In consideration of being permitted to participate in hot air balloon activities organized by Shepherd Balloon Operation & Maintenance LLC ("Company"), I, the undersigned Participant, hereby acknowledge, agree, and represent as follows:

Release and Waiver:
I hereby voluntarily release, waive, discharge, and covenant not to sue the Company, its owners, officers, employees, agents, affiliates, and representatives (collectively, "Released Parties") from any and all liability, claims, demands, actions, causes of action, losses, or damages, including but not limited to bodily injury, death, or property damage, arising out of or in connection with my participation in the hot air balloon activities, whether arising from the negligence of the Released Parties or otherwise.
Assumption of Risk:
I understand and acknowledge that participation in hot air ballooning activities, including setup, launch, flight, landing, and associated transportation, involves inherent risks, including serious injury or death. I voluntarily assume full responsibility for all such risks, whether foreseen or unforeseen.
Pilot Authority:
I acknowledge that the pilot-in-command is solely responsible for the safe operation of the aircraft and has the final authority to determine whether the flight shall be conducted.
Indemnification:
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, judgments, costs, expenses (including attorney’s fees), or liabilities arising out of my participation in the activities covered by this agreement.
Severability:
I agree that this agreement is intended to be as broad and inclusive as permitted by applicable law. If any provision or portion hereof is held invalid, illegal, or unenforceable, such shall not affect the validity or enforceability of the remaining provisions.
Governing Law:
This agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates.
Certification:
I certify that I am at least eighteen (18) years of age and in good health, physically capable of participating in hot air balloon activities. I have carefully read this Release of Liability, Assumption of Risk, and Indemnity Agreement, fully understand its terms, and execute it voluntarily and with full knowledge of its significance.
For Minor Participants:
If applicable, I further certify that I am the parent or legal guardian of the minor participant identified below, have legal authority to execute this agreement on their behalf, and agree to be bound by its terms.
