Client Job Terms
Quality Finish Construction also known as Quality Finish Inc. will be hereby referred to in this document as "QFC". (Updated 1/1/25)
General Terms
Thank you for choosing Quality Finish Construction, herein referred to as “Quality Finish Inc.” or “QFC”.This agreement is between QFC and the customer purchasing construction services herein referred to as “Client”. Completion of the project is based on the available scheduling of all parties: 8am-5pm as standard work hours, or a mutually agreed upon schedule. Changes to scheduled hours per the Client’s request could impact the completion timeline. Allow 1-2 days grace for completion of large jobs. Unforeseen issues that come up related to the job could cause scheduling delays for job completion. Additional work required to complete the job due to unforeseen circumstances, not listed on the original estimate could incur additional costs for labor and time. This includes delays due to the job site being unprepared or inaccessible by the client.
TERMS and CONDITIONS of SALE
Invoice statement of payment balance is due upon industry standard completion of the job. The Client will have 5 days from the date of job completion to pay the statement balance. Payments can be made via Cash, Bank transfers, Zelle, Debit, Credit or Check. A 3% charge will be incurred for debit or credit card payments. Checks may be made payable to “Quality Finish Inc.”. A FINANCE CHARGE of 1.5% per month, 18% per year will be charged to past due accounts. If this account shall be placed in the hands of an attorney for collection, the Client shall be responsible for all expenses incurred, without limitation, reasonable attorney's fees and legal expenses. The Client is responsible for any restocking or freight charges if order is canceled for any reason not mutually agreed upon. For projects over $3,500 and which require significant material purchase, a 25% down payment for total estimate may be required to add a job to the company schedule.
Licensing
Quality Finish Inc. promises that it holds all licenses necessary to perform the work, that such licenses are valid and effective as of the date any work is performed or services provided, and that all work performed or services provided will be done in compliance with all applicable federal, state, or local laws and regulations. Work required during the job that is not within the scope of the initial repair may require additional charges or hiring of a subcontractor which could incur additional costs.
Authority to Sign
Each party has the authority to enter into this Contract and to perform all of its obligations under this Contract.
Modifications
The Client and QFC must agree to any changes to this contract in writing.
Materials / Expenses
The initial job estimate represents an “estimate” of the material costs. Actual material costs may need to be updated or adjusted after final purchases are made. The Client will reimburse Quality Finish Inc. for reasonable expenses incurred by the Business in the provision of services under this Contract. This includes all materials purchased to complete the job which may not have been completely calculated by the original estimate, or additional services agreeably performed due to unforeseen job-related issues. No unreasonable or exorbitant expenses will be incurred without prior approval between Quality Finish Inc. and the Client.
Jobsite Containment
QFC agrees to be diligent in containing dust and debris from areas at the jobsite not under construction. Appropriate masking will be applied and plastic containment walls put up where necessary to contain debris inside construction areas. Client property inside construction areas will also be covered where considerable dust may fall. Drop cloths and/or plastic will be laid to protect flooring when needed. Debris and dust however cannot always be completely contained, as debris tends to travel and escape through vents, and while entering and exiting construction areas.
Owner Supplied Materials
Any materials supplied by the Client to QFC will not be covered under warranty or guaranteed by QFC for structural integrity or functionality.
Furniture Moving etc
The moving of furniture or other objects at the work site in order to complete jobs may be subject to an hourly fee. This may occur with heavy objects or when multiple items needs to be moved which impact job completion schedules. Some items such as delicate or high value items may be refused to be moved due to liability concerns.
Company Markup
The Client understands that QFC has a Material and General Contractor markup for all materials purchased and all subcontracted work provided during the project to cover overhead and operating expenses for the company. This markup is subject to change at any time based on the industry market climate and is available upon request.
On-Site Subcontractors
The Client agrees to not hire directly any subcontractors that have been hired by QFC to provide estimates or to complete work for the Client.
QFC Supervision
QFC supervisory staff may be present at times during subcontracted jobs, but may not be unless specifically requested by the Client. On-site supervision by QFC staff may be subject to an hourly rate unless explicitly required as part of the scope of work for the project.
Hours of Operation
QFC is open to receive and respond to calls, text messages, emails, and general communications Monday through Friday, 7am - 4pm. Company services are closed on Saturdays and Sundays, unless an emergency comes up or a job is being performed by QFC that requires communication with the Client. Any communications outside of normal business hours will be at the discretion and availability of QFC staff.
Inspection
The Client will be assumed to have accepted the service(s) performed unconditionally unless a claim that the service(s) are defective is made within 30 days from the date services are completed. Areas of workmanship that are discovered to be severe or faulty in function or structure will still be covered by QFC standard warranty period.
Warranty / Refund
2 Year Workmanship Limited WarrantyQuality Finish Inc warrants all labor in its contract work with the client to be free from defects in workmanship for a period of two (2) years. This 2 year Limited Warranty is for workmanship only and does not cover any manufacturer or product warranties. The warranty begins on the date of job completion. The warranty is given to the original client or property owner and is non-transferable unless required by Arizona State Law. Some restrictions apply.Any work performed that does not meet the required industry standard and is not performed to the client's satisfaction, must be notified by the client to Quality Finish Inc. and given a mutually agreeable time to fix the problem. If Quality Finish inc. cannot or will not fix the problem, a refund must be given to the client within 30 days of notification to the client that the work cannot be completed or rectified. If the work cannot be fixed or completed due to unforeseen issues that were beyond the control or awareness of Quality Finish Inc., resolution may require additional fees and/or a sub contractor may have to be hired to complete the job. ARIZONA RULE 4-9-108 WORKMANSHIP STANDARDS: A. A Contractor shall perform all work in a professional and workmanlike manner. B. A contractor shall perform all work in accordance with any applicable building codes and professional industry standards. C. All work performed by a contractor in a county, city, or town that has not adopted building codes or where any adopted building codes do not contain specific provisions applicable to that aspect of construction work shall be performed in accordance with professional industry standards
Termination of Contract
This Contract is effective upon signature of the Client, and remains in tact throughout the working relationship between QFC and the Client. If one of the parties chooses to end the Contract prior to a Project completion, the Client is responsible for paying for all work and costs incurred up until that date. If Quality Finish Inc. chooses to end the project prior to job completion, there must be a valid reason that makes job completion impossible, potentially dangerous, threatening or inappropriate. Quality Finish Inc., will not tolerate any form or verbal or physical abuse and may terminate a contract at any time due to any such abuse, threats, abusive language, assault, forms of aggression, etc. towards any QFC employees, contractors, representatives or subcontractors of Quality Finish Inc. Criminal violators will be prosecuted in accordance with the law. Either party may choose to end the working relationship by written correspondence.
