ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM
RELEASE

In consideration acceptance of this release, the mutual promises set out herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I, the undersigned, assume full and complete responsibility for any type of personal injury, property damage or other damages that may be sustained or may occur while playing, practicing, or participating in anyway as a member for myself and my child/children in The Express Baseball Club (“Express”).

On behalf of myself and my child/children, I hereby release and hold harmless Express, its directors, its employees, agents, servants and volunteers as well as Express organizers, promoters, contributors and all other persons and entities associated with Express, their agents and employees and all others in privity with them or any of them from any and all personal injury, property damage or other damages arising out of my participation in Express, whether such injury or damage be caused by the acts, omissions, negligence, gross negligence, misrepresentation or any or all of these things of those hereby released, including any person or entity associated directly or indirectly with Express, and any and all of them, including their agents and employees.

On behalf of myself and my child/children, I assume the risk associated with my participating as a member of Express including, but not limited to, acts, omissions and negligence of other participants, parents/guardians, coaches, umpires, and players, all such risks being known and appreciated by me.

In consideration of Express's acceptance of this, my release of liability, the mutual promises set out herein, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I hereby agree, on behalf of myself and my child/children, to indemnify and defend Express, its directors, officers, agents, employees, attorneys and all others in privity with them or any of them and all related persons and entities (including, without limitation, all those to whom reference is made herein) against any and all such claims and any and all attorneys' fees incurred by one or more of them in defending claims arising from any personal injury, property damage or other damages injury sustained or which may occur as a result of my participation in any way with or my membership in Express.

I further understand that Express reserves the right, upon non-discriminatory grounds, to exclude me from Express.

On behalf of myself and my child/children, I assume full and complete responsibility for any damage to any persons, property or both that may result from acts, omissions or both of myself or of my child/children, and further understand that neither Express nor any of the others to whom reference is made herein will assume or accept any responsibility for damage to any such persons, property or both.

On behalf of myself and my child/children, I agree to observe proper etiquette, to take all appropriate safety precautions and to observe all applicable rules, laws and regulations of Express relating to my membership in Express. I understand that failure to comply with any and all such laws, rules and regulations may result in disqualification of myself or of my child/children from participation in Express. I am 18 years of age or older, signed it on my behalf and on my child/children, and I understand all of the above.
TERMS, CONDITIONS, AND DISCLOSURES FOR OFF-SEASON TRAINING PROGRAM

By proceeding to checkout and making payment for the Off-Season Training Program, you are agreeing to the terms and conditions outlined in this document.

Description of the Program:
The Off-Season Training Program focuses on improving baseball skills during the off-season. The program typically includes around 18 training sessions, each lasting 60-90 minutes. The camp will consist of "skills and drills" such as long toss, batting, fielding, and other skills development exercises. All sessions must be scheduled in advance and are non-refundable and non-cancelable.

Location and Operating Hours:
Training sessions will be held at Midtown Ballpark, located at 3701 Cockrell Ave, Fort Worth, TX 76110. Session location, dates and times are to be determined and are subject to change. Sessions typically occur during the months of November, December, and January.

Instructors:
The Off-Season Training Program is managed and operated by Express Baseball Club coaches and instructors. There are no third-party partnerships involved in the program's instruction.

Physician's Approval:
As the training sessions can be physically demanding, it is recommended that you consult with your child’s physician before enrolling.

Use of Batting Cages:
Please note that the Off-Season Training Program does not include use of the batting cages.

Participation Agreement

l. I, {parentFirst} {parentLast} ("PARENT/GUARDIAN"), herby ACCEPT the position offered to {playerFirst} {playerLast} ("ATHLETE"), to join The Express Baseball Club (“CLUB”).

III. I am aware of my financial obligations and I agree to meet all payment deadlines. I understand and agree that ALL payments made to CLUB are non-refundable and that no refunds will be issued for any reason. I agree that the option I have selected is for a specific Participation Period. The annual membership lasts between November and June of the following year. I understand an administration fee will be applied to all payments of 11.25% which is not included in the total price of the program.

IV. I understand the total cost of ATHLETE’s initial participation period as indicated above will be divided over {paymentPlan} monthly installments beginning 11-01-2024. The breakdown of the monthly fee will be as follows: {monthlyFee}. As of today, {option1}, the total amount due is {dueToday}. I understand that if ATHLETE joins after the commencement of the Participation Period, I am responsible for the monthly payments that accrued during the applicable Participation Period before joining. Installment payments shall be payable on or before the 1st of each month. I understand that any late payment will be subject to a late fee in the amount of $35.00 and any returned payment will result in an additional fee of $85.00.

V. I understand that if I do not meet the payment deadlines, the ATHLETE may not be allowed to attend or participate in practices, tournaments or CLUB events until all payments are made current. I further acknowledge that I must make these payments for my ATHLETE’s participation without any guarantees as to: (1) the make-up of the team, (2) team performance, (3) ATHLETE’S performance, (4) playing time, (5) placement on a particular roster, (6) number of players on a team, or (7) the number of tournaments, practices, games or events, which may be affected by events outside the control of CLUB. I further that this agreement is binding, enforceable and transferable (in the event the CLUB or the baseball team changes names) even if my athlete is removed from the team whether voluntarily (by me as a parent/guardian) or involuntarily (by the CLUB for any reason(s) the CLUB deems necessary).

VI. I understand that I am responsible for respecting all other staff, players, parents/guardians, umpires, and coaches at all times, on or off the baseball field. I agree that the player and parent shall be respectful at all times and comply with the Team Rules, which are posted on the Team's website and accessible here: https://www.expressbaseballclub.com/teamrules, and which are incorporated by reference. I further agree that, in the event of one or more breaches of the Team Rules by the player and/or parent, the player may be suspended from the Team and participation in some or all team activities, with or without warning, at Express Baseball's sole discretion.

VII. I understand that the Participation Period that I have selected shall automatically renew for the next Participation Period, even if different Participation Periods last for different lengths of time. To terminate my membership, I understand I must send written notice of termination to info@expressbaseballclub.com at least 60 days before the end of the Participation Period. For example, if my membership ends at the end of the Spring/Summer Participation Period, I agree that I must provide a notice to terminate by May 1, and if my membership ends at the end of the Fall Participation Period, I agree I must provide a notice to terminate by September 1.

VIII. I understand that if I fail to abide by this agreement, Express will be entitled to enforce the same and recover its court costs, attorneys’ fees, and/or collection agency fees.

THIS AGREEMENT SHALL BE CONSTRUED UNDER AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS, EXCEPT FOR ANY APPLICABLE CHOICE OF LAW RULES. IN CASE ANY ONE OR MORE OF THE PROVISIONS CONTAINED IN THIS AGREEMENT SHALL, FOR ANY REASON, BE HELD TO BE INVALID, ILLEGAL, OR UNENFORCEABLE IN ANY RESPECT, SUCH INVALIDITY, ILLEGALITY, OR UNENFORCEABILITY SHALL NOT AFFECT ANY OTHER PROVISIONS THEREOF AND THIS AGREEMENT SHALL BE CONSTRUED AS IF SUCH INVALID, ILLEGAL, OR UNENFORCEABLE PROVISION HAD NEVER BEEN CONTAINED HEREIN. THIS AGREEMENT CONSTITUTES THE SOLE AND ONLY AGREEMENT OF THE PARTIES AND SUPERSEDES ANY PRIOR UNDERSTANDINGS OR WRITTEN OR ORAL AGREEMENT BETWEEN THE PARTIES. IX. I understand that if I fail to abide by this agreement, Express will be entitled to enforce the same and recover its court costs, attorneys’ fees, and/or collection agency fees.

THIS AGREEMENT SHALL BE CONSTRUED UNDER AND IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS, EXCEPT FOR ANY APPLICABLE CHOICE OF LAW RULES. IN CASE ANY ONE OR MORE OF THE PROVISIONS CONTAINED IN THIS AGREEMENT SHALL, FOR ANY REASON, BE HELD TO BE INVALID, ILLEGAL, OR UNENFORCEABLE IN ANY RESPECT, SUCH INVALIDITY, ILLEGALITY, OR UNENFORCEABILITY SHALL NOT AFFECT ANY OTHER PROVISIONS THEREOF AND THIS AGREEMENT SHALL BE CONSTRUED AS IF SUCH INVALID, ILLEGAL, OR UNENFORCEABLE PROVISION HAD NEVER BEEN CONTAINED HEREIN. THIS AGREEMENT CONSTITUTES THE SOLE AND ONLY AGREEMENT OF THE PARTIES AND SUPERSEDES ANY PRIOR UNDERSTANDINGS OR WRITTEN OR ORAL AGREEMENT BETWEEN THE PARTIES. I UNDERSTAND THAT FAILURE TO MAKE PAYMENTS AS AGREED WILL BE CONSTRUED AS A BREACH OF CONTRACT AND MAY RESULT IN LEGAL ACTION.

I authorize Express Baseball or its third-party agents on its behalf and the financial institution designated (or any other financial institution I may authorize at any time) to charge my designated credit card for regular recurring payments and any other one-time payments which may cause such payments to vary in amounts, for payments of all charges arising under my Express Baseball Club membership, including but not limited to current or any outstanding Membership Dues, Uniform or Practice Gear, any late fees, program fees, joining fees, administration fees, or other charges which arise from this membership, whether incurred by me or by others on my membership. I may change my designated credit card by any means permitted by Express Baseball, including but not limited to in person at an Express Baseball facility, online, or by calling our office. Upon conclusion of this inital term, I also agree to waive written notice of an increase in any amount to my monthly payment attributable to additional products and services purchased from Express or to other fees, dues, costs or charges that Express collects, including its resubmission of declined transactions.
