Dog Walking, Pet Sitting & Homestay Agreement

This is an Agreement between Pawz and Clawz Playground (The Dog Walker and Pet Sitter) and the Client (Owner). Services, charges, days and times to be agreed by both parties.

The utmost of care will be given in watching both your pet(s) and your home.  Pawz and Clawz Playground will undertake the agreed-on services and the Owner undertakes to provide all necessary information to assist in this performance Pawz and Clawz Playground will provide the services agreed in a reliable, caring and trust worthy manner. In consideration of these services, the Client waives any and all claims against Pawz and Clawz Playground.

Pawz and Clawz Playground undertakes to notify the Owner of any occurrence pertaining to the pet which may be relevant to the care and well-being of the pet.

SERVICES One on One walks, Adventure Pack walks, Day Stay, Pet sitting, Homestays, Vet Visits/Pet Transport, Pet Feeding, Pick up and Drop off Service, and Pet Boarding, and Medication Administration.

REQUIREMENTS Pawz and Clawz Playground is committed to providing the best care for your pets; however, will not be responsible for any pets who become sick or experience health issues during their time with Pawz and Clawz Playground. We recommend that all pets be up-to-date on vaccinations, this included flea, tick, and heartworm prevention, and in good health prior to their stay. By using our services, you acknowledge and accept this policy. 

As a courtesy to The Pet Sitter and to ensure The Pet Sitter is able to professionally provide services to your pet(s) and home without inconvenience, the service address (e.g. your home) should be kept in clean and orderly condition during the service dates. The client must provide all items necessary for pets to be adequately cared for in the client's absence. (I.e., food, medication, bedding, cat litter etc Should pets require any additional supplies whilst in the care of The Pet Sitter, these will be purchased and charged to the Client.

SOCIAL MEDIA The client gives consent for their pet’s image to be used in photo or video format on Pawz and Clawz Playground social media pages or promotional material.

DUTIES/SERVICES The Walker shall not be obliged to perform any other duties except those specified and agreed upon, per this agreement.

KEYS Pawz and Clawz Playground warrants to keep safe and confidential all keys, remote control entry devices, access codes and personal information of the Owner and to return same to the Owner at the end of the contract period or immediately upon demand.

PAYMENT The client is responsible for settling the company’s invoice for services 2 days prior to the commencement of the assignment. Failure to do so will incur a $15 a day penalty. All payments can be acknowledged and receipted if required.

CANCELLATIONS Cancellation by the Owner of scheduled walks with less than 24hrs notice may be charged at the full rate or rescheduled at the discretion of the Walker. This includes missed walks due to dog not being available on pick up.  Where the Walker as sole proprietor needs to cancel a scheduled walk due to unforeseen circumstances, may change days or extra walks will be arranged.

Charges may incur for Pet Sitting and Homestay up to 50% of the scheduled visits if cancelled less than 24 hours in advance. Should the client return early during a booking, payment will be discussed. The Pet Sitter reserves the right to terminate service at any time before or during pet sits, if The Pet Sitter in its sole discretion, determines that Client’s pet poses a danger to the health or safety of a person or another animal. If concerns prohibit Pet Sitter from caring for pet(s), Client authorizes pet(s) to be placed in a boarding kennel, with all charges from there on to be charged to Client.

DAMAGES Pawz and Clawz Playground accepts no liability for any breach of security or loss of or damage to the Owner's property if any other person has access to the property during the term of this agreement. Pawz and Clawz Playground shall not be liable for any mishap of whatsoever nature which may befall a dog or caused by a dog who has unsupervised access to the outdoors.

It is understood that anyone with access to the home will be notified of Pawz and Clawz Playground presence and vice versa. Pawz and Clawz Playground reserves the right not refuse entry to any visitors nor pre-authorized and informed about, by the Owner. Pawz and Clawz Playground will not be held responsible for any damages incurred to your home or pet(s) by visitors pre – authorized visitors. The Client agrees to notify Pawz and Clawz Playground of any concerns within 24 hours of client’s return home. Pawz and Clawz Playground cannot be held responsible for any mishaps, claims, and/or expenses attributed to a destructive or unpredictable behavior of the Client’s pet(s) that cause damage to the Client’s home/property and/or a neighbor’s home/property. (i.e., biting, furniture damage, accidental death, etc Nor can Pawz and Clawz Playground be held liable for injury, disappearance, death, or fines of pet(s) with access to the outdoors.

LOSS OR INJURY The Owner shall be liable for all medical expenses and damages resulting from an injury to the Walker, any animals or any person caused by the pet as well as damage to any property. Pawz and Clawz Playground are not liable for death or injury to any pet in the event of a motor vehicle accident. Pawz and Clawz Playground are not liable for loss or injury to any pet. 

DISPUTES Before taking any court action, a party must use best efforts to resolve any dispute under, or in connection with the Agreement through good faith negotiation. Each party must, to the extent possible, continue to perform its obligations under the Agreement even if there is a dispute.

GENERAL PROVISION Pawz and Clawz Playground is not liable to the Client for any failure to perform its obligations under the Agreement to the extent caused by Force Majeure, provided that the affected party a) immediately notifies the other party and provides full information about the Force Majeure; b) uses best endeavors to overcome the Force Majeure; and c) continues to perform its obligations as far as practicable.

SEVERABILITY Any illegality, unenforceability or invalidity of a provision of the Agreement does not affect the legality, enforceability or validity of the remaining provisions of the Agreement.

EMERGIENCIES If the Client, or the other contact person cannot be reached, the Client agrees to accept any decision Pawz and Clawz Playground makes in regards to the pet’s care or Clients property. The client is responsible for any veterinary bills, no matter how they are incurred, whilst pets are in the care of Pawz and Clawz Playground. The Client agrees to reimburse Pawz and Clawz Playground for any additional fees for tending to emergency or veterinary care as well as any expenses incurred for same. 

I have read the above terms and conditions. I know, understand, and agree to all terms stated above. By signing below, I am accepting this document as a contractual agreement.
