This agreement was made today, between the couple named below, and Katherine K. Cagle Referred to as Photographer.
NON-REFUNDABLE RETAINER:
The retainer fee of $1500 is due on signing this Agreement to hold the date of your wedding.
CONFIRMATION:
A signed "CONTRACT FOR WEDDING PHOTOGRAPHY SERVICES" and payment of the booking fee are necessary to confirm the stated wedding services from the Photographers.
PRE-WEDDING CONSULTATION:
A consultation typically happens at the time of booking. The Bride and Groom will broadly outline what is required, and the Photographers will advise on planning, logistics, and timings where needed. If required, the Bride and Groom are welcome to pop in for an additional chat closer to the time of the wedding (about two weeks) to iron out the remaining details. We will contact you by phone a few days before the wedding to ensure that there have been no last-minute changes.
COOPERATION:
The Bride and Groom and the Photographers consent to happily cooperate and communicate to achieve the best possible result within the understanding of this contract. We recommend that the wedding photographer(s) be provided with a helper (usually the best man) who will point out key individuals to be photographed. The Photographer (s ) may also require the assistance of the best man in organizing family groups. The Bride and Groom also agree to give the Photographer (s) sufficient warning of key events at the wedding to give the photographer time to prepare, e.g., Bouquet throwing, cutting the cake, and speeches. Please note that not all guests at weddings like having their photos taken. In such cases, the wedding photographer(s) will use his discretion but cannot be held responsible for the lack of pictures of these people.
THE SCHEDULE:
Our shooting schedule, working style, and experience are designed to achieve a great set of wedding photos for the Bride and Groom, accomplished with good humor and enjoyed by all concerned. Therefore, both the Bride and Groom and the Photographers agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the wedding does not run on time (for example, extreme lateness by the Bride arriving at the church), we cannot guarantee to take our standard set of photos, although, in such circumstances, we will do our absolute best to compensate.
HOTEL ACCOMMODATIONS:
Rehearsal and Day of Wedding hotel accommodations (1 room with 2 double beds for 2 days or 2 rooms with 1 double bed for 2 days) are required within 10 – 15 miles of the site in a safe location for all employees of the Photographer working the events for any events located further than 40 miles from the studio.
DESTINATION:
Additional fees are applicable for all weddings deemed as destinations (taking place beyond 125 miles from the studio), such as round trip airfare, hotel stay for 4-5 days & 3-4 nights pending complexity, and car rentals from the airport and back during the stay. All travel can be arranged by clients per the Photographers specifications or arranged by Photographer with the Agreement of payment invoiced.
MEAL
The Bride and Groom will provide the Photographer and the second shooter if they are brought on with a meal if they work over 4 hours.
CANCELATION POLICY:
If the event is canceled, no portion of the fees paid to the vendor will be returned. If the event is canceled less than 6 months before the date, 2nd payment will be required to compensate for hours of service already rendered and loss of event date. If the event is postponed, services contracted can be applied to a new date (refer to Postponement Policy).
POSTPONEMENT POLICY:
If the event is postponed, all services will cease at the time of notification of postponement if no determined new date is provided. The payment schedule will be determined and readjusted after post new event date notification. If the Client requires services to resume after a new event date is established, the second payment will be required at the service re-start.
OVERTIME:
Additional unplanned and/or un-contracted services (such as but not limited to a full redo of design, day of wedding extension of time, services outside of the scope of Agreement, management of non-wedding day activities, etc) are considered overtime and will be billed with prior notification and consent at the rate of $300 per hour.
PHOTOGRAPHERS STYLE:
By signing, you state that you have viewed the Photographer's online portfolio and are aware of the Photographer's artistic style. You are aware that the Photographer is the creative director of the shoot. The Photographer will not recreate images from online social media sites.
PAPARAZZI WEDDING GUESTS:
All your guests will have digital cameras, and all your guests will want to photograph the Bride and groom. In the spirit of cheerful cooperation, the Bride and groom agree to give the Photographers precedence over your guests to take the photographs required for the wedding services described above. We cannot be held liable for lack of wedding photos if guests taking pictures of the Bride and Groom have continually interrupted the Photographer's work.
HOUSE RULES:
Note the Photographers are sometimes limited by rules imposed by registrars, ministers, and venue management as to what can and cannot be done. For example, some ministers insist that no flash photography is allowed, and others will insist that the Photographers shoot from a specific location. In such circumstances, the Bride and groom agree to accept the technical limitations that may be imposed on the equipment used. We advise the Bride and groom to make themselves aware of the rules of the venue concerned and, if necessary, negotiate with the personnel concerned.
COPYRIGHT LAW:
Katherine K. Cagle Photography retains the copyrights to all images created during the photo session. The Client has permission to print digital files for personal use only. Digital files may not be used in commercial or business applications or entered contests without Katherine K. Cagle Photography's written permission. Please do not edit digital images or apply filters or presets from any program or social media site.
MODEL RELEASE:
The Bride and Groom grant the Photographers and their legal representatives, heirs, and assign, the irrevocable and unlimited consent to use the photographs of the Bride and groom for editorial, competition, advertising, and any other purpose and in any manner to alter the photographs without restriction, and to copyright the images. The Bride and groom hereby release the Photographers and their legal representatives, heirs, and assigns from all liability and claims in connection with the pictures.
Bride and Groom hereby relinquish any right that he/she may have to examine or approve the finished product or products or the advertising copy or printed matter that may be used in connection with an image that the Photographer has taken of the wedding day l or the use to which it may be applied. Bride and Groom waive any ownership and publication right he/she might be entitled to in connection with the Pictures, except for the personal use of the Pictures as part of a personal modeling portfolio. Bride and Groom agree he/she has no right to sell, license, or publish any of the Pictures to any person or entity.
The Bride and Groom represent that he/she is 18 years or older, that the photography session was conducted in a completely proper and highly professional manner, and this release was willingly signed.
SOCIAL MEDIA:
Do not add filters to your images. Should additional edits be needed, please get in touch with the Photographer to assist you. When you share, please tag Katherine K. Cagle Photography.
LIMIT OF LIABILITY:
If a photographer is too ill or becomes injured and cannot supply the wedding services specified above, the Photographer (s) try to book a replacement wedding photographer. Under normal circumstances, a second photographer from the Photographers is there for the day anyway, and this Photographer will then shoot the day on his/her own. If both photographers are unavailable and a replacement photographer cannot be found, then liability is limited to a refund of any payments received. Photographers have working methods to prevent the loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen, or destroyed for reasons in or beyond our control. In these circumstances, liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.
BOOKING FEE/DEPOSIT:
If the Bride and groom cancel the wedding for whatever reason, the booking fee is non-refundable. It will be considered as liquidated damages to the Photographers. We have understood the contents of this contract and agree to the terms therein.

RESPONSIBILITY
The Photographer is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the Photographer, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, the Photographer will obtain, upon approval of the Client, a qualified professional replacement to fulfill Photographer's obligations under the contract at no additional charge to the Client.
PAYMENT SCHEDULE AND METHOD
For your convenience, payments can be made online via HoneyBook.com using a valid credit card. The initial retainer of $1500 is due upon completion of the signed Agreement for services. The remaining balance is due one week before the event date.
Payment plans can be arranged but are subject to fees. You agree to make auto payments monthly, subject to fees, and have the remaining balance paid seven days before your event.
ATTORNEY
If legal action is necessary to enforce the terms of this contract, the prevailing party shall be entitled to reasonable attorney fees in addition to any other remedies to which that party might be legally entitled.
APPROPRIATE AND SAFE WORKING ENVIRONMENT
The Client (s) expressly agree(s) to take their best efforts to provide Photographer and Photographer's staff with safe and appropriate working conditions. In the event of circumstances deemed by either Photographer or a bystander to present a threat or implied threat of injury or harm to Photographer staff or equipment, the Photographer reserves the right to cancel all services remaining under this Agreement and leave the event. At the Photographer's discretion, the Photographer may enact a three-strike policy. After the first offense, the Photographer will make reasonable efforts to notify the Client (s) or a responsible party. Suppose the Client (s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes). In that case, Photographer shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client (s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, the Photographer will immediately leave the event. Suppose the Photographer leaves the event early due to any offending behavior. In that case, the Client (s) expressly agree to relieve and hold Photographer harmless due to incomplete event coverage or for a lapse in the quality of the Photographer's work. The Client (s) shall be responsible for payment in full.
The undersigned have read this contract, understand its terms, and agree to be bound thereby. Any additions, deletions, or revisions must be made in writing and approved by all responsible parties. The parties agree that this contract is the complete and exclusive statement of the mutual understanding of the parties.
