Backyard Starz LLC

WARNING: There are elements of risk in any adventure, sports, or recreational activity associated with the use of inflatable and/or outdoor equipment and activities incidental thereto (collectively referred to in this document as the “Activity”). While Backyard Starz LLC has taken reasonable steps to provide appropriate equipment and trained staff, the Activity is not without risk. Certain risks cannot be eliminated without destroying the unique character of the experience. For your safety and the safety of all participants, it is important that you understand these risks in advance.

I acknowledge that participation in a mobile Nerf Gun Battle and related activities provided by Backyard Starz LLC may result in personal injury, accidents, or illnesses, including but not limited to:

• Sprains, torn muscles, or ligaments
• Fractured or broken bones
• Eye damage (if goggles are not worn or used improperly)
• Cuts, bruises, abrasions, or contusions
• Concussions, head, neck, or spine injuries
• Allergic reactions
• Dehydration, oxygen shortage (anoxia), or exposure
• In rare cases, shock, paralysis, or even death

I understand this list is not exhaustive and that unknown or unanticipated risks may also result in injury, illness, or death.

1. Voluntary Participation: I understand that my (or my organization’s) participation is entirely voluntary. No one is forcing me to participate.
2. Physical and Mental Fitness: By signing this document, I verify that I am physically and mentally fit, not under the influence of alcohol or drugs, and sufficiently capable and trained (if applicable) to participate in these activities.
3. Responsibility for Minors: If signing on behalf of a minor, I accept full responsibility for all risks to that child.
4. Acceptance of Risk: I assume full responsibility for any bodily injury, accidents, illness, death, property loss, and associated expenses as a result of my participation in the Activity, regardless of whether such injuries or losses arise in whole or in part from the negligence of Backyard Starz LLC or its staff.

• In the event of an injury or medical emergency, I authorize any necessary medical treatment for myself (or my minor child).
• I acknowledge that I either have appropriate medical insurance or agree to pay all costs associated with any rescue or medical services that may be incurred on my/our behalf.

In consideration of being allowed to participate in the Activity, I hereby release, discharge, and covenant not to sue Backyard Starz LLC, its parent companies, affiliates, subsidiaries, franchisees, officers, directors, agents, volunteers, employees, sponsors, advertisers, or the owners/lessors of any premises where the Activity takes place (each considered one of the “RELEASEES” herein).

• Scope of Release: This release covers all liability, claims, demands, losses, or damages on my account, including those caused or alleged to be caused in whole or in part by the negligence of the RELEASEES, including negligent rescue operations.
• Agreement to Indemnify: If I, or anyone on my behalf, nonetheless brings a claim against any of the RELEASEES, I agree to indemnify, save, and hold harmless each RELEASEE from any litigation expenses, attorney fees, loss, liability, damage, or cost they may incur as a result of such claim.

I grant permission for Backyard Starz LLC to photograph or record me (and any minors under my care) during the Activity. I understand these images or recordings may be used for promotional purposes without compensation or further consent.

I, the undersigned parent or legal guardian, understand the nature of the aforementioned Activity and believe the minor is qualified to participate. I accept full responsibility for the minor’s safety and well-being. I further agree to release, discharge, and hold harmless each RELEASEE from all liability, claims, demands, losses, or damages on the minor’s account, including those caused or alleged to be caused in whole or in part by the negligence of the RELEASEES. If I or anyone on the minor’s behalf makes a claim against any RELEASEE, I agree to indemnify, save, and hold harmless each RELEASEE from any litigation expenses, attorney fees, loss liability, damage, or cost they may incur as the result of such claim.

I have read this Acknowledgement of Risks, Assumption of Risks & Responsibility, and Release of Liability thoroughly. I understand that by signing this document, I may be waiving certain legal rights, including the right to sue. I sign freely and voluntarily, without any inducement or coercion.
