Liability Waiver and Release of Liability 1. Description of Activities: I, along with any children accompanying me, am participating in yoga classes, health programs, workshops, and other wellness, bodywork, therapy, exercise, and healing arts activities (collectively, the "Activities") offered by Rincon Valley Yoga. This agreement applies to participation involving the studio, owners, managers, teachers, workshop presenters, employees, and independent contractors (collectively, the "Studio"). 2. Specialized Activity Addendums: I specifically acknowledge the unique risks associated with the following activities: Online & Virtual Classes: I acknowledge that when participating in Activities via live-stream or recorded video, I am responsible for creating a safe physical environment. I represent that I have adequate space, free of obstructions or hazards, and that the studio is not liable for injuries or equipment damage occurring in my home or remote location. I understand that the instructor cannot provide physical adjustments or see my form as clearly as in person. Yoga (Stand-Up Paddleboard): I understand that these activities take place on water and involve risks including, but not limited to, drowning, collision with other boards or watercraft, changing weather conditions, and injuries from falling into or onto the board or water. I certify that I (and any accompanying children) are competent swimmers. Floating Sound Baths: I acknowledge that these sessions involve lying on a floating mat or board on the water while being exposed to sound frequencies. I understand the added risks of motion sickness, falling into the water while in a relaxed or meditative state, and the potential for disorientation upon transitioning from water to land.Outdoor Yoga Retreats: I acknowledge that outdoor activities involve risks, including uneven terrain, varying weather conditions (heat, cold, rain), insects, wildlife, and limited access to immediate medical facilities. Sound Baths: I understand that Sound Baths involve sustained exposure to high-frequency sounds and vibrations (e.g., gongs, crystal bowls). I acknowledge these may be contraindicated for individuals with epilepsy, certain metal implants, or cardiac pacemakers. It is my responsibility to consult a doctor if I have these conditions. 3. Physical and Mental Health: I acknowledge that I must be in adequate physical and mental health to participate. I understand that the Activities may involve intense physical exertion. I confirm that I do not have any medical conditions that would hinder my participation. I recognize that the Activities could cause or aggravate an injury. It is my responsibility to consult with a physician before participating, and I have followed their advice. The Studio reserves the right to refuse my participation for medical or fitness reasons. 4. Assumption of Risk: I understand that participating in the Activities may lead to health risks, including high blood pressure, fainting, heartbeat irregularities, physical injuries, heart attacks, or strokes. I am aware of my physical limitations and am responsible for stopping or modifying my participation to avoid injury. I voluntarily assume all risks, known or unknown, associated with the Activities, including those arising from the negligence of the Studio. 5. COVID-19 and Communicable Disease: I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk of exposure or infection. I understand such exposure may result in personal injury, illness, permanent disability, or death. I voluntarily accept all responsibility for any injury to myself or my children and release the Studio from any claims related to COVID-19. 6. Waiver of Liability and Indemnification: I voluntarily and explicitly waive any "Claims" (including liabilities, demands, legal actions, or death) against the Studio and its "Released Parties" (owners, managers, staff, etc.). This waiver applies even if the claim arises from the negligence of a Released Party. Furthermore, I agree to indemnify and hold harmless each Released Party from any costs or legal fees incurred while defending any claims made by me or anyone acting on my behalf. 7. Media Release: I understand that the Studio may take photographs or video recordings of classes and events. I consent to the use of my image (and my children’s images) for promotional purposes on the Studio’s website and social media platforms (e.g., YouTube, Facebook, Instagram). 8. Governing Law and Severability. This agreement is governed by the laws of the State of Arizona. Any legal proceedings shall be initiated in Pima County. If any part of this agreement is found to be invalid, the remaining provisions shall remain in full force and effect. 9. Refund Policy: Refunds are not provided for missed classes or classes not canceled at least 4 hours in advance. Studio credit may be offered at the owner's discretion. Acknowledgment of Understanding: I have read this agreement thoroughly and fully understand its contents. I am aware that by signing this agreement, I am relinquishing significant legal rights, including my right to sue, and I do so voluntarily.
