoid the spread of community acquired conditions. 


    Glitter Gang Face Painting and Body Art by Marissa uses sanitary techniques to clean surfaces in high traffic areas. However, Glitter Gang and Body Art by Marissa can not be held responsible for the spread of any illness or virus. 


    Extreme Adverse Working Conditions


    Glitter Gang Face Painting and Body Art by Marissa has the right to cease painting and leave without refunding any money if there are extreme adverse working conditions and the client fails to remedy the situation after it has been brought to the client’s attention. Adverse conditions include but are not limited to: destructive, violent, or extremely inappropriate behavior of a child/pet/adult, illegal activities, dangerous weather, or otherwise dangerous conditions. 


    Any damage to the artist’s equipment due to negligence is the client’s responsibility. Please ensure that guests are not running or playing dangerously close to where the artist is working. 


    The artist retains the right to refuse to paint any part of the body that is not legal to expose, or any place the artist does not feel comfortable painting. The artist retains the right to refuse to paint any design or wording that is obscene, offensive, or distasteful. The artist retains the right to refuse to paint any symbols or other illustrations that are commonly associated with gangs or other illegal affiliations. The artist has the right to refuse to paint copyrighted characters or designs they are uncomfortable painting. 


    General


    This contract does not go into effect until booking fee (or show-up fee, based on event type) has been received by the artist to secure the date; all dates and times are agreed upon by both parties. 


    Glitter Gang Face Paint and Body Art by Marissa agrees that a liability insurance policy is in full force and effect. Upon request, a current insurance certificate will be provided. 


    This agreement shall be governed by, venued in, and construed in accordance with the laws of the State of Nebraska. This agreement constitutes the entire agreement between the artist and client and supersedes any prior written or oral communications. If any portion of this agreement is deemed invalid, the remainder of the agreement will remain in full force and effect. However, clients may authorize additional time with additional fees and expenses orally at or before the event.
