Waikoloa Canoe Club (WCC) members may rent rack space for their OC-1/OC-2 canoes, subject to availability and priority. Rack space priority is determined by the waiting list and is granted per the following terms and conditions:

Terms and Conditions

1. Membership Requirements
   1. Members must be in good standing and current on their annual dues.
   2. Rack rentals must be renewed annually, operating on a calendar year from January 1 to December 31.
   3. Rack space is non-transferable. If a canoe is sold, the new owner must apply for a rack space and will be placed on the existing waiting list. Subleasing is not permitted.
2. Rack Space Allocation
   1. Individual members may rent one rack space, while family memberships may rent up to two spaces.
   2. The WCC Board reserves the right to move racks or reassign spaces to meet the club's overall needs.
   3. If additional rack space is needed to accommodate WCC regatta racer canoes, priority will be given to WCC racers, and individuals competing for other clubs may be asked to relinquish their rack space.
3. Active Usage Only
   1. Rack spaces are intended for active paddlers and are not to be used for long-term storage of unused canoes.
   2. The WCC Board may require the removal of inactive canoes to accommodate members on the waiting list.
4. Racks for OC-1/OC-2 Usage Only
   1. Rack spaces are designated exclusively for OC-1/OC-2 canoes.
5. Primary Use by Members
   1. Canoes stored in racks must be primarily used by WCC members.
   2. If a WCC member allows others to use their canoe regularly, those individuals must also be dues-paying WCC members and abide by club rules.
   3. Regular use of a canoe by non-members is grounds for termination of this agreement and removal of the canoe.
6. Rack Rental Fee and Payment Deadlines
   1. The annual rack rental fee is $150 plus WCC membership dues.
   2. Only Members in Good Standing are eligible to lease rack space.
   3. Rack spaces not paid for by February 1 will result in the canoe being impounded.
   4. If rack rental fees remain unpaid by June 1, the canoe will be considered abandoned and will become the property of WCC. WCC reserves the right to use, sell, or otherwise dispose of the canoe as deemed appropriate.

WAIVER AND RELEASE OF LIABILITY
By signing below, you acknowledge that you have read and agree to all terms and conditions stated within.

In consideration of my being allowed to store my canoe, as approved, on the storage racks at the Waikoloa Canoe Club site at Anaeho’omalu Bay, I hereby release, waive and discharge WCC, Inc, d/b/a/ Waikoloa Canoe Club, its directors, officers, and members, Moku O Hawaii Canoe Racing Association, Hawaii Canoe Racing Association, Waikoloa Land Company, Waikoloa Development Co., AtPac (Hawaii) LP, Kolea Condominiums, Hilton Waikoloa Village, Lanpar/HTL, Lonomakua Partners, LLC, Transcontinental Development (Hawaii) Co, Waikoloa Beach Association, Waikoloa Beach Marriott, Waikoloa Land  and Cattle Co., and Waikoloa Resort Association and their respective officers, members, agents, successors and assigns from all liability to me, my family, my guests, or others using the storage and other facilities at the Waikoloa Canoe Club Sight, for any and all personal injury or loss or damage to my property caused or alleged of said storage rack and surrounding facilities at the Waikoloa Canoe Club site, for any and all personal injury or loss or damage to my property caused or alleged of said storage and/or removal procedures related thereto. I assume all risk related to use of the storage rack and surrounding facilities.  I understand and acknowledge that no security is provided and that I am solely responsible for ensuring that my canoe and/or other sporting equipment is properly secured and locked so as to prevent or discourage theft and to prevent my boat from falling or being blown off its location.

In consideration of being allowed to participate in any way in this sports activity, related events and activities, the undersigned acknowledges, appreciates, and agrees that: The risk of injury or illness from the activities involved in this sport is significant, including the potential for permanent paralysis and death; and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury or illness does exist; and, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEE'S or others and assume full responsibility for my participation; and, I willingly agree to comply with the stated and customary terms and conditions for participation.

If I observe any unusual or significant hazard during my presence or participation I will remove myself from the activity and bring such hazard to the attention of the nearest coach or team leader immediately. I verify that I will only participate in club activities, on and off water, while in good physical and mental health and that I will not consume any mind altering drugs or alcohol prior to or during club activities that may impede my ability to participate putting myself or others at risk. I will inform the coach or team leader at the beginning of any on water activity if I am not feeling well or have a medical condition and remove myself from the activity.

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS PADDLESPORT RISK MANAGEMENT, LLC; WAIKOLOA CANOE CLUB; WAIKOLOA DEVELOPMENT CO; their officers & directors, officials, agents, and/or employees, other participants, sponsoring agencies, commissions, sponsors, advertisers, volunteers, coaches, steerers, and, if applicable, owners and lessors of premises and equipment used to conduct club activities (“RELEASEE'S”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEE'S OR OTHERWISE.

I also acknowledge that photographs and video may be taken of me in my participation in, and attendance at this club activity, and hereby freely agree to allow without restriction all uses of such photos and videos in the reporting of this club activity , and in the promotion of the club, its location, other sporting events, sport in general, and/or related purposes.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARTICIPANTS OF MINOR AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/legal guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above, of all the Releasee's, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasee's from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEE'S, to the fullest extent permitted by law. I further agree to the photographic and video release set forth above.
