I voluntarily assume all risks associated with my participation in activities at RPSFIT. I agree that RPSFIT, its instructors, and staff are not liable for any injury, loss, or damage. I also understand that I am encouraged to work at my own pace and listen to my body during all classes. You voluntarily assume all risks associated with fitness activities and childcare services. RPSFit is not liable for any injuries, illnesses, or accidents occurring during participation, except in cases of gross negligence.*

Code of Conduct: To maintain a supportive and respectful environment, members agree to: Follow all program guidelines and safety instructions, Treat staff and other members with respect, and Avoid disruptive behavior or activities that negatively impact others. Failure to comply with the Code of Conduct may result in termination of membership without refund.*

Subscription & Attendance Policy: I understand that my membership operates on a daily subscription basis. Fees secure my spot in the program and are non-refundable, regardless of attendance. It is my responsibility to attend scheduled classes. No refunds, credits, or make-up classes will be provided for missed sessions.*

Force Majeure Clause: RPSFit is not liable for delays or cancellations caused by circumstances beyond its control, including but not limited to natural disasters, pandemics, or government mandates. Please Initial:*

Any disputes arising out of or relating to this agreement will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Savannah, Georgia, and each party will bear its own costs.*

Cancellation and Refund Policy

Mandatory 7-Day Cancellation Period

In compliance with Georgia law, you may cancel this contract within seven (7) business days of signing for any reason.

To cancel within this period:

1. Notify RPSFit in writing or in person at the facility.

2. Refunds will be issued for any advance payments, minus the fair market value of services received (not exceeding $100).

Cancellation After the 7-Day Period

If you wish to cancel after the seven-day period:

1. In-Person Requirement: Visit the RPSFit front desk during business hours to complete a cancellation form.

2. 24-Hour Notice: Cancellations must be submitted at least 24 hours before the next billing day to avoid additional charges.

3. Feedback Request: Members will be asked to provide feedback on their experience to help improve our program.

Pause Option

If you need to take a temporary break, you may pause your membership for up to 30 days per calendar year. Pause requests must be submitted in person at the RPSFit front desk.

Refund Policy

Refunds are only available under the following conditions:

1. Results Guarantee Policy: If you meet the eligibility requirements but do not achieve measurable results (see below).

2. Permanent Disability or Death: In the event of permanent disability or death, the membership may be canceled without penalty upon submission of proper documentation (e.g., physician’s note or death certificate).

Results Guarantee Policy

At RPSFit, we stand by our commitment to helping you achieve measurable results. If you follow the program guidelines for 30 consecutive days and do not achieve measurable results, we will refund your membership fees.

Eligibility Requirements for Refund:

1. Attendance: You must attend at least 90% of scheduled classes within the 30-day period.

2. Participation: Actively engage in accountability check-ins and complete weekly challenges.

3. Progress Tracking: Submit a completed progress log, documenting attendance, participation, and milestones.

Refund Process:

To request a refund, visit the RPSFit front desk in person and submit your completed progress log along with supporting documentation.
