QUARRY DAYS VENDORS IN THE PARK
LIABILITY WAIVER AND RELEASE FORM
1. Vendor Qualification
The Chamber reserves the right to refuse participation in the event that qualifications outlined on the vendor form are not met. These qualifications include timely submission of the application, accurate documentation of products or services offered, and compliance with event standards. No buy/resell is allowed.
2. Prohibited Items
Items such as or related to tobacco/e-cigarettes, alcoholic beverages, firearms, illegal drugs, explosives, and offensive or "adult" items, including materials that could be considered inappropriate for a family-friendly environment, shall not be permitted for exhibition or sale. Vendors must ensure all products meet safety standards and comply with all federal, state, and local laws.
3. Insurance and Permits
It is the Vendor's repsonsiblity to carry the necessary insurance for their prdoucts and displalys in relation to their participation in this show. The Vendor also represents that they hold all permits and/or licenses required by law.
4. Booth Supervision
Vendors are responsible for supervising their booths at all times, including before, during, and after the event. In the event a Vendor needs to leave their booth temporarily, arrangements should be made with neighboring vendors or event staff. The Chamber is not responsible for unsupervised booths. All unsold merchandise shall remain the property of the Vendor.
5. Original Merchandise
Vendors warrant that all items offered for sale are original and do not infringe upon any intellectual property rights. Vendors agree to pay any royalties or other fees required for their merchandise.
6. Prohibited Conduct
Vendors and their personnel shall not consume alcohol, illegal drugs, or tobacco/e-cigarettes before or during the event or at load-out. Vendors displaying signs of inebriation or drug use will be asked to leave without a refund. Smoking is strictly prohibited on the premises during the event.
7. Monetary Exchange Responsibility
Vendors are solely responsible for all monetary exchanges and tax obligations associated with sales at the event. Vendors should prominently display their sales tax permit if required by law.
8. Liablity and Indemnification
Vendors agree to indemnify and hold harmless the Dell Rapids Chamber of Commerce, its employees, volunteers, agents, sponsors, and the CIty of Dell Rapids from any injury, damage, or loss incurred in connection with the event. Vendors are responsible for damages caused by their actions or omissions and must acknowledge this clause in writing. Overnight volunteers, if provided, assume no liablity for booth contents.
