School Tuition Agreement Terms and Conditions
1. Agreement to Pay Tuition The undersigned (referred to as the “Parent/Guardian”) agrees to pay the full tuition and associated fees for the enrollment of their child(ren) (referred to as the “Student”) as outlined above to Graham & Keane, LLC DBA The Garden. This agreement is legally binding and enforceable under the laws of the state of North Carolina.
2. Commitment to Full Payment By signing this agreement, the Parent/Guardian acknowledges and agrees that they are obligated to pay the full tuition amount for the term noted above, regardless of whether the Student withdraws, is dismissed, or otherwise ceases attendance at any point during the school year. Tuition is calculated and charged on an annual basis, and no portion of tuition or fees will be refunded or canceled for any reason*.
3. Payment Schedule Tuition may be paid in full or according to an approved payment plan established with the school. Payment plans must be adhered to, and failure to make timely payments will result in penalties, including but not limited to late fees, suspension of the Student from classes, and possible referral to collections.
4. Withdrawal Policy If the Parent/Guardian elects to withdraw the Student from the school, written notice must be provided to the school’s administration. Such notice does not relieve the Parent/Guardian of the obligation to pay the remaining tuition balance for the academic y e a r.
5. Late Payment and Penalties Payments not received by their due dates will incur a late fee 15% per occurrence. Continued delinquency in payment may result in further actions, including suspension or expulsion of the Student, and referral to a collection agency. All costs of collection, including attorney’s fees and court costs, will be the responsibility of the Parent/Guardian.
6. Refund Policy The school does not issue refunds for tuition or fees under any circumstances*, including withdrawal, suspension, or expulsion of the Student.
7. Force Majeure The school is not liable for any delay or failure in performance of its obligations under this agreement due to events beyond its reasonable control, including acts of God, natural disasters, pandemics, government mandates, or other unforeseen circumstances. In such events, tuition remains payable and non-refundable.
8. Governing Law This agreement is governed by the laws of the state of North Carolina. Any disputes arising under this agreement will be resolved in the appropriate court within the state.
9. Entire Agreement This agreement constitutes the entire understanding between the parties regarding tuition and supersedes any prior agreements or understandings, whether written or oral.
10. Acknowledgment and Acceptance By signing below, the Parent/Guardian confirms that they have read, understood, and agreed to all terms and conditions of this agreement and in the Community Handbook provided at the time of enrollment. This agreement becomes effective upon signature.
