  • This Artist Exhibition Agreement ("Agreement") is made and entered into as of

  • by and between: Gallery Name: ART HARBOR LLC Address: 914 Front Street, Georgetown, SC 29440 (Hereinafter referred to as the "Gallery")

    AND

  • (Hereinafter referred to as the "Artist")

    Both parties agree to the following terms and conditions in connection with the exhibition

  • of the Artist's works at the Gallery:

    1. Exhibition Details

    1.1 Exhibition Title: The exhibition will be titled "

    1.2 Exhibition Dates: The exhibition will be displayed at the Gallery from:

    1.3 Location of Exhibition: The exhibition will be held at the Gallery located at 914 Front Street, Georgetown, SC 29440.

  • 2. Scope of Exhibition

    2.1 Artwork to be Displayed: The Artist agrees to provide the following works for the

    [Description of the works, number of pieces, medium, dimensions, etc.]

    2.2 Presentation of Artwork: The Gallery will allocate approximately 150 square feet of display space, including provisions for installation and necessary security to ensure the protection of the Artist's works.

    2.3 Sale of Artwork: The Artist agrees that the works displayed in the exhibition will be available for sale unless otherwise specified in writing. The Artist will set the prices for each artwork listed in the exhibition. The Gallery will provide sales assistance during the exhibition period.

     

  • 3. Gallery's Responsibilities

    3.1 Promotion: The Gallery will promote the exhibition through:

    • Social media
    • Email
    • Newsletters
    • Press releases 
    • Flyers and posters
    • Opening reception event (if applicable)


    3.2 Exhibition Opening/Reception: The Gallery will host an opening reception on

  • to introduce the Artist and their works to the public. The Artist is encouraged (but not required) to attend.

    3.3 Insurance: The Gallery will provide insurance coverage for the artwork during the exhibition period, covering the value of the work while on Gallery premises against risks of theft, fire, or damage, subject to the Artist's written appraisal of the artwork's value.

    3.4 Sales Handling: The Gallery will manage all sales transactions and will be responsible for invoicing, collecting payments, and providing sales records to the Artist.

    4. Artist's Responsibilities

    4.1 Artwork Delivery: The Artist is responsible for delivering the artwork to the Gallery on or before ______________. Delivery should be made to 914 Front Street Georgetown SC 29440. The artwork should be delivered in ready-to-display condition, including necessary framing, wiring, or other presentation requirements.(No alligator-style hangers, please)

    4.2 Artwork Pickup: The Artist will be responsible for picking up the artwork after the conclusion of the exhibition, no later than  _____________________. If the artwork is not picked up by this date, the Gallery may charge a storage fee of $25 for each day the artwork remains in the Gallery's possession.

    4.3 Artist's Commission: If any work is sold during the exhibition, the Artist will receive 50% of the sale price. The Gallery will retain 50% as commission.

    4.4 Promotional Materials: The Artist will provide the Gallery with the following materials

    • High-resolution images of each work
    • Artist's Biography
    • Artist Statement
    • Any other relevant materials (e.g., press clippings, exhibition history)

    5. Financial Arrangements

    5.1 Gallery Commission: The Gallery will retain a commission of 50% of the sale price of each artwork sold during the exhibition.

    5.2 Payment to the Artist: The Gallery will remit the proceeds of any sales to the Artist within 30 days after the exhibition's conclusion or after the sale. Payments will be made via

    5.3 Exhibition Fee: The Gallery will charge the Artist an exhibition fee of $65 to cover the cost of the exhibition (e.g., reception food & beverages, space rental, administrative costs, etc

    6. Liability and Insurance

    6.1 Liability: The Gallery will take reasonable precautions to ensure the safety of the artwork. However, the Gallery shall not be responsible for any loss, theft, or damage of the artwork unless caused by the Gallery's gross negligence or willful misconduct.

    6.2 Insurance: As noted in Section 3.3, the Gallery will insure the artwork for its value, as indicated by the Artist.

  • 7. Term and Termination

    7.1 Term of Agreement: This Agreement will be effective from the date of execution by both parties until the conclusion of the exhibition, including the removal of artwork as

    7.2 Termination: Either party may terminate this Agreement by providing written notice to the other party at least 7 days in advance of the exhibition start date. If the Artist terminates the Agreement after delivery of artwork, the Artist will be responsible for all costs incurred up to the termination date.

    8. General Provisions

    8.1 Confidentiality: Both parties agree to keep all financial details and other proprietary information related to this Agreement confidential unless otherwise required by law.

    8.2 Governing Law: This Agreement will be governed by and construed in accordance with the laws of South Carolina.

    8.3 Amendments: Any amendments to this Agreement must be in writing and signed by both parties.

    8.4 Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior or contemporaneous communications, whether oral or
