Legal Disclaimer and Agreement
This Legal Disclaimer and Agreement ("Agreement") is entered into by and between Conscious Colorado Collective also known as CCC ("Organization") and the applicant ("Applicant"). By participating in the application process, Applicant agrees to the following terms and conditions:
1. General Disclaimer
The information provided by CCC during the application process is for informational purposes only and does not constitute legal, financial, or professional advice. CCC makes no representations or warranties, express or implied, regarding the accuracy, completeness, or reliability of any information provided. Applicants are solely responsible for ensuring that their submissions comply with all applicable laws, regulations, and guidelines.
2. Liability Waiver
CCC disclaims all liability for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the application process, including but not limited to:
- Technical malfunctions or interruptions;
- Data breaches or unauthorized access to submitted information;
- Errors, omissions, or delays in processing applications;
- Rejection of applications for any reason;
- Events beyond CCC's reasonable control, including but not limited to acts of God, natural disasters, or other force majeure events.
Applicants assume all risks associated with their participation in the application process.
3. No Guarantee of Acceptance
Submission of an application does not guarantee acceptance or approval. CCC’s decision-making process is final and not subject to appeal or external review. CCC reserves the sole and absolute discretion to approve, reject, or take no action on any application, for any reason or no reason, without liability or obligation to the Applicant.
4. Confidentiality and Intellectual Property
All submissions will be treated in accordance with CCC’s Privacy Policy. By submitting an application, the Applicant:
- Confirms that they hold all necessary rights, licenses, and permissions to any intellectual property included in their submission and agrees to indemnify and hold CCC harmless from any claims, damages, or liabilities arising from third-party intellectual property disputes.
- Grants CCC a limited, non-exclusive, and revocable right to review and evaluate the submitted materials solely for the purposes of the application process.
CCC does not claim ownership of any intellectual property included in the submission.
5. Dispute Resolution
Any disputes arising from or related to the application process shall be resolved through a mutually agreed-upon method of dispute resolution, such as mediation or arbitration. The specifics of the dispute resolution process, including location, rules, and cost allocation, shall be determined at the time of the dispute in consultation with both parties.
6. Data Protection and Privacy Compliance
CCC processes all personal data in accordance with applicable data protection laws, including but not limited to the Colorado Privacy Act (CPA). CCC is not liable for any data breaches caused by third-party service providers used during the application process.
7. Force Majeure
CCC shall not be held liable for any failure or delay in fulfilling its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, or other force majeure events.
8. Consent to Terms
By submitting an application, the Applicant acknowledges that they have read, understood, and agree to be bound by the terms of this Agreement. The Applicant further consents to the use of electronic communications and signatures for all purposes related to this Agreement and the application process.
9. Amendments and Modifications
CCC reserves the right to amend or modify this Agreement at any time without prior notice. Any changes will be communicated through email notification to Applicants or by posting a notice on the application platform. It is the Applicant’s responsibility to review this Agreement periodically for updates.
10. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
11. Non-Waiver
Failure by CCC to enforce any provision of this Agreement shall not be construed as a waiver of any rights or remedies under this Agreement.
12. Entire Agreement
This Agreement constitutes the entire understanding between CCC and the Applicant regarding the application process and supersedes all prior agreements, understandings, or representations, whether oral or written, relating to the subject matter hereof.
