In consideration of being permitted to participate in the above-identified program/activity, I acknowledge, understand, and agree to be bound by the following terms and conditions: 1) I warrant that I am over the age of 18 and that I hereby knowingly and voluntarily waive any and all claims I have now and in the future, and release from all liability and agree not to sue the SPFA, its officers, directors, employees, agents, contractors or volunteers (Releasees) for any personal injury, death, property damage or loss sustained by me as a result of my voluntary participation in the program/activity offered by SPFA and identified above, due to any cause whatsoever, including, without limitation, negligence on the part of SPFA or any of the other Releasees or other program participants. I further agree that if I violate this agreement and attempt to bring suit against any of the parties released, that I will be held responsible for the reimbursement of reasonable attorneys' fees and court costs incurred by that party in defending such action. 2)I acknowledge my understanding and acceptance of the risks of the program/activity being offered and in which I am participating. I further agree that if I suffer injury or illness, SPFA or its designated agent can, at my cost, arrange for any medical treatment and emergency evacuation service as it or they may deem necessary for my health and safety. 3)I agree to at all times abide by and comply with instructions given to me by SPFA and/or its designated employee, agent, contractor or representative or the individual or entity managing the program or activity and that failure or refusal to comply with such instructions may result in my removal from the program/activity. 4)For myself, my heirs, assigns, personal representatives and next of kin, I hereby forever release, indemnify and hold harmless SPFA, its officers, directors, employees, volunteers and authorized agents or representatives and contractors from and against any claims, actions, causes of action, losses, injuries or damages to persons or property, costs and expenses, including reasonable attorneys' fees arising out of, resulting from or related to any injury, disability or death I may suffer, or loss or damage to person or property, whether arising from the negligence of the above releasee(s) or otherwise, to the fullest extent permitted by law. 5)By participating in the program/activity I consent to the use of photographs, pictures, film or videotape recordings taken of me or provided by me for publicity, promotion, websites or any other reasonable use by SPFA.
