Payment Terms

I understand the terms of this agreement. All class sessions are supervised by qualified personnel trained in the procedures and traditions and the martial arts. I agree to pay for the class sessions in accordance with the payment plan indicated above. All promotion registration fees (test fees) are excluded from this contract. I further understand that failure to complete the lessons does not relieve me of the obligation to pay the tuition in full. I understand that a $7.50 late charge will be assessed for any payment seven days past due. I understand my rights as stated above. I understand that I may cancel this contract without any penalty or future obligation within three (3) days from the date of this agreement. Notice of cancellation shall be in writing and mailed to the school by registered or certified mail.

I will faithfully comply with all of the rules and regulations of the school and the traditions of the martial arts. In consideration of being allowed to participate in any way in the program, related events and activities, I the undersigned acknowledge, appreciate, and agree that:

1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death. I understand that I should consult a physician before enrolling myself in the program.

2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releases or others, and assume full responsibility for my participation.

3. I have no knowledge of any physical conditions, which would render me unable to participate in the specified class sessions.

4. I understand that I am expected to have my own health insurance to cover me. I understand and agree that should medical attention be required, I and/or my insurance provider shall be responsible for all costs associated with such medical attention.

5. I willingly agree to comply with terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

6. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS ELITE MARTIAL ARTS, INC, its officers, officials, agents, and/or employees, other participants, instructors, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any injury, disability, or death I may suffer; or loss or damage to person or property, whether arising from the negligence of the releases or otherwise, to the fullest extent permitted by law.

7. I, individually further hereby release the RELEASEES from any claim whatsoever which may arise as a result of any first aid, treatment or services or assistance provided to me in connection with any injury that arises from activities during the program. I take full responsibility for my welfare and safety during the program. I hereby give permission for emergency medical treatment to be administered as deemed appropriate.

8. I agree that photos or videos may be taken during my participation in these activities and that such images may be used in promotional material.

9. In addition to ELITE MARTIAL ARTS, INC, all of the preceding also applies to the World Tang Soo Do Association, the World Ki Gong Association, the landlord of any of our facilities and any facility used for any event or activity.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
