These Terms and Conditions ("Agreement") apply to all bookings and use of facilities provided by South East Leisure ("SEL"). By confirming your booking, you ("Hirer") agree to comply with these Terms and Conditions.
1. General Terms
1.1 Access is strictly limited to the booked space and time, including setup, activity, and pack-up periods.
1.2 Additional usage beyond the booked time will be subject to availability and may incur additional fees.
1.3 The Hirer is responsible for ensuring that all participants, spectators, and associated parties comply with these Terms and Conditions.
1.4 Supervision of all attendees is the Hirer’s responsibility, ensuring allocated spaces are adhered to throughout the booking.
1.5 Requests for setup outside of booked times must be made in advance, and additional charges may apply.
1.6 The Hirer must return the premises to its original state, including cleaning and removal of waste after use.
1.7 The Hirer is liable for repair costs resulting from damage caused by negligence or misuse.
1.8 Hazardous, flammable, or dangerous materials are not permitted on SEL premises.
1.9 Activities must not obstruct common areas, staff operations, or other patrons.
1.10 Noise levels must remain acceptable and not disrupt other users, nearby residents, or businesses.
1.11 The Hirer must notify SEL of any booking changes and receive confirmation for adjustments.
1.12 Affixing items to the venue without prior written approval is strictly prohibited.
2. Financial Terms
2.1 Payment Terms: All booking fees must be paid within 14 days of invoice issuance unless otherwise agreed in writing.
2.2 Fee Adjustments: SEL reviews fees annually, with adjustments implemented as required. Changes in fees for bookings made before adjustments will be communicated to the Hirer, who may review the updated terms.
2.3 Late Payments: Unpaid invoices beyond the due date will incur late fees calculated as the last quarter's Consumer Price Index (CPI) plus a 2% administrative fee. SEL reserves the right to suspend or cancel future bookings until all outstanding balances, including penalty interest, are settled.
2.4 Cancellation Policy: Cancellations must be made in writing. The Hirer must adhere to the cancellation terms outlined in the signed Booking Form.
2.5 Bonds and Additional Charges: Refundable bonds are subject to the Bond Form terms. Additional charges apply for cleaning or damages incurred during the booking.
2.6 Legal Costs: The Hirer will bear any legal costs incurred by SEL in recovering unpaid amounts, including solicitor fees and collection charges.
3. Conduct and Safety
3.1 The Hirer and attendees must comply with all applicable laws and SEL’s Code of Conduct.
3.2 Disruptive or unsafe behavior may result in immediate expulsion and, in some cases, cancellation of the booking without refund.
3.3 The Hirer must maintain a safe and respectful environment, ensuring appropriate supervision of children and individuals with disabilities.
3.4 All safety incidents or hazards must be reported to SEL staff immediately.
4. Insurance and Indemnity
4.1 The Hirer must hold valid public liability insurance of at least $10 million, providing proof upon request.
4.2 The Hirer indemnifies SEL against all claims, damages, and liabilities arising from their use of the premises.
5. Security
5.1 SEL reserves the right to require security personnel for specific bookings.
5.2 Security staffing levels will be determined by SEL, with costs included in the booking fee.
6. Child Safeguarding
6.1 The Hirer must comply with all child safety legislation, including Working With Children Checks (WWCC).
6.2 All personnel supervising children must carry valid WWCC cards at all times while on SEL premises.
6.3 SEL has zero tolerance for child abuse and reserves the right to remove individuals who fail to meet child safety standards.
7. Emergency Management
7.1 The Hirer and attendees must follow SEL’s emergency procedures, including evacuation plans and assembly point guidelines.
7.2 SEL reserves the right to close facilities or relocate bookings in the event of emergencies.
8. Equipment and Materials
8.1 The Hirer is responsible for any equipment brought onto the premises. SEL accepts no liability for loss or damage.
8.2 All electrical equipment must be approved by SEL and carry a current test and tag.
8.3 Promotional and marketing materials require prior written approval and must be removed after the booking.
9. Privacy
9.1 Personal information collected for booking purposes will be handled in accordance with SEL’s Privacy Policy, available at SEL Privacy Policy.
