1. Acknowledgment of Risk
The Participant acknowledges and understands that participating in activities at Tree of Life Farm, including but not limited to agricultural activities, recreational events, consumption of food or beverages, and any other farm-related activities (the "Activities"), carries inherent risks of personal injury, illness, and property damage. These risks may include, but are not limited to, physical injuries, allergic reactions, foodborne illnesses, environmental hazards, and other adverse reactions. The Participant voluntarily assumes all such risks associated with the Activities.
2. Release of Liability
To the fullest extent permitted by law, the Participant hereby waives, releases, and discharges Tree of Life Farm, its officers, directors, employees, agents, volunteers, and affiliates from any and all liability, claims, demands, actions, or causes of action for personal injury, death, illness, allergic reactions, property damage, or any other loss, damage, or harm arising from or related to the Participant's participation in the Activities, whether caused by the negligence of Tree of Life Farm or otherwise.
This waiver and release extend to all claims or actions arising from, but not limited to:
1) Injuries sustained during the Activities, including while using farm equipment, participating in physical activities, or interacting with animals.
2) Adverse reactions to food or beverages consumed on the property, including allergies, foodborne illnesses, or other health concerns.
3) Any other risk associated with the Activities conducted at or near Tree of Life Farm.
3. Indemnification
The Participant agrees to indemnify, defend, and hold harmless Tree of Life Farm, its officers, directors, employees, agents, volunteers, and affiliates from any claims, lawsuits, demands, or damages arising out of the Participant’s participation in the Activities, including any injury, death, or property damage that may occur.
4. Medical Treatment
The Participant acknowledges that Tree of Life Farm does not provide medical services, and the Participant consents to receive medical treatment in the event of injury or illness while participating in the Activities. The Participant agrees to bear all costs associated with such medical treatment and agrees to hold Tree of Life Farm harmless from any claims related to the provision of medical care.
5. Acknowledgment of Understanding
By signing this Agreement, the Participant acknowledges that they have carefully read and fully understand its contents. The Participant understands that they are waiving their rights to sue Tree of Life Farm for any injury, death, illness, or damage incurred during or as a result of participation in the Activities. The Participant further affirms that they are voluntarily participating in the Activities and that they are fully aware of the risks involved.
6. Age and Authority
If the Participant is under the age of 18, a parent or legal guardian must sign below, affirming their consent to the terms of this Agreement on behalf of the minor Participant. The parent or legal guardian acknowledges that they have the legal authority to waive the minor’s rights and accept the terms of this Agreement.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Texas, in which Tree of Life Farm is located, without regard to its conflict of laws principles.
8. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
9. Entire Agreement
This document constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous understandings, representations, and agreements, whether written or oral, regarding such subject matter.
