Deposit. A deposit of $400 (the “Deposit”) must be paid along with this Agreement. When the Artist receives this signed agreement, and the Deposit, the Artist will reserve the Appointment date and time for You and forgo all other opportunities to work with other clients at that date and time. As such, the Deposit will not be refundable under any circumstances.
If Your tattoo requires multiple appointments to complete, You will need to pay another deposit to secure any such appointment.
You understand and agree that the non-refundable nature of the Deposit does not constitute a penalty and is reasonable, because it would otherwise be impracticable and extremely difficult to calculate the actual damages resulting from any such lost opportunities.
Fees. You will be charged $200 per hour for the work done on Your tattoo.
All work will be charged in 15-minute increments and time will be rounded up to reflect the same. (Ex. If Your tattoo takes two hours and 20 minutes to complete, You will be charged for two and a half hours of work).
There is a two (2) hour minimum for each tattoo, so even if Your tattoo takes less than two hours, You will be charged for a full two hours.
Payment. Payment will be due in full at the end of each Appointment. The Deposit will be applied toward any balance due.
Payment Method. You may pay your balance by credit card, debit card, PayPal or cash. No other payment methods will be accepted.
Chargebacks. If You are unhappy with this Agreement or any of the work performed under this Agreement, You are welcome to pursue any of the remedies offered to You under this Agreement. If You initiate a chargeback after payment of any properly accrued fee or deposit, You will be responsible for any fees imposed on the Artist in connection with dealing with such a chargeback, including, but not limited to any bank fees imposed on the Artist by the Artist's bank, and any fees, including reasonable attorneys' fees incurred by the Artist for having to respond to such a chargeback.
Collection. If the Artist is required to pursue collection efforts to collect any fees due under this Agreement, including any fees subject to a chargeback, You will be responsible for all costs of the same, including, but not limited to, reasonable attorneys' fees and court costs.
Rescheduling. You may reschedule the Appointment up to two (2) times for any reason by providing the Artist with notice at least one (1) week before the Appointment date. There will be no penalty for timely rescheduling.
If notice is not timely given or You need to reschedule more than twice, You will need to pay a $400 Rescheduling Fee before another appointment date and time can be scheduled.
Client agrees and understands that when notice is not timely given, the Artist misses the opportunity to fill that time slot and other clients may miss the opportunity to receive the Artist’s services, as such, the Rescheduling Fee is not a penalty.
Lateness. You should arrive at Your Appointment at the specified Appointment time. If You will be late for Your Appointment, please be sure to let the Artist know as soon as possible. If You arrive more than 15 minutes late, You will be charged a $100 Late Fee.
If You are more than 30 minutes late for Your Appointment, You will be considered a No-Show. Your appointment will then be canceled, and You will need to pay an additional $400 Rescheduling Fee to reschedule Your appointment.
Emergencies. The Artist understands that emergencies can happen at any time, so if You have a true emergency and cannot give the Artist enough advanced notice or end up arriving late to Your Appointment, the Artist, in the Artist’s sole discretion may try to accommodate You.
Please understand that while the Artist wants to be able to accommodate all emergencies, the Artist needs to be able to balance Your needs with the needs of the Artist’s business and other clients. As such, all emergencies will be evaluated on a case-by-case basis and no accommodation is guaranteed.
For the purposes of this Agreement, emergencies are limited to the following:
• Sudden accident, illness, or hospitalization of the Client sudden accident, illness, hospitalization, disability, or death of an immediate family member or loved one of the Client.
• Act of war, terrorism, riot, or other severe civil disturbance.
• Fire, earthquake, flood, hurricane, tornado, or other severe weather or Acts of God.
Artwork Policy.
• Artists will refuse any gang-affiliated, racist, or drug-related tattoos.
• Within 48 hours of the Appointment, the Artist will email and/or text You a preview of Your custom artwork design. This design will be based on the discussion You and the Artist had during Your consultation.
• A maximum of three (3) revisions that stay within the idea discussed at the consultation will be allowed. Your wishes will always be considered; however, You agree and understand that the Artist requires creative freedom and if You require more than three (3) revisions then the Artist reserves the right to cancel Your appointment and Your Deposit will be forfeited to compensate the Artist for her time.
• Prior to the application of Your tattoo You will be given the opportunity to approve the artwork, a stencil of Your design will also be applied to Your skin so that You are able to see the size and placement of Your design.
However, You understand and agree that while the Artist will attempt to do her best to stay as close to the design as possible, there are no guarantees that the design on Your skin will look like it did on paper or on a screen. Furthermore, You agree and understand that tattoos are very personal and the Artist makes no guarantees that You will love the design once it is applied to Your skin. You will still be charged for all time used even if You are not satisfied with Your tattoo.
Mask Policy. You will be required to wear a mask during Your entire tattoo session. The mask will need to cover Your nose and mouth. If You refuse to wear a mask Your Appointment will be canceled, and Your Deposit will be forfeited. If You remove Your mask during Your session, You will be warned once. If You remove Your mask again, the Artist will end the session, and You will be charged for the time used.
Good Vibes Policy. Lude and/or rude behavior of any type will not be tolerated. If You behave Yourself in any questionable way, the Artist, in Artist’s sole discretion, reserves the right to cancel Your appointment and keep Your Deposit or to cut Your session short and charge You for time used.
Intoxication Policy. If You show up to Your Appointment intoxicated or under the influence of any drugs or alcohol no services will be rendered. Your Appointment will be canceled, and Your Deposit will be forfeited.
Guest Policy. The studio is a small space, and the Artist would appreciate it if You came to Your session alone; however, You are permitted to bring up to one (1) guest with You to Your session provided that the guest is over 18 years of age. Any guest You bring will be responsible for complying with the Mask, Good Vibes, and Intoxication Policies above. Failure of Your guest to comply with these Policies will result in Your Appointment being canceled or Your session being cut short, and You being charged for time used.
Animal Policy. Except for registered service dogs no other animals will be permitted in the studio with You during Your appointment. You must notify the Artist ahead of time if You plan on bringing a service dog and proof of registration must be provided. Failure to abide by this policy will result in Your Appointment being canceled and Your Deposit forfeited.
Touch Up Policy. Some tattoos may require touch ups related to the technical application and healing of the tattoo. These touch ups are free if done within three (3) months of the Appointment, with the following exceptions:
• Touch ups cannot be done until the tattoo is fully healed.
• Touch ups due to client failure or negligence to follow our aftercare procedures will not be free and will be charged the same rate as a new tattoo.
• Changes to the original agreed upon tattoo are not considered a touch up and will be charged as a new tattoo.
• Tattoos done on the head, face, genitals, feet, or hands (including fingers) may heal differently and may not be eligible for free touch ups. If Your tattoo is on any of these body parts, it might need multiple touch ups and may be charged as a new tattoo each time. Any complimentary touch up of tattoos done on these body parts will be at the discretion of the Artist.
Photo and Video Release. The Artist may take photos and videos during Your session for the purpose of displaying such photos and videos on her website, social media accounts, in the media, and in connection with the Artist’s advertising campaigns and other promotional materials.
You agree to the release, publication, exhibition, or reproduction of any and all recorded media of Your appearance, voice, and name (if necessary) for any purpose whatsoever, in perpetuity, in connection with the Artist and her initiatives, including, by way of example only, use on websites, in social media, news, and advertising.
You waive and release any claims You may have related to the use of recorded media of Yourself, including, without limitation, any right to inspect or approve the photo, video or audio recording of Yourself, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such record media.
Client’s Representations. Client states and promises that:
• Client is at least 18 years of age and that the birthdate provided above is accurate.
• Client has received, reviewed, and understood the Tattoo Preparation Instructions attached to this Agreement as Attachment A, and Client will follow those instructions. Client further understands that failure to follow those instructions may result in Client’s Appointment being canceled and Deposit forfeited.
• Client has received, reviewed, and understood the Tattoo Aftercare Instructions attached to this Agreement as Attachment B, and Client will follow those instructions. Client further understands that failure to follow those instructions may result in Client’s tattoo not healing correctly and may result in infection or other health complications.
Disclosures. You understand that:
• Tattooing is an invasive procedure in which the skin is penetrated by a foreign object.
• If proper sterilization and antiseptic procedures are not followed by the tattoo Artist, there is a risk of transmission of blood borne pathogens and other infections, including, but not limited to, human immunodeficiency viruses (HIV) as well as Hepatitis B and C viruses.
• Tattooing may cause allergic reactions in persons sensitive to dyes or the metals used in ornamentation.
• Tattooing may involve discomfort or pain for which appropriate anesthesia cannot be legally made available by the person performing the tattooing unless such person holds the appropriate license from a Virginia health regulatory board.
You further understand that the following risks and dangers may be associated with the application of Your tattoo:
• The possibility of discomfort or pain;
• The risk of infection;
• The possibility of allergic reactions to the pigments or other metals used;
• The permanence of the markings; and
• The risks associated with tattoo removal.
Getting a tattoo if you have a medical condition or take medication may not be advisable depending on the nature and severity of your condition or medication. You should always seek the advice of your personal health care provider because there are some medical conditions that may affect your ability to get a tattoo.
Some examples include diabetes, blood disorders, heart problems, skin diseases, immune system disorders, allergies, infections, or pregnancy.
Some medications that may affect your ability to get a tattoo include blood thinners, antibiotics, steroids, immunosuppressants, anticoagulants, or Accutane.
You should consult with your doctor before getting a tattoo if you have any medical condition or take any medication that may affect your healing process, increase your risk of infection, bleeding, scarring, or allergic reaction as any of these may impact your health and interfere with the quality of your tattoo.
Getting a tattoo if you’re pregnant or breastfeeding is not recommended because of the potential risks involved. Aside from the various health risks, there is also a risk of affecting the quality of your tatoo due to hormonal changes that may cause skin stretching, sagging, discoloration, fading, or distortion. It is best to wait until after you have given birth and stopped breastfeeding before getting a tattoo.
Limited Liability. In the unlikely event of a dispute and/or legal action, the Artist’s liability is strictly limited to a refund of any fees paid for the tattoo, or if no amount was paid, then the Deposit.
Enforcement Costs. If You breach this Agreement, You will be liable to the Artist for any reasonable costs associated with enforcing the provisions of this Agreement, including, but not limited to: court filing fees and reasonable attorney fees.
Entire Agreement. This Agreement and any documents attached to it contain the entire understanding between the Parties regarding Your tattoo.
Construction. The language in this Agreement should be construed according to its fair meaning, and not for or against either Party. The normal rule of construction (i.e.: that any ambiguities are to be resolved against the drafting party) should not be used in the interpretation of this Agreement.
Severability. Each provision of this Agreement must be interpreted in a way that is valid under applicable law. If any provision is held invalid, the rest of the Agreement will remain in full effect.
Review and Understanding. You acknowledge that You have read this Agreement in its entirety, understand its provisions and their respective consequences, and are signing this Agreement on Your own free will.
Electronic Signatures. This Agreement must be signed electronically and any digital signature that appears on this Agreement will be considered an original.
Applicable Law and Venue. This Agreement will be governed and interpreted by Virginia law. Any lawsuit arising directly or indirectly out of this Agreement must be resolved in a court located in Alexandria, Virginia and the parties agree to submit to the personal jurisdiction of any such court.
