WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
In consideration of attendance, participation in and/or utilization of any dog training class, dog daycare or dog boarding service (collectively hereinafter, the “Services”) offered by JVHall LLC, a Virginia limited liability company, d/b/a All Things Pawssible (hereinafter, “ATP”), the undersigned hereby agrees, acknowledges, and states as follows:
1. I hereby acknowledge that attendance, participation in and/or utilization of any of the Services includes inherent risks to all attendees, including myself and my dog, because some of the dogs to which we will be exposed may be difficult to control, may not be vaccinated despite representations otherwise, and may be the cause of injury, death, or damage, even when handled with the greatest amount of care. I acknowledge and understand that dog training classes, dog daycare and dog boarding can be hazardous activities, and I am fully aware of the risks associated with these Services for both myself and my dog, including, without limitation, all manner of illness, new injury, aggravation of existing injury, anxiety, stress, damage, or death (collectively, the “Potential Injuries”).
2. I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE ATP and any of their employees, volunteers, officers, directors, agents, assigns, representatives, and associated trainers (collectively, the “Releasees”) from any and all liability, claims, demands and causes of action whatsoever arising out of or related to any loss, damage or injury, including death, that may be sustained by me, my dog or any of my invitees at ATP, or any personal property belonging to me, while attending, participating in and/or utilizing any of the Services offered by ATP.
3. On behalf of myself, my dog and any minors under my authority who may be present at any of the Services operated or offered by ATP, I hereby expressly assume the risk of any Potential Injuries arising from such attendance, participation in or utilization of any Services which may be incurred while at ATP, on ATP’s premises, or, at, or near any entrance to ATP’s premises.
4. I hereby further agree to INDEMNIFY AND HOLD HARMLESS ATP from any liability, claims, demands, losses, damage or costs, including court costs and attorneys fees, from any Potential Injuries to any person or dog which may be alleged to have been caused directly or indirectly by me or my dog at any of the Services offered or provided by ATP or while on ATP’s premises or at, or near any entrance to ATP’s premises.
5. I hereby acknowledge, certify, warrant, and represent that:
- My dog which I seek to participate, attend, or utilize any of the Services offered by ATP is NOT A HAZARD TO HUMANS OR OTHER DOGS in health or temperament.
- My dog has never shown aggression, bitten, injured or killed another dog or person.
- I will keep my dog on a leash during all times when entering and/or exiting the ATP premises.
- I will not bring any toys or bowls from home to ATP for any of the Services in recognition that this may cause territorial and/or aggressive behavior.
- My dog has all age-appropriate vaccinations, and I will provide proof of such immunity upon request by ATP.
- My dog is physically sound and free from any condition that would prevent or limit its participation in any of the Services.
- I am an actual owner, or duly authorized agent, of the dog which I seek to enroll and have full authority to enroll them in any of the Services.
- I will not bring my dog to ATP for any of the Services if, to my knowledge, the dog has been exposed to any communicable diseases within 30 days of the date in which I seek to attend, participate in or utilize any of the Services.
- Should I leave my dog at ATP for a period of 4 consecutive days after the end of any dog training class or dog daycare, or after their designated pickup date from dog boarding, without having secured another owner or custodian for the dog, the dog will be considered “abandoned” and ATP may take all necessary steps to rehome, adopt or relocate the dog.
6. I agree and acknowledge that ATP does not require the Bordatella vaccination, and further agree that should I elect to give this vaccine, I will keep my dog out of the ATP facility for two weeks after vaccination to avoid shedding the virus on/near other dogs.
WHEREFORE, in signing this WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT, I have read, acknowledged, and accepted these terms and conditions, and certify that all the information given is accurate and truthful. I further agree that I understand and sign this agreement voluntarily and no other oral representation, statements or inducements have been made apart from this written agreement. I am at least eighteen (18) years of age, and I execute this agreement for full, adequate, and complete consideration, acknowledging my waiver of rights and intending to be bound by the same.
