MINOR WAIVER/RELEASE
RELEASE OF LIABILITY FOR MINOR PARTICIPANTS
READ BEFORE SIGNING
 
In consideration of my child, being allowed to participate in any way in the PHX Elite Basketball (an entity of Yoshana Connections, a 501c non-profit) events and activities,
undersigned acknowledges, appreciates, and agrees that:
 
The risk of injury to my child from the activities involved in these programs is significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,
 
1. for myself, spouse, and child, I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releases or others, and assume full responsibility for my child’s participation; and,
 
2. I willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in my child’s readiness for participation and/or in the program itself, I will remove my child from the participation and bring such attention of the nearest official immediately; and,
 
3. I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, hereby release and hold harmless: Yoshana Connections (d/b/a PHX Elite), its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), with respect to any and all injury, disability, death, or loss or damage to person or property incident to my child’s involvement or participation in these programs, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.
 
4. I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, hereby indemnify and hold harmless all the above releasees from any and all liabilities incident to my involvement or participation in these programs, even if arising from their negligence, to the fullest extent permitted by law.
 
5. I, the parent/guardian, assert I have explained to my child/ward: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my child/ward understands this agreement.
 
I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
 
UNDERSTANDING OF RISK I understand the seriousness of the risks involved in participating in this program, my personal responsibilities for adhering to rules and regulation, and accept them as a participant.

PHOTO RELEASE:

I, the undersigned, hereby grant PHX Elite and Yoshana Connections the right to take and use photographs, videos, and other media of my child during participation in programs and events. These images may be used for promotional purposes, including but not limited to flyers, social media, websites, and newsletters.
 
I understand that these materials will be used to promote the program and may be seen by the general public. I waive any rights to review or approve the finished images or any written copy that may accompany them.
 
I consent to the use of photographs and videos of my child.

PAYMENT POLICY

MONTHLY FEE: $280 (10u and up) or $175 per month (7u-9u) (Auto-Pay)

One-time uniform fee: $155.00 

All athletes must be enrolled in monthly auto-pay. Team dues will be auto-drafted via electronic transfer to the method of payment on file. 

Due Date: Monthly beginning on the date of enrollment and continuing each month on the same day of the month as the initial enrollment.

All payments for services must be made in full by the due date.
 
Late Payments: a payment is considered late if it has not been received within 5 days of the dute date.
 
Non-Payment: If payment is not received within 15 days from the due date, your account will be placed on hold, and your athlete may be temporarily suspended from practice, games and team activities until payment is made in full.
 
If payment is not received within 30 days from the due date, your account will be considered in default.
 
Disenrollment for Non-Payment: after 30 days of non-payment, your athlete may be automatically disenrolled from our services. Disenrollment will result in the termination of access to all services provided by Yoshana Connections and PHX Elite, and any previously agreed-upon service arrangements will be canceled.
 
 Reinstatement of Services: reinstatement of services after disenrollment for non-payment may be possible upon full payment of the outstanding balance, including any late fees and a reinstatement fee of $25.00. Re-enrollment is subject to availability and is not guaranteed.

Cancellation Policy
If you wish to cancel services, you must provide written notice of cancellation to phxelitesports@gmail.com. Services will be terminated immediately upon receipt of your cancellation request. Please note that any fees paid prior to the date of cancellation are non-refundable. No credits, refunds, or prorated adjustments will be issued for unused services or partial months.
 
Refund Policy: Payments for services are non-refundable. In the event of disenrollment due to non-payment, no refunds will be provided for any partial use of services.
 
Communication: It is the responsibility of the parent/guardian to ensure that the orgranization has up-to-date contact information. We will make reasonable efforts to contact customers regarding payment issues, but you are ultimately responsible for managing your account.
 
Agreement: by enrolling in our services, you agree to adhere to this payment policy. Failure to comply with the payment terms outlined above may result in disenrollment and the termination of services.
