Thank you for giving Highway 280 Paint & Body the opportunity to serve you. This agreement contains the terms of our repair contract with you and/or the insurance carrier for your claim.
Repair Authorization: You authorize us to repair your vehicle as described in the written estimate that has been provided to you. We may need to revise our estimate if we discover unseen damage that cannot be detected without dismantling the vehicle. If we observe further damage and your additional authorization is required to repair it, we will contact you. If you instruct Highway 280 Paint and Body not to repair your vehicle after we have started our work, we will charge you for the labor required to reassemble the vehicle, restocking fees for pre-ordered parts and/or materials, storage for the time the vehicle was in our possession, and any other fees we incur related to your vehicle. You acknowledge and consent to our use of third parties to perform certain parts of the repair process, in our discretion. We will be responsible for the work of any third parties in accordance with our warranty.
Your Vehicle While in Our Possession: You authorize us to operate your vehicle for diagnostic, testing, and other service-related purposes, including conveying the vehicle to and from third parties, performing any parts of the repair process. While we take reasonable precautions to make sure your vehicle is safe, we are not responsible for damage to your vehicle that is beyond our control. This includes but not limited to damage caused by acts of God such as hail, water, wind damage, or criminal acts such as vandalism or theft. We are not responsible for the loss of any personal items that you leave in your vehicle. Please remove all your personal belongings.
Diagnostic Scanning: We preform pre and post-repair diagnostic scans of your vehicle as part of the repair process during which historical vehicle data will be collected. Including in some cases, the date, time and mileage of when a diagnostic trouble code was generated. We collect this information for purposes of repairing your vehicle and we may share it with others as needed to complete the repair of your vehicle and settle any insurance or payment claim. You authorize Highway 280 Paint & Body to perform these diagnostic scans on your vehicle and use the data as described above, even if your insurance coverage does not pay for either of these procedures. If insurance coverage is not available, you agree that you shall be solely responsible for all costs incurred by Highway 280 Paint & Body in connection with performing any such diagnostic scans on your vehicle.
Payment Terms: We require full payment prior to releasing your vehicle to you. You agree to be responsible for all fees, costs or other expenses that we may incur to collect payment for any unpaid and/or overdue charges that you authorize, including but not limited to attorneys’ fees and court costs. NOTE: There is a 3% convenience fee for credit card use.
Direction to Pay and Assignment of Insurance Proceeds: If an insurance company is responsible for paying any part of the repair charges, you authorize and direct that insurance company to make payment directly to Highway 280 Paint & Body. You also assign all your rights to any insurance proceeds intended to pay for our repair work to Highway 280 Paint & Body. If an insurance company delivers payment for our services to you, you understand you are obligated to pay Highway 280 Paint & Body with those funds.
Limited Power of Attorney: Insurance companies may send us checks or other negotiable instruments for our services that are made payable to you individually or jointly to you and Highway 280 Paint & Body. By signing below, you grant us limited power of attorney to endorse, negotiate and/or deposit any forms of payment made in your name and to apply those funds to repair charges that you owe. You acknowledge that because Highway 280 Paint & Body has an interest in the insurance proceeds paid for repairs performed, this limited power of attorney is coupled with an interest.
Payment Guaranty and Lien Rights: You are responsible for any charges that you authorize which are not paid by an insurance company, regardless of reason. To secure payment for our work, you grant Highway 280 Paint & Body a lien against your motor vehicle for any unpaid charges. If we are not fully paid for our work, you further authorize Highway 280 Paint & Body to perfect a lien against your vehicle with the governmental authority that issued your auto title.
Warranty: We offer a written warranty on our repair labor. To make a claim under our warranty, you must give us the opportunity to inspect and correct any defects. We are not obligated to pay for inspection or estimating fees, storage or repair work charged or undertaken by any other party without prior written consent. This section presents selected points about our warranty and does not represent all its terms and conditions. Our complete warranty will be provided to you upon completion of repairs and is also available upon request.
Communication: By providing your mobile number, you acknowledge and agree that Highway 280 Paint & Body may contact you at that number, including via an automatic telephone dialing system and/or artificial or pre-recorded voice with notifications regarding status and services as well as other non-marketing purposes. You further warrant to Highway 280 Paint & Body that you are a subscriber or customary user for the phone number. You agree to promptly notify Highway 280 Paint & Body if the number you have provided is canceled or changes.
This agreement may not be modified. Any notations or markings on this agreement attempting to change its meaning are not binding to Highway 280 Paint & Body.
