THE UNDERSIGNED (hereinafter “Model”), for and in consideration of the engagement of the Model as a model by Thrillem, a production company based in VA, United States (hereinafter “Producer”), the opportuniy for publication and distribution of Media (as defined below), and other good and valuable consideration, the receipt and sufficiency of which Model hereby acknowledges, Model does hereby grant to Producer, including Producer’s legal representatives, agents and assigns, the full, irrevocable and perpetual right and permission to create, on the date hereof and on any future date, Media and, in respect of any such Media and of any Media now existent and in the possession or control of Producer, to copyright, edit, modify, make derivative works of, reproduce, make and retain copies of, publish to and broadcast from internet sites hosted by the Platform (as defined below), and to otherwise make use of any Media, in whole or in part, and in conjunction with any aliases, stage or professional names by which Model is, has previously been, or may in the future be, known (the “Permissible Uses”). Model acknowledges and agrees that no further sums shall be due to Model in connection with any Permissible Uses or in connection with the exercise of any of the rights granted hereunder. For the purposes of this Model Consent & Release, “Media” shall mean digital images, photographs, GIFs or videos (with or without recorded sound) in which Model (and, where applicable, Model’s property) is, in any manner, depicted, whether existent or yet to be created and by whomsoever created, and “Platform” shall mean the internet-based platform and hosting service that Producer will use to store, modify, publish, distribute, and broadcast Media.
Model does hereby release and agree to hold harmless Producer, Producer’s representatives, licensees, agents, assigns, employees and any person or corporation (including any such corporation’s employees, contractors, agents, licensees and assigns) acting under Producer’s permission or authority including any entity publishing, hosting and/or distributing any Media and any such entity’s agents, affiliates and subsidiaries, in whole or in part (the “Released Parties”), from any and all damages, liabilities, costs, expenses, claims, and/or judgments of any kind or nature whatsoever arising from any Permissible Uses or the exercise of any of the rights granted hereunder, including, but not limited to, claims based on copyright infringement, invasion of privacy, right of publicity, libel, defamation, or false light, or claims arising from or relating to any alteration, blurring, optical illusion, use in composite form, distortion, or other modification, intentionally or otherwise, that may occur or be produced in the creation, processing, reproduction, publication, distribution or streaming of any Media, even should the same subject Model to ridicule, scandal, reproach, scorn or indignity. Model hereby releases and agrees to hold harmless the Released Parties from any and all damages, liabilities, costs, expenses, claims, and/or judgments of any kind whatsoever arising from any unauthorized use, duplication, publication, theft or misappropriation of any Media by any third party. Model does hereby consent to the depiction of Model in any manner in Media, to the publication of any Media on the Platform, and to the public distribution, downloading or streaming of any Media from the Platform.
To the extent possible, Model hereby grants and assigns to Producer all right, title, and interest in and to all Media including, but not limited to, copyright. Model understands and agrees that Model has no right to inspect or approve any Media prior to its publication or distribution or to inspect or approve any text, graphics, images, or other content created or published in connection with or combined with any Media.
Model hereby warrants, represents and covenants that: (i) Model is of full age and competent to sign this Model Consent & Release, (ii) the rights granted under this Model Consent & Release do not and will not conflict with or violate any commitment Model has made or will make to any person or entity, and (iii) prior to signing this Model Consent & Release, Model has read it in its entirety and has fully understood the meaning and effect of its contents. Model acknowledges and agrees that this Model Consent & Release shall be binding upon Model, Model’s heirs, legal representatives, and assigns.
To comply with Mastercard’s AN-5196 Revised Standards for Adult Content Merchants and Visa’s Integrity Risk Program, The model agrees and attests that:
● The model is a participant in 18+ work on the Producer's web site, and third party sites such as but not limited to entities including but not limited to Patreon, Onlyfans, Mymembersite, or Fansly.
● The model is 18 years of age or older.
● The model has provided/is providing a valid government-issued identity card to the producer.
The Model is providing informed consent to the following provisions:
● The Model consents to being depicted in the work(s) of the Producer.
● The Model consents to their image/depiction being uploaded to, published on and/or distributed through entities including but not limited to Patreon, Onlyfans, Mymembersite, or Fansly and related mobile applications and websites, including publicly, by the Producer.
● The Model consents to their/depiction being viewed, streamed or downloaded from entities including but not limited to Patreon, Onlyfans, Mymembersite, or Fansly,
mobile applications and websites by all members of the general public.
● The Model understands that if entities including but not limited to Patreon, Onlyfans, Mymembersite, or Fansly removes any work I participated in due to lack of consent documentation that I may appeal this removal and have this work reinstated by providing the necessary consent documentation.
● The Model also agree to the Producer and entities including but not limited to Patreon, Onlyfans, Mymembersite, Fansly storing their consent documentation, including all supporting identification documentation, and producing such consent documentation to entities including but not limited to Patreon, Onlyfans, Mymembersite, Fansly, a third-party payment partner and/or card network operator.
