Hi, I'm so glad we are going to be working together. This is the inital agreement so we can confirm the interview date - we do not require any sales page copy or deliverables on this form.

We should have already discussed everything on this page, but just in case something was missed this gives us time to discuss any questions right away before the interview.

There will also be another form for sending sales page copy and deliverables..

PLEASE only submit when you have everything ready - putting something like TBD or "will get later" causes errors, we see the issues almost every time! For example someone puts TBD on their live call dates, then they schedule themselves out of town during the live call timeframe.

You can hit Save at bottom and it will send you a link to your email for the draft you are working on. Helpful if you are working on it over sevearl days. If you accidentally submit partial information or put TBD, we will ask you to resubmit the whole form when you have all of the information, you will be able to edit the original submission.

Commitment to our Partnership

By completing this form, you understand we are both committing to a spot on the Happivize calendar. On your end, you agree to provide us the content and information we need to create everything on our site. On our end, we commit to your time and your offer. Other platforms have 3 and 4 speakers a week and missing one for them isn't that big of a deal. But it's a very big deal for Happivize! We promote you the whole week to really give you the opportunity to connect with our audience. Once you commit, we stop offering that slot to anyone else, and if you cancel with less than two months notice,we can't just plug in someone else because other speakers won't be able to create a new program in time.

If you realize you are someone who overschedules themselves, or procrastinates and then cancels, or feels too much pressure when creating a program...we can come up with an alternate way to work together. Please reach out to Aimee if you feel you might cancel...there are other options! And yes, we know all our speakers have great intentions, but we have had enough speakers cancel at last minute to require this whole section.

So we are requesting to please be honest with yourself and only commit if you know you can and will deliver. (Obviously true emergencies come up, we aren't talking about that). We thank you in advance for being honest and upfront with how you work and who you are! As long as we know in advance, we can create a win-win.
I feel very comfortable that I can and will deliver my program as we scheduled, I will block off time (or whatever works best for me) for my creation process, including writing my sales page, any beta-test, collecting testimonials, and creating the deliverables so that we can launch a great program together.I agree to give at least two month's notice before interview date if I need to cancel.

4 WEEK EXCLUSION PERIOD - so we can both focus on promoting your Happivize appearance to our communities without overlapping another summit appearance and promotion, you agree that you won't appear on another summit within 4 weeks before or 3 weeks after your launch date on Happivize. There is a small degree of flexibility in this, we probably already discussed this, and if something urgent comes up, please ask.*

I currently do not have another summit scheduled 4 weeks before or 3 weeks after the above launch date, and/or I have discussed my summit schedule with Aimee directly.I also won't schedule Q&As to re-promote a previously launched program during this timeframe.I agree to note on my calendar (or whatever works best for me) so that I do not schedule a new selling summit interview or Q&A 4 weeks before or 3 weeks after my above interview date.(The following is the main the reason that this ends up happening, so I am including the info here, it literally happened with 3 of our speakers in a row this month so I decided I should address it specifically.) If another summit asks to move my already scheduled date and the new date will be within the 4 week before or 3 week after time, I will explain that I'm unable to accommodate the schedule change. Other summits who schedule multiple speakers each week often ask to move speakers' dates around because another speaker wants to move their date, but you can tell them it conflicts with another scheduled summit, they will be okay with that.If I do accidentally forget and reschedule another summit such as Darius, Eram, Judy etc within this window, I agree to let the other show know I made a scheduling error and need to reschedule with them.I also agree not to offer a program covering any of the same topics we are covering on Happivize between now and our scheduled interview date (unrelated topics on other summits are fine as long as it's not in the above mentioned window).

I always forget to ask this! Do you have an upsell around the $800 price point that you would like to offer only to people who purchase one of the above packages? Examples are a group of sessions, a mastermind, small group coaching etc. While they are buying something from you and have said yes to you is a great time to offer them a higher end product*
Live Calls & Sessions

We also want to make sure you have your program live calls and sessions blocked out on your calendar, so we ask for the following info.

Dates and times of Live calls (if part of your program)

1) When to Schedule them We like to re-promote your program again right before live calls start, and we have alloted a re-promote time for each speaker based on a 3 week rolling live call start date. Meaning each speaker starts their calls in 3rd week after launch and each week we re-promote that one speaker. So please schedule your calls
- In the third week after interview eg if May 1 call, then week of May 22
- Wed - Sun live call dates is best for repromotion. Customers love weekends if that's doable. If you pick a Monday or Tuesday, we will only be able to re-promote you once since we have sale ending for the speaker on Monday and new speaker on Tuesday. Wed-Sun live calls we can send a solo email about your program.
- 3pm or later ET - note that 90% of our buyers are in North America, so calls need to be scheduled around N. American times
If you choose to start a week not 3 weeks later, we will not be able to re-promote you.

LMK if you need clarification - this rolling start on live calls is to maximize sales and repromotion for your program.

2) We will use the dates listed below to block the space on our Happivize calendar to make sure your calls don't conflict with other speakers' scheduled calls (if calls are at same time, it might prevent people from buying your program). We will reach out if there is a conflict, it is first come first serve and can be easily remedied.

Confirming for Live Calls

I have listed / converted times to Eastern TimeIf I'm outside of North America, I have double checked each date for Daylight Savings issues if any calls are in March, Oct/early Nov. I have kept the times consistent for N. America and adjusted my calendar time if needed for DST changes. eg https://www.worldtimebuddy.comI have double checked that the day of week matches the date listed.I understand that the Happivize audience is primarily looking to experience energy healing as opposed to lots of teaching. Teaching can be part of it for sure, but they will be most interested in a transmission/activation in the live calls. Most speakers will do about 15-20 mins of teaching, 20 mins of transmission/activation type things (can be interspersed with the teaching), and 15-20 mins of Q&A.
Private Sessions - confirm you have at least some slots on your calendar available for Happivize customers who get private sessions within about 1-3 weeks after launch so that our earliest *(most eager) buyers can get in fairly soon, this is especially for those speakers who book a month or more out. If we already talked about their being a delay on your availability, please note that below, or ask Aimee about this before submission*
For speakers new to Happivize - we have better sales if I have a session with you in advance and can personally talk about your work. Please provide a link for me to schedule a session and I will try to make it work. As you can imagine this means I end up in lots of sessions! But I do make an effort to schedule them since it helps with sales. If I cannot due to being out of town etc, my project manager may attend and provide written testimonial*
GIFT #1: For new people who Register on Happivize

When new people opt-in, they are given short welcome gifts for our upcoming speakers so they can get a taste of your work and look forward to your interview. A single 7-15 minute MP3 or short private/unlisted video is recommended. Should be a clearing/activation type experience, not teaching. This should be a single gift, not a 2part gift.

Please provide a graphic and link to the file and a one sentence description.

This does NOT need to be new or exclusive to Happivize, just needs to be a good teaser, it's fine if you have offered it many times before and if some in the audience will already have it.

I understand that my interview and product offer are "evergreen" and agree that they will be continued to be offered to the public for at least one year. If after one year you do not want us to continue offering the product, please let us know and we will remove within 30 days.I understand that it is a 50/50 split on the product(s) after approximate 3.29% credit card processing fee (our cost averaged over 12 mos, may change slightly if cc fees change)I agree that any marketing materials (eg. text, images, formatting, graphics, testimonials, ratings/reviews) created or supplied by Happivize are the property of Happivize and may not be copied or used elsewhere. Any original materials or text provided directly by you may of course be used by you elsewhere, but that does not include our edited version. All deliverables content provided by the speaker remains the sole property of the speaker, with the understanding that we have an unrestricted license to distribute them to purchasers of your product.I agree that the materials of my program (other than private sessions) may be shared with Happivize staff for familiarizing with content, and Happivize staff may participate in the group part of programs to provide testimonials when possible.I agree not to offer this program in whole or in part to my list directly during the first year of evergreen sales. I also agree to a program with overlapping topic(s) to my list directly or on another show between now and the launch of the program.Parity of sales channels - I agree that for as long as this offer is on Happivize, I will not offer the above product(s) on any other sales channel at a lower price or with additional or updated content at the same price, unless I make the same terms and content available to Happivize one week in advance of the new offer so that the Happivize offer can be updated simultaneously. This is so customers who purchase in the evergreen mode don't feel like they need to price shop to find a better price.I understand that Happivize has different 10% off promotions that may apply to your product, such as for a birthday or a coupon for 10% off first purchase when new customers register and buy within the first 30 days, or special bundle offers. We try to use these sparingly so they are special and a motivation to purchase. You agree that Happivize can offer up to 10% off the list price of your product(s) This is separate from the $10 off per package "early-bird sale" in the first week of a launch.I understand Happivize has a 30-day refund period or until a private session has been conducted, whichever is sooner. Customers must schedule private sessions within 6 months of purchase and give at least 24 hours notice of reschedule, otherwise the session is forfeit.Commissions will paid by the 15th of the following month for the completed sales in the previous month. A completed sale is one single pay sale, or both payments on a 2-pay sale. For example completed sales in January will be paid by Feb 15. After several months, when single sales come in, you will be paid on the 15th of the month following the end of the refund period (date of sale + 30 days), with commissions held over until there is a minimum of $100 accrued.I agree to reply to comments on the Facebook Happivize Community post "Ask (Expert Name)" where customers can ask an agreed upon question, whether the package will help, and/or ask for recommendation of which package is best. You can see posts for previous healers on the Happivize Community page (https://facebook.com/groups/happivize) to see what it involves. The majority of the comments will be in the first week. We will turn off commenting the day after your first live call starts. It may be turned back on if we do a repromotion as described below.If we connected as a result of a Happivize customer recommendation, we both agree to offer that customer one free package (for the first time you appear on Happivize) as a thank you for connecting us.I agree to have a repromotion of the all-digital part of my program 4-12 months after initial launch at a sale price. Typically it is summer and Black Friday. Generally the package that is the digital + recorded group calls + remote healing are offered for $99 during summer for 4 days during Black Friday/-Cyber Monday at $89 and then $99 for rest of week. If your package style is different, we can discuss the price. We offer 10% off for a package with session but by far majority of are the $89/99 packages. The purpose is to offer the package at a discount since the live calls are now recorded. You also agree to promote this with at least one email to your list.These "Agreement Terms" will be in effect for any future programs you offer on Happivize on or after the signature date, unless the terms are tweaked, in which case we will ask you to sign a new agreement. This way you don't have to agree to all of these every time you offer a program.
PAYMENT OF COMMISSIONS - it will be either via Paypal for US sole proprietors and certain int'l countries or by direct bank deposit (if you file as an s or c corp or are in UK or Australia). Fees deducted for wire transfers outside of the USA of flat $10, but the exchange rate is 1-1.5% which is much better than Paypal's 4.5% in addition to their $5 fee. For US sole proprietors, please provide paypal email below, there is a $100 minimum payment per month, we will hold commissions until you accrue $100 or more. If we pay via paypal and you give us the wrong email address below, you agree that you may have to forfeit your commissions for that month. Paypal does not automatically refund if the commissions go to the wrong email, we will try to get them back to send to you (it happened once and we got it back, but it can take 30 days), but we cannot promise.*

Promotion Information

We send 5-7 solo emails and include you in 3-4 newsletters to promote your program. We ask that you send two before your interview to your unique opt-in page. Then one to announce the replay, one to announce the Early Bird Sale is ending, and one a few days before the live calls start (these last 3 go to replay/product page page for those who didn't feel like opting in). Swipe will be provided for all emails. Any further promotion is appreciated.

I hereby expressly grant to Happivize, LLC, as represented by Aimee Serafini the right to use photos and/or audio and visual impressions ("impressions") of me recorded by or provided by me to Aimee Serafini, in connection with or as part of any presentation, program, publication, product, transmission or other professional endeavor in which the impressions may be used or incorporated, and also in the advertising, and/or publicizing of any analog or digital works or their content, in perpetuity.

I agree that it may be edited or otherwise altered. I understand that these impressions, as well as my name, likeness, voice and biographical material, may be used for commercial, educational or informational purposes, in any manner or media, in perpetuity, throughout the world. I waive any rights of copyright or ownership in the resulting commercial, educational and informational materials in which I appear, and acknowledge that no monetary or other compensation is provided in exchange for waiving this right. I also agree to allow all forms of distribution of the materials that accompany the impressions. I represent that I have the right, capacity, and authority to enter into this agreement (the "Agreement") and that my participation and performance and the rights I have granted in the Agreement will not conflict with or violate any commitment or understanding I have with any other person or entity.

I agree to indemnify and hold harmless Aimee Serafini and Happivize LLC from and against all claims, losses, expenses, and liabilities of every kind including reasonable attorney’s fees arising out of the inaccuracy or breach of any provision of this Agreement.
