Rental Provider: Human Smart Job Sp. z o.o., headquartered in Pruszcz Gdański (83-000)
Pruszcz Gdański, Chopina Street 36, registered in the Register of Entrepreneurs of the
National Court Register under the number KRS 0001090662, with registration records
maintained by the District Court in Gdańsk, 7th Commercial Division, NIP: 6040231370,
hereinafter referred to as the "Service Provider," represented by Mahammad Mammadov.
Terms and Conditions
1. The Lessor (hereinafter referred to as the "Lessor") provides, and the Tenant
(hereinafter referred to as the "Tenant") rents, an electric bike of the brand Ecobike,
hereinafter referred to as the "Bike."
2. Upon receipt, the Tenant confirms that the Bike is in good condition, operates
correctly, and is clean.
3. The Tenant rents the Bike along with the following accessories: an electric bike with a
battery, charger, bike lock, and phone holder.
4. The Bike is rented for a minimum period of two weeks. In case of termination, the
Tenant must notify the Lessor at least seven days in advance.
5. The Tenant assumes full financial responsibility for the entrusted equipment and
acknowledges being informed of its value.
6. The Tenant has read the operating instructions for the Bike and agrees to follow
them.
7. The Tenant is not permitted to transfer the Bike to third parties or rent it out to others.
The Tenant must return the Bike personally to the Lessor.
8. The Tenant agrees to take proper care of the Bike. In case of damage, the Tenant
bears the repair costs, as determined by the Lessor.
9. The Tenant agrees to park the Bike in a safe location to prevent theft. In case of theft
caused by the Tenant's negligence, the Tenant assumes full financial responsibility
for the loss.
10. The Tenant is not allowed to repair the Bike at service centers other than those
authorized by the Lessor. If repairs are needed, the Tenant must immediately inform
the Lessor, who will arrange for the repairs.
11. Rent is payable in advance every seven days, either in cash or by bank transfer to
the Lessor’s account.
12. In case of breach of any clause of this agreement by the Tenant, the Tenant agrees
to pay the Lessor a contractual penalty (specified in the annex to this agreement) for
each violation.
13. Matters not regulated by this agreement are subject to the provisions of the Act on
the Protection of Tenants' Rights, the Municipal Housing Stock, amendments to the
Civil Code, and the provisions of the Civil Code.
14. Any amendments to this agreement must be made in writing to be valid.
15. I declare that I have been informed about the possibility of reporting to the FLEETCHECK register of the owner PZPA Solutions Sp. z o.o. any violations related to the performance of my duties, in particular those related to indebtedness. I acknowledge that I have the right to object to the entry in the register and to request its correction.
I consent to the transfer (assignment) of my receivable arising from the concluded legal relationship (cooperation/employment agreement) to an authorized entity indicated by PZPA Solutions to the extent consistent with the purpose described in the register of driver/courier offenses and the principles of personal data processing. Furthermore, I consent to the processing of my personal data for the purpose of pursuing claims arising from outstanding payment arrears and to the transfer of information about my indebtedness to institutions involved in assessing creditworthiness and payment credibility, including the Credit Information Bureau S.A. (BIK), in accordance with applicable law. I declare that I have been informed about the possibility of assignment within settlements, as well as about the preservation of my rights, including the right to access the data, correct them, and object to their processing.
16. The agreement is made in two identical copies, one for each party.
Annex 1: Fees
1. Rental of one additional battery for an electric bike: 50 PLN (7 days)
2. Deposit: 0 PLN
3. Service costs: As individually assessed (when due to Tenant's fault)
4. Late return of Bike (with equipment) beyond the agreed rental period: 100 PLN per
day
5. Loss/damage of the electric bike battery: 2300 PLN
6. Damage to the battery casing (top cover): 100 PLN
7. Loss/damage of the battery key/lock: Repair cost
8. Damage to the frame: 950 PLN
9. Damage to the front/rear wheel: 300 PLN
10. Damage to the charger: 120 PLN
11. Damage to the bike lock (rear/main): 150 PLN
12. Damage to the display: 250 PLN
13. Damage to the throttle grip: 100 PLN
14. Damage/loss of flashlight: 70 PLN
15. Loss of locker key: 40 PLN
16. Returning a dirty bike: 30 PLN
17. Damage to the rear wheel: 649 PLN
18. Returning the Bike without providing a 7-day notice: 100 PLN
19. Cost of a stolen/lost bike: Full bike price (if not covered by insurance)
20. Cost of Bike repair after an accident: As assessed by service.
