1. THE UNDERSIGNED, FOR THEMSELVES AND FAMILY LISTED BELOW, HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the Continental Club, its directors, officers, members, activity leaders, and agents (hereinafter referred to as "releases") from all liability to the undersigned, his/her personal representatives, assigns, heirs, and next of kin for any loss or damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the undersigned, whether caused by the negligence of the releases or otherwise while the undersigned is participating in any activity affiliated with the Continental Club.
2. THE UNDERSIGNED, FOR THEMSELVES AND FAMILY LISTED BELOW, HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releases and each of them from any loss, liability, damage or cost they may incur due to the presence of the undersigned in any activity of the Continental Club whether caused by the negligence of the releases or otherwise.
3. THE UNDERSIGNED, FOR THEMSELVES AND FAMILY LISTED BELOW, HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of releases or otherwise while participating in any activity of the Continental Club.
4. THE UNDERSIGNED, FOR THEMSELVES AND FAMILY LISTED BELOW, ACKNOWLEDGES AND UNDERSTANDS THE RISKS OF SKIING AND OTHER SOCIAL AND/OR SPORTING ACTIVITIES. Nevertheless, the undersigned hereby agrees to assume those risks and to release and hold harmless all of the persons or entities mentioned above who (through negligence, carelessness or otherwise) might be liable to me, or my heirs or assigns, for damages. It is further understood and agreed this waiver, release and assumption of risks is to be binding on my heirs and assigns.
5. THE UNDERSIGNED, FOR THEMSELVES AND FAMILY LISTED BELOW, further expressly agrees that the foregoing RELEASE, WAIVER AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the law of the State of Washington and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. This document is a legally binding contract which supersedes any other agreements or representations by or between the parties and which is intended to provide a comprehensive release of liability, but is not intended to assert any claims or defenses which are prohibited by law.
6. THE UNDERSIGNED, FOR THEMSELVES AND FAMILY LISTED BELOW, HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements or inducement apart from the foregoing written agreement have been made.
7. THE UNDERSIGNED, FOR THEMSELVES AND FAMILY LISTED BELOW, gives permission to verify all information contained within this application and agrees to release the Continental Club or its representatives from any liability resulting from such verification.
