Please note that by signing this Agreement, you give up the right to sue for any injury or damages howsoever caused.
TO: VANCOUVER CHINESE BAPTIST CHURCH (the “Church”) and its directors, officers, employees, representatives, contractors, subcontractors, volunteers and agents (collectively, the “Agents”).
In consideration of the Church allowing the “Participant” (designated and/or undersigned in this agreement), to participate in the events and activities comprising Tsawout Chinese New Year Trip, including, but not limited to the participation of off-site class sessions and scheduled to commence on February 7, 2025 and terminate on February 9, 2025, I, the undersigned, agree on behalf of myself, my personal representatives, heirs and assigns, and, if the Participant is not me but is my child or ward, on behalf of the Participant, his or her personal representatives, heirs and assigns, to the following terms and conditions:
1. I acknowledge that the Activities involve inherent risks, including but not limited to the following:
- Travelling between venue (Tsawout Assembly of Priase, 2781 Mount Newton Cross Rd, Saanichton BC V8M 2E4) and pickup/dropoff location on a motor vechicle, and transportation on BC Ferry vessels
- Injuries and illness as a result of participation in trip activities
- Loss or damage of personal properities during the participation of the trip
and other risks and dangers that may cause property damage, serious injury and possible death to the Participant.
2. I fully understand the risks and dangers associated with the Participant’s participation in the Activities and nevertheless freely and voluntarily accept these risks.
3. I hereby:
(a) waive any and all claims which I may have against the Church and the Agents and release the Church and the Agents from all liability for injury, death, property damage or any other loss sustained by the Participant as a result of the Participant’s participation in the Activities; and
(b) agree that I will hold harmless and indemnify the Church and the Agents from any and all liability for any damage, loss, expense or injury to any third party resulting from the Participant’s participation in the Activities, due to any cause whatsoever including, without limitation, any negligence, breach of contract or breach of any statutory or other duty of care by the Church and the Agents or any of them.
4. I am aware that neither the Church nor the Agents will provide (and has no obligation to provide) the Participant with any disability, accident, liability or medical insurance or compensation should the Participant become injured or cause personal injury or property damage to any third party while participating in the Activities.
5. I acknowledge that this Agreement limits the liability of the Agents to the same extent as it limits the liability of the Church, even though the Agents are not formal parties to this Agreement.
6. This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of British Columbia and no other jurisdiction.
7. Any litigation involving the parties to this Agreement shall be brought solely within British Columbia and shall be within the exclusive jurisdiction of the courts of British Columbia.
8. In entering into this Agreement I am not relying on any oral or written representations or statements made by the Church or the Agents with respect to the safety of the Activities.
9. If any of the terms or conditions of this Agreement or their application to any party or circumstances is held invalid by any court or other authority having jurisdiction, the remainder of this Agreement and the application to parties or circumstances other than those as to which it is held invalid will not be affected.
