PicklePlay Activities Waiver

I acknowledge and agree to PicklePlays following requirements:

Details of Activity

1. I will be participating in pickleball lessons and games.

Consideration

2. In consideration of being permitted to participate in the Activities, I release and forever discharge PicklePlay, its owners, employees, agents, legal representatives from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in my death, which has been sustained as a consequence of my participation in the Activities, and not withstanding that such damage, loss, or injury may have been caused solely by the negligence of PicklePlay.

3. I understand that I would not be permitted to participate in the Activities unless I sign this Waiver.

Concurrent Release

4. I acknowledge that this Waiver is given with the express intention of effecting the extinguishment of certain obligations owed to me by PicklePlay, and with the intention of binding my spouse, heirs, executors, administrators, legal representatives, and assigns.

Fitness to Participate

5. I acknowledge to PicklePlay that I do not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent me from participating in the Activities. If required I will obtain a medical examination and clearance.

Full and Final Settlement

6. I acknowledge and agree with PicklePlay that:

a) PicklePlay has given me sufficient time to carefully review this waiver,

b) I have been given the opportunity and have been encouraged to seek independent legal advice prior to signing this Waiver,

c) I understand fully the risks and claims that I am waiving to participate in the Activities,

d) I freely and voluntarily execute this Waiver, and

e) I am forever prevented from suing or otherwise claiming against PicklePlay for any property loss or person injury I may sustain while participating or in preparing for the Activities.

Governing Law

7. This Waiver will be governed by and construed in accordance with the laws of the Province of Ontario.
