Acknowledgment of Risk
I acknowledge and understand that volunteering as a driver for Resilience Relief and Recovery Reach, inc hereafter refereed to as R4, and R8, or any independent or affiliated organization involves inherent risks. These risks may include, but are not limited to:
Vehicle accidents or collisions.
Injuries or property damage resulting from loading or unloading supplies.
Weather conditions, road hazards, or other environmental factors.
Physical strain from lifting or transporting goods.
Potential exposure to hazardous materials or unsafe areas during disaster response efforts.
I understand that R4 and R8 strive to ensure the safety of their volunteers, but risks are inherent in disaster relief activities and cannot be fully eliminated.
Release of Liability
I hereby release, waive, and discharge R4, R8, and any independent or affiliated organizations, including their officers, directors, employees, agents, volunteers, and partners, from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, loss, or damage that may occur while volunteering as a driver. This includes any incidents resulting from my use of my personal vehicle or any vehicle assigned to me by R4, R8, or any affiliated organization.
I agree that I am volunteering at my own risk and that I am solely responsible for any injuries or damages sustained during my participation, whether to myself or others.
Indemnification Agreement
I agree to indemnify and hold harmless R4, R8, and any independent or affiliated organizations, including their officers, directors, employees, agents, volunteers, and partners, from any and all claims, liabilities, damages, or expenses, including legal fees, arising out of or related to my actions as a volunteer driver.
This includes, but is not limited to:
Claims arising from vehicle accidents, property damage, or injuries.
Claims resulting from non-compliance with traffic laws or organizational policies.
Any claims brought by third parties as a result of my volunteer activities.
Insurance Responsibility
I confirm that my personal vehicle is properly insured, registered, and maintained in accordance with state laws. I understand that R4, R8, or affiliated organizations’ insurance does not cover personal vehicles or any damage resulting from their use during volunteer activities.
I further understand that it is my responsibility to consult with my auto insurance provider to confirm that my policy provides adequate coverage for volunteer activities.
Code of Conduct and Safety Compliance
I agree to follow all R4, R8, and affiliated organizations' policies, procedures, and safety guidelines while volunteering. I understand that failure to adhere to these policies may result in the termination of my volunteer role.
Consent to Background Check
I consent to R4, R8, or affiliated organizations conducting a background check to ensure the safety and integrity of their volunteer program.
Acknowledgment and Agreement
By signing below, I acknowledge that I have read, understood, and agree to the terms of this Liability Waiver, Statement of Risk, and Indemnification Agreement.
Liability Waiver and Hold Harmless Agreement
I,{name} hereby acknowledge and agree to the following terms and conditions in connection with my voluntary services provided to Resilience Relief & Recovery Reach, Inc. (“R4”):
Volunteer Status. I understand and agree that I am providing services to R4 on a voluntary basis. I am not an employee, agent, or key personnel of any R4 affiliate.
Non-Representative Capacity. I acknowledge that none of my actions or statements shall be construed as a representative of R4. I do not have the authority to act on behalf of R4 in any capacity.
Limitation of Liability. I understand and agree that R4 shall not be liable for any actions, claims, damages, or liabilities arising out of or in connection with voluntary services, including but not limited to any negligent acts or omissions on my part.
Independence of Actions. I affirm that all actions I take while volunteering for R4 are undertaken voluntarily and under my own volition. I am solely responsible for my actions and decisions.
Third-Party Disclaimer. I acknowledge that any third party engaged and/or otherwise associated with R4 is not liable for any of my actions or statements while I volunteer for R4.
Assumption of the Risk. Physical activity, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the effort to avoid injuries. The specific risks vary from one activity to another, but the risks range from minor injuries such as bruises and sprains to major injuries such as an eye injury or loss of sight, joint or back injuries, heart attacks and concussions, to catastrophic injuries including paralysis and death. I have read the previous paragraphs and I know, understand, and appreciate these and other risks. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.
Hold Harmless Clause. I hereby agree to indemnify, defend, and hold harmless R4 and any third party engaged and/or otherwise associated with R4, their officers, directors, employees, agents, and assigns, from and against any and all claims, liabilities, damages, losses, expenses (including reasonable attorneys’ fees), or any other legal actions or proceedings resulting from my actions, omissions, or conduct in the course of my volunteer work.
Severability. I agree that the foregoing waiver, assumption of risk and indemnification provisions are intended to be as broad and inclusive as it is permitted by the laws of the state I am volunteering in and that if any portion is held to be invalid, illegal or unenforceable, it is agreed that the remaining portions shall continue in full force and effect.
By signing this waiver, I release R4 and any third party engaged and/or otherwise associated with R4 from any liability, claims, or demands arising from my volunteer activities and agree to hold them harmless from any future claims.
