Signing this form shows that you agree to the following:
PRODUCTION
The Content Owner will provide a short missive for pronunciations, plot lines, character traits and anything considered not readily discoverable in the text, in writing, within 14 days of signing this contract.
The Producer will produce a representative sample of the work (approximately 10-15 minutes in length). The Producer will await approval from the Content Owner in writing before continuing with production of the full work. Content Owner is allowed 5 business days to approve in writing. If we don't hear back within 5 days, production of the full work will continue and any artistic changes won't be allowed.
The Content Owner will provide feedback in writing, containing any corrections or artistic clarifications upon review of the sample. The Producer may be expected to produce a second sample incorporating this feedback if Content Owner deems necessary.
The Producer may hire third parties to assist in the production of the Audiobook, including to perform services as proofer, editor, or studio engineer. The Producer agrees to be responsible for the final production of the Audiobook, even if the Producer hires one or more third parties to assist in the production of the Audiobook.
Upon completion of the final audio, the Producer will invoice in writing for the final amount. Content Owner must pay the invoice for final audio files to be released.
At this point, the Content Owner may only request changes from the Producer in writing where the produced audio deviates from the text provided to the Producer at the start of the project.
OWNERSHIP
Once Audiobook is complete, Pink Flamingo Productions shall not retain rights to any part of the audiobook and makes no claim to any sale of the work. Pink Flamingo Productions will not use audio for any purpose other than marketing and promotions of Company and Product.
TERMINATION
This agreement may be terminated by Content Owner at any time before first sample of work is approved with full refund of Marketing Fees. Production Fees are non-refundable. Termination of the agreement after approval of the first sample will result in a fee of one half (1/2) of the fee for the estimated length of project which is determined by word count.
PAYMENT
The Content Owner agrees to pay the Producer a fee equal to amount per finished hour of audio chosen above. (The total fee will be estimated based upon an average of 9,300 words per hour of finished audio.) One half (1/2) of the fee will be paid upon approval of the first 10-15 minute sample. If payment is not received, production will not move forward. The remainder of the fee will be paid once the Content Owner has received the final and complete audio. Payments not made within 15 days of invoice will be charged a 15% late fee each month until balance is paid in full.
Production Fee and Marketing Fee will be invoiced and is due within 7 days of signing this contract.
USE OF AUDIO
The Content Owner agrees to use these voice files in the audiobook and promotion of audiobook only. No part of these files may be used for machine learning, artificial intelligence, or repurposed in any way without written consent of Pink Flamingo Productions and talent associated.
